Prison, Yesterday and Today
Before discussing the evolution of prison let us first define the word Prison. What is prison? It
refers to a penitentiary, an institution for the imprisonment of persons convicted of major/ serious crimes
for a longer periods of time. Prison systems have started early and evolved immensely too.
On earlier days, prison was more like hell. Imagine being confined in an area under the Main
Sewer for a week, now imagine being confined there for years, disgusting, right? Imagine being separated
and sent to the other side of the world because of committing a crime, isn’t it too much? Yesterday’s way
of prison system involved hard labor where massive tasks are shouldered to the prisoners. Deprivation of
everything is also present, allowing only the essentials for living. There is also degradation, using
offensive uttering insulting words or languages on the part of prison staff to the prisoners to degrade or
break the confidence of prisoners. Isolation or Solitary Confinement –non-communication, limited news,
“the lone wolf” will also stab you to death, slowly but surely. The worst of all, Corporal Punishment,
imposing brutal punishment or employing physical force to intimidate a delinquent inmate. Everything
was so inhumane.
Today, persons deprived of liberty are already endowed with human rights. They are no longer treated as
mere physical bodies, they are under the umbrella of numerous laws, protected. However, perennial
problems are still knocking on the door, insufficiency or lack of food, congestion or overcrowding, drugs
inside the jail, brusque treatment of jailguards and many more. The Philippine Government is trying their
best to address the problems in prison system.

CRITICAL ANALYSIS
Article II of the 1987 Constitution specifically provides that the State values human dignity and
guarantees full respect for human rights and that no one loses his dignity and these rights regardless of
what he or she may have done. This policy of the state applies particularly to the treatment of deprived of
liberty under the correctional system they are in. Not only the State is concern of the persons deprived of
liberty but also the United Nations, both are setting national and international standards on the treatment
of persons deprived of liberty and in investigating and monitoring the conditions they are in conducts on
regular basis the spot checking of conditions obtaining in the various correctional institution/facilities in
the country.
Foremost, the provision of basic needs of prisoners is the prime factor to be fulfilled before any
effective rehabilitation program can be committed and tackled. Though persons deprived of liberty, they
are still endowed with the same basic rights for human rights. It is melancholic to say that the most
common problem of persons deprived of liberty is the insufficiency of food provision due to the delay in
release of food allotment and inadequate or unsanitary food preparation. Imagine 35php budget for three
meals, what would you eat? Rice and a can of sardines, I would maybe starve myself to death. Another
major problem is the living space, the basic confinement area. By human standards, all accommodations
provided for the use of persons deprived of liberty, particularly sleeping accommodations shall meet all
requirements of health, with due regard to climactic conditions, content of air, floor space, lighting and
ventilation. For scores of year until now , correctional institutions in the Philippines are usually
dilapidated, congested, no longer suited for human existence, having defective comfort rooms resulting
to unsanitary conditions , lack of sleeping paraphernalia, undersized cells with poor ventilation and
defective water system and lacks potable water. Due to these old prevailing problems, persons deprived
with liberty have a lower chance of rehabilitation and a higher chance of getting illnesses or else become
recidivist.
What is the essence of correctional system? It is used as rehabilitation center, where there should
be organized care and treatment program that suits well and could shape a person deprived of liberty into
a productive one as he/she is released in the community. For example, people with different diseases,
corona virus, diabetes, cancer, and brain tumor, what happens if you inject them with the a medication
and treatment for diabetes? Will those who have Corona Virus, cancer and brain tumor be healed too?
BIG NO, because each of them are needing a specific treatment. Persons deprived of liberty are just like
my example too, each one of them needs a specific treatment, a novice, recidivist, children, women, all of
them needs to be addressed specifically to attend their needs and treatment. Regardless of the crime the
persons deprived of liberty did, they are still humans, flawed yet still have feelings, and they should not
be labelled as sinners and a curse, let’s see them as a subject for change, worthy to create a bigger future
with silver lining.
