COUNTER-AFFIDAVIT

I, HENESSY P. IMAYSAY, MARRIED, of legal age, Filipino, with

residence at Tensuan Site, Poblacion, Muntinlupa City, after having been
duly sworn in accordance with law, hereby depose and state: THAT

1. I am the same person who is the respondent in the instant case;

2. Paragraphs 2, 3, 4, 5, and 7 of the affidavit of Clarissa A. Imaysay

are ADMITTED;

3. Paragraph 6 is DENIED. With respect to it, the truth is: the reason
why she was not employed was because we both decided and
agreed that it is best for the rearing of our children to have their
mother present at all times during the crucial years of their
development. That is precisely why I took it upon myself to
sacrifice and seek employment in other provinces even if it means
being away from my own children. The decision was mutual and
consensual, and she was never, by all means, prevented from
seeking employment;

4. Paragraph 8 is vehemently DENIED. The truth to the matter is we

never ceased all communications over the course of my
employment in Manila, and she would even threaten to leave me
for another man whenever I would miss our regular 8pm
Messenger sessions. Attached hereto as Annex “1” are photocopies
of some of the messages we have exchanged during my almost 7
years of employment in Manila as the complainant alleged.

 It was also false when the complainant accused me of not making
any efforts to see our children. In fact, since I left for Manila on
2013, I went home to Aklan for numerous times and I have
constantly sought to see my children but it was the complainant who
refused to communicate. Attached hereto as Annexes “2” and “3” are
photocopies of my messages to the complainant begging her to at
least allow me see my 2 children even if we both cannot work our
marriage anymore.

5. Paragraphs 9, 10,11, 12 and 14 are vehemently DENIED. I have

also never missed my responsibilities to my family as I would send
60% of my salary to them thru online banking on a monthly basis
for their daily expenses and my children’s education. Attached
hereto as Annexes “4”, “5”, and “6” are the photocopies of my
salary slip, and the receipts of my money transfers to my family for
support;

6. Paragraphs 15, 16, 17 and 18 are likewise DENIED. Shiela Jean and I
never cohabited. We never had an illicit affair as accused by the
complainant. This matter could not have been more false as Shiela
Jean actually has a long-time relationship with his boyfriend, now
fiancé. Sheila Jean has always been just a sister figure to me. Anent
the Certificate of Marriage presented by the complainant, they were
all reproduced and “photoshopped” as well in her desperate attempt
to make a case for her false allegations. Attached hereto as Annexes
“7”, “8” are the original photos where the sham photos were
reproduced and lifted;

7. Paragraphs 19, 20 and 21 are denied. The filing of the complaint is

the complainant’s way of leaving me because she had already lost
all of her feelings towards me and that her jealousy borne out of
pure imagination is eating her up inside even to the point of
dragging our whole family including our innocent children with it.

That I am executing this Counter- Affidavit to attest to the truth of the

foregoing statements and to ask this Honorable Office of the Provincial
Prosecutor of Aklan to DISMISS the above entitled criminal complaint
for lack of legal basis.
