Activity: Differentiate human acts and acts of man by giving a concrete example not
given in the links above. Be consistent of correct grammar and substantial content. This
is good for 20 points.
When we speak of human acts, there are three elements that must be present in the actions,
these actions must be according to man’s knowledge, freedom and will. Actions that are free and
deliberate and that proceeds from the free and conscious acts of man. An act that is always done
for a purpose. On the other hand, acts of man are actions beyond man’s consciousness; not
dependent on the intellect & the will. Man’s actions who lack the use of reason. Absent in any of
the three elements of human acts is an act of man. For an instance, a 5-year-old child ate hotdog
and scrambled egg for her breakfast because she is hungry and she loves it, this is a human act.
However, when that 5-year-old child was forced by her mom to eat vegetables for her breakfast
but the child didn’t like eating vegetables yet she still ate her meal even though it’s against her
will, this is an act of man. Moreover, it is important to know the distinction of human acts and
acts of man because they differ in liability or responsibility. If it is human act, there will be full
responsibility and if it is an act of man, there will be no or lesser responsibility. In fact, this
became bases for the Philippine Criminal Law. For an instance, when a husband killed his own
wife and the other man the day after he caught them having sex in their conjugal bedroom, this is
a human act and the husband will take full liability with his action since he has done it with his
knowledge, freedom and will. However, when the husband caught his wife having sex with the
other man in their conjugal bedroom and he killed the two on the actual scene, this is an act of
man and the husband will take no liability with his action given the fact that he acted in a
justified outburst of passion and that he has no time to regain his self-control. Thus, human act
are actions in accordance to the person’s knowledge, freedom and will, any absent of the three
elements is an act of man.
