INTRODUCTION

Renato Payuban Llenes, 43 years old, father of five, resident of Sitio

Tigcahon, Brgy. Bankal, Lapu-Lapu City, a self- confessed suspect in the

Christine Lee Silawan killing, 16-year-old, Grade 9 student of Maribago High

School and church collector. He created a dummy account under the

name “CJ Diaz” on Facebook to entice the attractive and young Christine

Lee Silawan into romantic relationship with him. He killed Silawan at about

6:00- 7:00 at evening on March 10, 2019, by stabbing her multiple times and

peeling off Silawan's face with the used of barber scissors, motivated by a

fit of jealousy after Silawan allegedly said she was no longer a virgin. Llenes

attempted to rape Christine Lee Silawan but Albayde said no penetration

has been made for the reason of no erection. The PNP Crime Laboratory-7

stood by its finding that Christine was not raped. Before Llenes was arrested

by the Police, the National Bureau of Investigation Central Visayas Regional

Office (NBI-CEVRO) also nabbed Silawan’s ex- boyfriend who was a minor

at the time of the arrest. The boy, however, was eventually released after

the panel of prosecutors cleared him and indicated Llenes for the murder.

Presentation to the media came two days after authorities accosted him

for possession of an unlicensed 45 caliber pistols in Barangay Bankal, and

according to Police Director General Oscar Albayde aside from killing

Silawan, Llenes was also identified as part of the drug watchlist of the Lapu-

Lapu City Police Office. The PNP chief said the suspect voluntarily admitted

his crime through an extra-judicial confession because he was haunted by

his conscience.

Renato Llenes filed a non-guilty plea in the murder case filed against

him in connection with the arraignment of Christine Lee Silawan in Lapu-

Lapu City. His lawyer, Manuel Degollacion, has said that Llenes is not going

to revoke his previous assertion and instead wants the complaint against

him to be downgraded to murder. The homicide sentence is shorter than

the murder penalty, which is up to 40 years in imprisonment. Renato Llenes

was found dead hanging inside the comfort room of the infirmary cell at

around 6: OO am on May 24, 2020. According to Police Colonel Benjamin

Lara, Llenes died due to asphyxia by ligature and Balabat said that one

odd behavior that LLenes showed during his incarceration as narrated by

the other persons derived of liberty (PDL) and which strengthened his belief

that the suspect committed suicide when Llenes he would be seen curling

up in the corner of the prison cell when is being teased about the death of

Silawan and Balabat said that Llenes could have already been

experiencing mental health issues but that this was not accorded prompt

action as no one reported his bizarre behavior to authorities. Since the

prosecution is resolved that Llenes was responsible for the girl’s brutal death

on March 10, 2019, according to Zaragoza , a Lapu-Lapu City Prosecutor,

the case already closed with Llene’s death.

RESULTS AND DISCUSSION

o Biosocial Trait Theory

- Neurophysiological

▪ Renato Payupan Llenes became obsessed with Christine

Silawan after using illegal drugs shortly before

committing the crime and according in

neurophysiological, chemicals and delinquents often

suffers brain impairment, as measured by EEG

(electroencephalograph). And drug addiction

traditionally has been based on the premise that

addiction is a process that results from brain changes

that in run turn result from chronic administration of drugs

of abuse.

o Psychological Trait Theory

▪ Renato Payuban Llenes stabbed Silawan because he

got jealous after she allegedly said she was no longer a

virgin and according to psychological trait theory,

psychological aspects of crime including the association

between intelligence, personality, learning and criminal

behavior.

o Behavioral Theory

▪ Renato Payupan Llenes became assertive because of

the drug’s effects and according to behavioral theory,

human actions are developed through learning

experiences and through the direct effects of drugs on

some sort of the brain; or through its effects on other

reinforces (such as social or sexual reinforces) or

behavioral effects (such as increased attention).

o Rational Choice Theory

▪ Renato Payupan Llenes experience mood swing after

he used of the illegal drugs “Shabu.” And according to

rational choice theory, decision to commit crime is

shaped by human emotions and though processes.

o Cognitive Theory

▪ Renato Payupan Llenes committed suicide because he

has already been experiencing mental health issues and

according to cognitive theory, is a psychological

perspective focuses on mental processes: how people

perceive and mentally represent the world around

them.

CONCLUSION

Renato Payupan Llenes admitted to the crime when he was arrested,

the accused had entered not guilty plea during his arraignment last June

2019. The death of self-confessed killer Renato Llenes has only extinguished

his criminal liabilities, deeming the Silawan case as “closed”, but justice for

Christien Lee Silawan has remained undelivered. Approaches to the

identification of higher-risk offenders that are less focused on psychological

profiling and more on indicators of abusive attitudes and behavior in

relationships should be developed to consider the introduction of some

form of systematic follow-up monitoring of criminal cases to improve

communication between offenders and police work. And Department of

Justice (DOJ) Philippines undertakes further work on to assess the impact of

the justice response on the accused’s behavior.
