AND/OR MOTION TO DISMISS

Plaintiff OAC REALTY & DEVELOPMENT CORPORATION

(hereinafter referred to as “Plaintiff”), by counsel, respectfully states:

1. After a thorough re-examination of the attendant facts and

circumstances surrounding the actions taken that led to the filing of
the complaint, it was ascertained that the case was precipitated and
filed due to a misunderstanding among the parties. Subsequent
thereto, the parties have agreed that they will already settle this case
amicably among themselves out-of-court.

2. Thus, pursuant to Section 2, Rule 17 of the Rules of

Court, Plaintiff withdraws its complaint and seeks the dismissal of the
instant case with the approval of the Honorable Court.

PRAYER

WHEREFORE, premises considered, Plaintiff respectfully prays

that the instant case be dismissed pursuant to Section 2, Rule 17 of
the Rules of Court.

Other reliefs, just and equitable under the premises, are

likewise prayed for.
