obligation will be, at Xxxxx Corporation option, to replace the nonconforming Xxxxx Corporation tool or product or refund the purchase price.

Corporation product, whether direct, indirect, special, incidental or consequential, regardless of the legal theory asserted, including warranty,
contract, negligence or strict liability should the tool be run without Xxxxx Corporation Operational Personnel present.
