MODULE I - Rights to Ancestral Domain and Lands


A. The Ancestral Domain, how it is Respected, Protected, Recognized and
Promoted
The Ancestral Domain of Mandaya ICCs/IPs in Barangay Pichon, Caraga, Davao
Oriental is respected, protected, recognized and promoted thru the approval of their
Certificate of Ancestral Domain Title (CADT) Application before the Commission last
March 20, 2009 with the En Banc Resolution No 98-2009-AD, series of 2009. The Title
itself was registered to the concerned Register of Deeds (ROD) last December 17, 2013
and was awarded to the IP community the following year with the different participation
sectors of government agencies, LGUs headed by former Governor Hon. Corazon
Malanyaon and adjacent IP community witnessing the celebration. As part of the
development framework to improve their socio-economic and cultural well-being and
promote, protect, sustain and conserve the ecology and environment as their proactive
role in responding to climate change, thus, crafting and formulating of an Ancestral
Domain Sustainable Development and Protection Plan (ADSDPP) was started last
December 2014 with a budget allocation of Phase I at the time. n December 2017,
through OPAPP-PAMANA, addidtional funds are appropriated to continue the remaining
phases of the ADSDPP, Presently, ADSDPP is on the finalization of the technical draft
for validation of the IP community. There was also an initial step to strengthen and
enhance the IP Governance or the IPS through the ADSDPP. To enhance and nurture
the indigenous knowledge in the Mandaya Children and youth, the Indigenous
Knowledge Systems and Practices (IKSP) was documented. Lastly, any entity be it
Government or Private interested to invest in the Mandaya ICCs/IPs Ancestral Domain
shall undergo the Free and Prior Informed Consent (FPIC) Process.

and awarded to the community on April 2014.

authorized representative signed the Memorandum of Agreement with
representatives of Volga Power Corporation re: CP Application for Caraga A3
Hydroelectric Power Project.

A. Indigenous Political Structure (IPS)
The advice and pronouncement of justice is administered by the
Mangkatadong. He is the powerful leader of the community. Within the circle of
the Mangkatadongs of the community, there is one they regard as Likid or
Bangon. The decision is always done in consultation with his Council, who they
referred to as konsiyo, and the errands around are called tabadtabad.

A Mangkatadong is selected not by election and inheritance. Anyone can


become a Mangkatadong if he possess the characteristics of being just, full of
wisdom, fair in carrying out justice no matter who the culprit is, trustworthy, of
good family background, determined, brave and of good moral character. Anyone
found to be using his fake title or any titles attributed to our leaders shall be made
answerable through our customary practices.

The right hand of the Mangkatadong is the Bagani. He executes the


pronouncement of the Mangkatadong. He ensures peace and order in the
community and enforces peace based on justice. The Bagani has to
consult the Mangkatadong on what to do because he shall be held responsible
for any false move or whatever consequences may take place in his failure to
consult the Mangkatadong. Such shall lessen his stature and he shall be called
“ilaw na bagani” which means he is unfitted to the title and his actions are not
within the rim of justice, thus shall he bear no respect from the community.
