How to answer questions- David-Kratos Ampofo

Disclaimer- Your lecturer may require a special style in answering his questions.

1. Write clearly
2. Make your script as organized as possible
3. Underline your cases
4. Brand your question in a way that invites the lecturer to mark your paper.

Problem Questions.

Area of Law- it’s a matter of style. If its not demanded by your lecturer, you do not need to use it. It
helps you know if you are deviating.

Issues- List your issues.

Rules- List your rules . They should be in the order in which your rules are presented. Do not refer
the lecturer to your issues. Instead restate the issue. In discussing your rule you need to discuss the
principle. For example, if your rule is Invitation to treat, you define what invitation to treat is and
then you state where you got the definition from( authority for rule).

Application- This is where you resolve the issue . A mere restatement of the facts is not enough.

Conclusion – Concise summary of each issue.

Alternatively, after listing your issues you can let your answer flow in the form of an essay. Make
sure that it flows in a proper logical sequence.

A question may ask you to advice parties. This boils down to a matter of style in your conclusion. It
basically means that after your rules, analysis and conclusions, you state the advice you’ll give to the
party.

If a question asks you to give judgement as a judge use the IRAC format to answer.

Essay questions

They test your knowledge and appreciation of the law

Introduction – Introduce your essay using if possible recent events relating to the question. For
example, if there’s a question on the rule of law and there’s recent happenings in relation to the rule
of law you can use it here.

Your introduction is a matter of style. What’s important is you introduce your topic.

You should also explain the main topic under consideration in the question.

You should incorporate a few key authorities to your topic. For example, showing constitutional
articles supporting the rule of law

Body - A classical essay question will require a balancing act. For example, advantages /
disadvantages , reason for/ against .

Each point should have a paragraph . The paragraph should have an introduction, the main issue to
be analyzed then follows (this is where the actual law on the subject matter of the paragraph is
discussed ) then there’s a concluding sentence . Avoid being dogmatic in your essay . Separate your
views from the actual law. Any other thing you want to add should come under recommendations.

Recommendations- This is where you can put your personal views . Avoid stating these views as the
law. Dissenting opinions and other persuasive authority can be used to support your point.

Conclusion- Draw your essay to an end . it is a matter of style .
