Subject : Request to Conduct of Alternative Procurement – Negotiated Procurement
(Emergency Cases)
This is to request the CONSTRUCTION OF BARANGAY ISOLATION UNIT be conducted under Alternative
Procurement: Emergency Cases pursuant to Section 52.3 of Republic Act No. 9184 and its revised
Implementation Rules and Regulations (IRR) of 2016.

The Proclamation No. 929, was promulgate on 16 March 2020 declaring a State of Calamity throughout
the Philippines for a period of six months or until 12 September 2020. Due to the rapid increase of
infection cases in the country, the President signed Proclamation No. 1021 on 16 September 2020, the
declaring the Extending the period of State of Calamity throughout the Philippines due to Corona Virus
Disease 2019 declared under Proclamation No. 929, S. 2020 for the period of one (1) year, effective
12 September 2020 to 12 September 2021, unless earlier lifted or extended as circumstances may
warrant.

It is established public policy, as well as a statutory mandate that all government procurement shall be
done through competitive bidding. However. As an exception, in order to promote efficiency and
economy, Article XVI of RA No. 9184 provides for instances where resort to Alternative Procurement
modalities is allowed, e.g Emergency Cases. Therefore, procurement entities can apply the rules on
Negotiated Procurement- Emergency Cases during a state of calamity like COVID-19 pandemic. It is
understood that said modality is allowed in the following instances:
(a) In case of imminent danger to life or property during a state of calamity;
(b) When time is of the essence arising from natural or man-made calamities; or
(c) Other causes where immediate action is necessary to prevent damage to or loss of life
property, or to restore vital public services, infrastructure facilities and other public utilities.

The coronavirus disease 2019 (COVID-19) pandemic has presented numerous challenges to health
systems, including large numbers of patients with COVID-19 that can overwhelm health facilities and
staff. Treatment for mildly to moderately ill patients may not required hospitalization, but some people
may be able to isolate safety at home, putting household contacts and, in turn, community members at
risk of COVID-19. Isolation facility, or community isolation centers can provide people with mild to
moderate symptoms, who are at increased risk for severe disease, with a safe space to voluntarily
isolate until they are no longer considered infections according to IATF.

Such facilities can reduce household transmission and reserve health facility resource for more seriously
ill patients.

As the virus continues to spread in the country, hospitals face shortage of isolation centers and medical
supplies which may result to unwanted increase of morality rates.
The procurement of CONSTRUCTION BARANGAY ISOLATION UNIT provides “immediate response and
initial recovery steps to avoid loss of life, injury, disease and other negative effects on human, physical,
mental and social well-being, together with damage to property, destruction of assets, loss of services,
social and economic disruption and environment degradation”, pursuant to the government
Procurement Policy Board Resolution (GPPB) No. 03-2020 2 amending the Consolidated Guidelines for
Alternative Methods of Procurement or Annex “H” of the 2016 revised IRR of RA No. 9184
