RA 10601 – AN ACT PROMOTING AGRICULTURAL AND FISHERIES


MECHANIZATION DEVELOPMENT IN THE COUNTRY

Article I – Declaration of Policy, Definition of Terms and Coverage; consists of 4


sections. The section 1 tells that this Act shall be known as the “Agricultural and Fisheries
Mechanization (AFMech) Law”. The section 2 is the Declaration of Policy that consists of 6
policies. The 3rd section is the Definition of Terms. The Agricultural and fisheries machinery
refers to equipment for the production, harvesting, processing, preserving, transporting,
manufacturing, distribution of agricultural and fisheries products. The agricultural and
fisheries mechanization refer to the development, adoption, assembly, manufacture,
application of appropriate… The agro-industrial processing refers to the local activity or
series of activities to maintain… the fishing boat refers to any boat, ship, or other watercraft
that are designed to equipped to be used for taking fishery species… And the 4 th Section is
the Scope and Application is the provision of this Act that shall supply to the research
development, project implementation of agricultural fisheries, machinery and equipment.

Article II – The National Agri-Fishery Mechanization Program; consists of 2


sections. The section 5 is The National Agri-Fishery Mechanization Program, which shall be
formulated by the Department of Agriculture that follows the 6 objectives. The section 6
Program Implementation is the overall implementation of the National Agri-Fishery
Mechanization Program and shall be coordination by the DA through the Undersecretary duly
designated by the Secretary.

Article III – Research, Extension and Human Resource Development; consists of


8 sections. The section 7 is the Unified National Research and Development (R&D) and
Extension Agenda. The section 8 Agri-fisheries Mechanization RDE Network is hereby
organized and composed of research and educational institutions, LGUs, nongovernment
organizations and so on. It is responsible for the formulation and implementation of the
National Agricultural and Fisheries Mechanization RDE Agenda. For the section 9, Agri-
fisheries Machinery and Equipment Service Centers and the section 10 is Agri-fisheries
Mechanization and Engineering Resource Network. The section 11, Research Grants, it is a
section that contains the enhancement of research and technological development on
agricultural and fisheries mechanization. The section 12 is the Training and Scholarship
Program and the section 13 is Manpower Complement. The last section of this article is the
section 14, Skills Certification of Agricultural Machinery Technicians and Operators.

Article IV – Local Assembly, Manufacture, Supply and After-Sales Service; the


section 15 is the Local Assembling and Manufacturing. Production of locally-made engines
and other machinery for agricultural and fisheries purposes shall be promoted and encouraged
by the DA in partnership with the private sector, and through joint venture agreements. The
section 16 Incentives for Local Manufacturers and Assemblers of Agri-fisheries Machinery
Ventures in local manufacture, fabrication and assembly of Agri-fisheries machinery and
equipment shall be eligible for loans under the Agricultural Competitiveness Enhancement
Fund (ACEF) under the program of the DA. For the 17 is After-Sales Service. All
agricultural and fisheries machinery assemblers, manufacturers, importers, suppliers,
distributors and dealers are required to provide after-sales service and warranty to then
respective clients which shall be monitored by the agriculture offices of the LGUs and the
Bureau of Agricultural and Fisheries Engineering (BAFE).

Article V – Testing and Evaluation, Registration, Standardization and


Accreditation; consists of 4 sections. The section 18 is the Testing and Evaluation,
Agricultural and fisheries machinery and equipment to be sold in the market shall pass
through testing and evaluation by the Agricultural Machinery Testing and Evaluation Center
(AMTEC). The section 19 is the Registration of Ownership of Agricultural and Fishery
Machinery and Equipment, is that all the owners of agricultural and fishery machinery and
equipment must register these with the agriculture offices of municipal and city government
units. The section 20 is Registration of Manufacturers, Fabricators, Assemblers and Importers
describes that all manufacturers, fabricators, assemblers and importers must register with the
BAFE. The section 21 is Standards Development and Enforcement and section 22 is the
Classification and Accreditation of Assemblers, Manufacturers, Importers, Suppliers,
Distributors and Dealers.

Article VI – Institutions; consists of 5 sections. The section 23 Agricultural and


Fisheries Mechanization Committee shall act as an advisory body to ensure the success of the
programs and activities of the DA concerning agricultural and fisheries mechanizations. The
section 24 is Strengthening the DA Agricultural and Fishery Engineering Groups. The section
25 is the Philippine Center for Postharvest Development and Mechanization (PHilMech). The
PHilMech shall coordinate, plan and execute agricultural and fishery mechanization and
postharvest RDE programs and projects of the DA. The section 26 is the Bureau of
Agriculture and Fisheries Product Standards. The section 27 is the Agricultural Machinery
Testing and Evaluation Centers (AMTEC). The AMTEC of the College of Engineering and
Agro-Industrial Technology (CEAT) of the UPLB is hereby institutionalize.

Article VII – Responsibilities of the Local Government Units; consists of 2


sections. The section 28 Implementation by the LGUs, known as the “Local Government
Code of 1991”, shall undertake applied research, extension, dispersal, management and
regulation of agricultural and fisheries machinery and equipment, including the collection of
fees. The section 29 Strengthening the Agricultural Engineering Groups of the LGUs, the
planning, coordinating, regulating and implementing bodies at the provincial, city and
municipal levels on agricultural and fisheries engineering, mechanization and infrastructure
programs and projects.

Article VIII – Prohibited Acts, Penalties and Sanctions; consists of 3 sections. The
section 30, Prohibited Acts is the list of prohibited acts with 4 violations. The section 31 is
Penalties where any person who shall violate any provision of this Act shall, upon conviction,
be subject to a 􀂡ne of not less than One thousand pesos (P1,000.00) but not more than Ten
thousand pesos (P10,000.00) or imprisonment of not less than two (2) months but not more
than one (1) year, or both The section 32 is Sanctions.

Article IX – Miscellaneous Provisions; consists of sections. The section 33


Agricultural and Fisheries Mechanization Programs at the Local Levels and the section 34 is
Contiguous Farming. The section 35 is the Use of Renewable Energy and the section 36 is
the Infrastructure Support. The section 37 Implementing Rules and Regulations and for the
section 38 is the Funding, the section 39 is the Congressional Oversight Committee. The
section 41 is the Repealing Clause and Effectivity Clause is the section 42.
