FINSHING WORK AGREEMENT

This AGREEMENT made on the 30th day of August 2021

Between

W/Ro Sebele
(Hereinafter called EMPLOYER) on the one part.

And
MEALATRA Trade and Engineering Service Plc.
(Herein after called CONTRACTOR) on the other part,

WHEREAS the EMPOLOYER is desirous of to have construction of finshing work for G+7 apartement
building. The works are delegated to contract for the supply of labor and equipment.

WHEREAS the CONTRACTOR has agreed to undertake the construction/execution of finshing work for
G+7 apartement building in line with the design as per the terms and conditions of CONTRACT
DOCUMENTS.

Now, therefore, the parties agreed as follows;

1. GENERAL PROVISIONS

a. In the AGREEMENT words and expressions shall have the same meanings as are respectively
assigned to them in THE STANDARD CONDITION OF CONTRACT.

b. Contract documents as defined under Article 2 shall be taken as complementary and mutually
explanatory of one another, but in the case of ambiguities or discrepancies the contract document
shall prevail over all other contract documents including general conditions of contract.

c. For the consideration hereinafter mentioned the CONTRACTOR will upon and subject to the
conditions hereto annexed executes and completes the works shown upon the said drawings and
described or referred to in the said specification and bill of quantities.

2. CONTRACT DOCUMENTS
a. Drawings
b. Agreed unit price

Shall be known as THE CONTRACT DOCUMENTS. These CONTRACT DOCUMENTS represent


the AGREEMENT between the EMPLOYER and the CONTRACTOR and that there is no agreement
or any other document relating to or in any way affecting this AGREEMENT at this stage and these
CONTRACT DOCUMENTS suspend all other agreements and drawings prior to the date hereof.

3. AGREEMENT CONSIDERATION

In consideration of the payments to be made by the EMPLOYER the CONTRACTOR hereby


covenants with the EMPLOYER to execute and complete the works and remedy any defects therein
in conformity in all respects with the provisions of the CONTRACT. The EMPLOYER hereby
covenants to pay the CONTRACTOR in consideration of measured volume of execution and
completion of the works and the remedying of defects.

4. INTERIM PAYMENTS

Interim payments shall be made as the execution of works, progresses at the completion of each floor
for each activity.

5. CONTRACT TIME AND LIQUIDATED DAMAGES


a. Works as laid down in the AGREEMENT shall begin immediately after signing the
agreement.
b. For each calendar day of delay in the completion of the works, the CONTRACTOR shall
pay to the EMPLOYER a sum of Birr equal to one per thousand of the contract price.

c. The completion time of the works will be 135 calender days.

6. STATUS OF CONTRACT

It is agreed and understood that the said CONTRACT AGREEMENT shall be interpreted according
to the Ethiopian law and this AGREEMENT is deemed to be an ADMINISTRATIVE CONTRACT
in accordance with ARTICLE 3132 of the 1960 Civil Code of Ethiopia.

7. ADVANCE PAYMENT
The employer shall pay advance payment to the contractor, total amount 120,000.00 (one hundered
tewenty thousand)birr which will be repaied by deducting 20% from each interim payment after
agreed with the gurantee condtion.

IN WITNESS, whereof the parties have caused their respective common seals to be hereunto affixed
on the day and the year first above written.
