LANDSCAPE CONTRACT AGREEMENT NO#1/2020

This is a Landscape work contract agreement that is made on ___in Axum,

Purpose
The purpose of this contract is for landscape work of

at Axum, hawelti Keble for the project by the contractor.

Article 1 General Provision

1.1 In this agreement words and expression shall have the same meanings or are respectively
assigned to them in STANDARD CONDITIONS OF CONTRACT referred in close 2.1
below.
1.2 For the consideration hereinafter mentioned, the contractor will upon and subject to the
condition stated in the documents hereto annexed, execute and complete the works shown
upon the said drawings described or referred to in the said bill of quantities, the
specification and the said conditions within

with VAT for landscaping Whereas

this amount is a unit price method on the drawing and BOQ.

Whereas: both parties have agreed to enter in to this agreement, committed to fulfill all terms
and conditions obligated by this agreement as outlined below:

Article 2.Contract documents

It is agreed and understood that the following documents will be part of the contract agreement.

2.1 This agreement and other related attached documents.

2.2 The letter of acceptance (Attachment #1)
2.3 Signed bid proposal of the contractor (Attachment #2)
2.4 Signed prints of drawings (Attachment #3)
2.5 Listed current prices of industrial materials

The above stated documents shall be known as “contract document” and represent the agreement
between the Client and the Contractor and that there is no other agreement or any other
documents relating to or in any way affecting this agreement at this stage and that these
documents supersede all other agreements and drawings prior to the Data hereof.

Article 3 Responsibility of the contractor

The Contractor is desirous of undertaking the complete SUPPER-STRUCTURAL works of
landscape at AXUM, kebele Hawelti, H.No: new (hereafter called ‘the work’) at the above
mentioned places based on the attached drawings and a specification describing the work and
will have the following responsibilities.

3.1 All works should be to the best standard acceptable by the project engineer, see the
attached standard plan and bill of quantities which is now made an integral part of this
contract.
3.2 The contractor will ensure qualified personnel are employed in carrying out the work.
3.3 The contractor will be responsible for all labor, materials, machineries and equipment costs
associated with the work.
3.4 The contractor will ensure that ‘the works’ will be completed within the agreed timeframe
50 of calendar days.
3.5 The contractor will be responsible for the payment of any government duties and taxes.
3.6 The Contractor would be responsible for the works he has executed.
3.7 Amending the design based on site works or client’s demand may vary in quantity and total
contract amount of the agreement.

Article 4 Responsibility of the Client

4.1 The Client has the right to discontinue the agreement if the work is not to the standard
quality accepted by the conditions and regulations of the government of Ethiopia.
4.2 In consideration of the payments to be made by The Client to The contractor herby
covenants with The project to execute and complete the works and remedy and defects
there in conformity in all respect with the supervision of the contractor and The Client
hereby covenants to pay The contractor in consideration of the execution and
completion of the works and the remedying of defects there in contract price for.
4.3 The Client will pay the contractor after takeoff sheet and payment certificate is
approved.

Article 5 Condition of Contract

 The Contractor agrees that the contract agreement covers all services, and will not charge
or penalize the Client for extra time, provided it is still within the limit of calendar days. Any
delay in the delivery of construction material caused by the Contractor delay in submitting
materials requisition, will not warrant such time extension, therefore the construction
should still be completed within the agreed calendar days timeframe.
5.1 The Contractor agrees that any delay in the completion of the construction activities
without prior consent of the Client will be a prorated daily penalty for The Contractor.

Article 6 CONTRACT PRICE & PAYMENT CONDITIONS

6.1 The total amount of contract price is

VAT Advanced payment for this work will be 30% of the total contract amount
released within Two days from the date of signing of this contract agreement; and it will
be deducted by the same percentage from each payment.
6.2 First payment is after completing 40% of the total work executed
6.3 Second Interim payment 70% of the total Contract works executed.
6.4 Final payment is up on the completion of all the contract works.
6.5 All payments shall be endorsed to the company’s account.
Article 7. Agreement Enforcement
The Contractor shall be accountable for any harm that might result from mal function of
their respective obligation herein contained under the civil code of Ethiopia. If dispute arise
between the CLIENT and the Contractor the party here by agree to resolve it through
mutual discussion. In case of failing to rich consensus the party has agreed to take the case
to an authorized court of appropriate jurisdiction under Ethiopian law.

WAIVER
The Contractor and The Client has agreed that any dispute regarding the fulfillment if this
agreement shall be settled amicably, and shall not be taken to the court of law, and as such, both
waived its rights to such claims.

Article 8 EFFECTIVE DATE OF THE CONTRACT

This agreement is in operation starting from , 2020 and shall come in to
effect immediately after the signing of it between the two parties.

corporate seals and by the hands of their proper officers hereunto duly authorized.
