BETWEEN THE OWNER & THE CONTRACTOR

Where the client desires to get Construction of Majlis Block, Constructed at:
Plot No.3250437
Zabeel First, Dubai,UAE

ALL AS PER FOLLOWING CLAUSES

TERMS & CONDITIONS:


1. Completion period shall be 6 months + 15 days Mobilization (Practical completion) from the
date of final approved drawings/building permit approval from DM or site demarcation
whichever is later.
2. Total cost of the construction shall be Dhs. 352,000- (Dhs. Three Hundred Fifty Two
Thousand only) which shall be paid to the Contractor according to the progress of work
certified by the Consultant.
3. An advance payment of 20% of the contract value shall be paid on signing the Contract
Agreement against Company Guarantee Cheque.
4. Remaining payment shall be made as per the work progress on site payable within 14 days
of submitting the running bill. 7 Days for Consultants approval and 7 Days for Client to
release the Payment.
5. Release of First 5% retention on receiving DM BCC and 5% Final retention on receiving DEWA
connections against company guarantee Cheque.
6. Building permit fees, Permanent connection charges for Electrical, Plumbing, Drainage,
Telephone and Transformers are excluded.
7. Shoring, Dewatering, any kind of temporary support, soil improvement works are excluded
from our scope of works
8. Hard, soft landscaping and irrigation works including sweet soil excluded from our scope of
works.
9. Transformers, RMUs, HV Cable, main incoming cable to transformer & Rerouting of any
existing cables is excluded.
10. Any subcontractor or provisional sum item removed or supplied or added to the contract by
the Client shall be charged 10% as builder’s work, Contractor’s over heads and profits.
11. Any type of changes or additional works shall be carried out only on receiving the drawings
and written approval of Variation in form of time and cost from the Client and Consultant,
no verbal instructions or changes shall be carried out on site during the time of execution.
12. All the instructions either Client or Consultant shall send by mail to the Main Contractor. No
site instructions shall be carried out without approval of Client and Consultant.
13. PRICE ESCALATION clause is applicable for all the items described in the Bill of Quantities.
14. Our prices are based on preliminary tender drawings and Specification provided by the
Consultant and any changes in DM approved drawings shall be charged extra as variation.
15. 5 % VAT Amount should be paid by Client to the Contractor for every monthly invoice.
16. On non-completion of the work within stipulated period of completion, the contractor would
be liable for penalty charges at the rate of Dhs.300 per day for the owner. The maximum
limit of penalty will be 5% of contract amount.
