Subject- Problem of water scarcity in a slum area in Jaipur, infringing their fundamental rights-
Seeking relief and legal action.

I am Hitarth Dixit, a public-spirited citizen and a student of law, also an intern at UbAdvocate. I
the undersigned representative of the people of JJ Colony (Jhughi slum area) where about 1000
people reside, addressing this issue urgently of water scarcity. As people living in this area are
poor and ignorant about their rights in law, I am writing you on their behalf.

For the last two months, there has been a serious drinking water problem. Earlier the government
used to send water tanks on daily basis. The water level has gone down. Pump sets are prohibited
by the government. Due to this, people are suffering in terms of health, hygiene, law and order.
Several representations were made to the government and all concerned authorities but in vain.

As your Hon’ble self is aware, that the water right has been protected as a fundamental human
right by the Hon’ble Supreme Court as part of the Right to Life guaranteed under Article 21 of
the Indian constitution. The Hon’ble SC in the cases of Delhi Water Supply & Sewage v. State
of Haryana & Ors (1996) and Chameli Singh & Ors. V. State of U.P. (1996) held that the water
right is a fundamental right and the government cannot ignore it. The Hon’ble SC in another case
of State of Orissa v. Govt. of India (2009) gave direction to the central government that the
problem of water scarcity should be resolved whether they have to seek help from foreign
nations. The Hon’ble SC advised the central government to make a committee of scientists and
convert the ocean water into drinking water. The Court also advised them to extract water from
Himalayan glaciers if needed.

It is my humble request to your Honor to look into this matter. The water level has gone down
and the government has prohibited pump sets. Due to this, these people are suffering in health,
hygiene, law and order.
My Honor, being a student of law, I deem it my duty to draw your Honor’s attention to the above
happenings, I do hope and trust that you would look into the matter and take corrective steps as
deemed appropriate to protect this institution.
