I am Utkarsh Gupta, a public-spirited citizen, a law student and an intern at


ubAdvocate who is writing this letter on behalf of some aggravated citizens to
seek to file a PIL by the way of this letter as the petitioner are poor and do not
have the sufficient means to approach the court.
The petitioner are the residents of JJ colony, Kanpur. JJ colony is a jhuggi slum
area where about 10000 people reside. They are poor and ignorant about their
rights in law. They do not have any means to come to court also. For the last
two months there has been a serious drinking water problem. Earlier the
government used to send the tank on daily basis. Water level has gone down.
Pump sets are prohibited by the government. Due to this people are suffering in
terms of health, hygiene, law and order. A number of representations were made
to the government but all failed.
Under Article 21 of the Constitution of India ‘Right to Life’ is a fundamental
right and this right is associated is with Right to sufficient water availability to
every person by the Supreme Court of India in the case of ‘Delhi Water Supply
& Sewage ... vs State of Haryana & Ors, 1996’ and ‘Chameli Singh vs State Of
U.P on, 1996’. It also violates there right of adequate shelter under Article 21 if
the Constitution of India. Various projects were undertaken to provide drinking
water to every citizen of India one of which was the National Water Policy of
2012 in which it was targeted to give every person and household in India with
adequate water availability. The residents of JJ colony are entitled to proper
drinking water facility under this scheme and as stated above the residents
made several representations to the governments but to no avail which is a
clear violation of their fundamental right under Article Article 21 of the
Constitution of India. The Supreme Court also stated that in State of Orissa vs
Government of India, 2009 that the availability of water is a fundamental right
and government cannot ignore such pleas.
I request you to please treat this letter as a PIL and provide some relief to the
residents of JJ colony by directing the appropriate authorities to make pipelin3e
water available to the residents of JJ colony and in the meantime they should
start sending water filled tanks as needed by the colony daily. Also I would like
to request that households of the colony be connected to a water possible as
soon as possible.
