PREFACE

Uniformed members of the Philippine National Police (PNP) and their


beneficiaries are expressly granted certain welfare benefits under
the provisions of RA No. 4864, as amended by Presidential Decrees
No. 448 and 1184, an. Republic Acts No. 6963, 6975 and 8551, thru
a PNP welfare benefits program administered by the National Police
Commission (NAPOLCOM).

These benefits are granted after the compensability of the claim for
such welfare benefits are determined and/or established by
sufficient proofs to be service-connected. The claimants are
required to comply with all the requirements prescribed by law such
as the submission of pertinent documents required thereto.

In order to better communicate the details of said program to its


clientele, the Commission deemed it imperative to issue this
handbook which provides all the basic information on the
requirements, processes and procedures for the availment of the
benefits provided under aforesaid laws.

The NAPOLCOM hopes that in so doing, the beneficiaries concerned


will become more aware of the benefits and privileges accorded by
the government to the men and women comprising the PNP, in
recognition of the invaluable public safety services they are
providing which are so vital towards the attainment of peace and
order and national and local development.

TOTAL PERMANENT PHYSICAL DISABILITY
BENEFIT (BENEFITS UNDER R.A. NO. 4864 (POLICE ACT OF
1966 AS AMENDED BY PRESIDENTIAL DECREE NOS. 448 AND 1184)

 WHAT IS TOTAL PERMANENT PHYSICAL


DISABILITY?

 Total Permanent Physical Disability (TPPD) is any impairment


of the mind or body which renders the disabled uniformed PNP
member incapable of performing substantially the duties of a
police officer and which is expected to be long, continued and
of indefinite duration, provided, that irreparable loss of the
power of speech, or sense of hearing, or loss of one or both
hands or feet, or loss of one eye or both eyes, or loss of limbs,
or brain injury resulting in incurable imbecility or insanity shall
be considered total permanent physical disability.

In all cases, the disability shall be deemed permanent if it has


persisted for a period exceeding six (6) months, without fixed
healing period and renders the uniformed PNP member
incapable of performing the duties and functions, Provided
further, that in case the disability is found to be permanent
beyond doubt upon medical examination of said member, the
waiting period of six (6) months shall no longer be applied.

Uniformed PNP Member - an officer or non-officer of


the PNP appointed in accordance with R.A. No. 6975, as
amended.

Disability - any loss or impairment of the normal


functions of the physical or mental faculties of a
uniformed PNP member which reduces or eliminates his
capability to continue with his present employment.

Injury – any harmful change in the human organism


arising from any incident sustained at work, while at the
work place, or elsewhere executing an order from the
PNP, or sustained by reason of the performance of duty.

BENEFITS?

 An application for TPPD may be filed by the uniformed PNP


member himself or in case of incapacity, his duly authorized
representative.

In case a uniformed PNP member who has been found to be


disabled refuses to apply for total permanent disability
retirement, he/she shall be separated or attrited pursuant
to the provisions of Section 29 or R.A. No. 8551 as
implemented by Memorandum Circular No. 2008-005
“Prescribing Policies, Procedures and Guidelines Governing
the Attrition System for Uniformed Personnel of the PNP.”

 WHAT ARE THE BENEFITS AWARDED?

 The following TPPD benefits shall be awarded to a PNP


member who incurred such disability in line of duty or
service-connected sickness or injury:

1) Gratuity equivalent to the claimant’s one (1) year basic


salary;

2) Lifetime monthly pension equivalent to eighty (80)


percent of the claimant’s basic salary;

3) Reimbursement of reasonable expenses for medicines,


medical attendance, hospital fees, necessary
transportation and subsistence; and

4) Restoration of deducted leave credits.

 WHEN IS THE EFFECTIVITY DATE OF RETIREMENT?

 The retirement of a PNP member by reason of TPPD takes


effect only upon approval of the adjudication by the
concerned NAPOLCOM Regional Director.

If a uniformed PNP member has been compulsorily retired


pursuant to Section 39 of R.A. No. 6975, as amended, prior
to the approval of his claim by the Commission for TPPD
benefits, it having been established that he incurred such

disability before his compulsory retirement, the effectivity
payment of pension by the Commission shall likewise
commence upon the approval of the adjudication.

In no case shall a uniformed PNP member be allowed to file


both optional retirement and an application for total
permanent physical disability.

Prior to the approval of the application by the Commission,


the uniformed PNP member shall continue to report for duty
and render police service and receive his salary as such,
unless he is physically incapable of performing his duties or
he has already reached his compulsory retirement in which
case he shall automatically cease to report for duty and to
receive salary.

Commission – refers to the National Police


Commission created under R.A. No. 6975, as
amended.

 WHERE TO FILE CLAIM

 All uniformed PNP members assigned with the National


Headquarters, National Support Units (NSUs) and other PNP
Special Units shall submit their individual APPLICATION
LETTER FOR TOTAL PERMANENT PHYSICAL DISABILITY
(TPPD) retirement under oath to the Directorate of
Personnel and Records Management (DPRM) thru the
Pension Retirement and Benefits Administration Service
(PRBS) for recording and appropriate action.

All other PNP members assigned with the Police Regional


Offices shall submit their individual APPLICATION LETTER
FOR TPPD to the Regional Personnel and Human Resource
Development Divisions (RPHRDD).

 ENDORSEMENT OF APPLICATION TO HEALTH


SERVICE

 The concerned Regional Personnel and Human Resource


Development Division (RPHRDD) shall within fifteen (15)
days from receipt of the application for TPPD endorse the

same to the Regional Health Service for the conduct of
initial medical screening.

After the initial medical screening, the Regional Health


Service shall submit its medical report to the Chief, RPHRDD
who shall in turn endorse the application for TPPD together
with the said report to the DPRM.

All applications of PNP members for TPPD


endorsed/submitted to the DPRM shall be referred to the
Health Service for final medical screening.

 CONDUCT OF MEDICAL SCREENING

 The Director of the Health Service thru the Chief, PNP


General Hospital shall assign a physician who specializes in
the field of medical expertise involving the case of each
applicant for TPPD to conduct the medical examination.

Such medical examination shall be conducted in the


Regional Health Service Unit where the applicant/claimant is
assigned if it is physically difficult for him or it will seriously
affect his health condition to report to the PNP General
Hospital for examination.

All results of medical findings in each case are submitted to


the Director of the Health Service. Cases where the
applicants are categorized as P4 shall be indorsed by the
Director of Health Service to the Medical Screening
Committee for Physical or Mental Incapacity (MSCPMI) for
final medical screening.

MSCPMI conducts final medical screening and submits


results of deliberations to the Director of the Health Service
who shall re-endorse each case back to DPRM thru PRBS.

 DELIBERATION OF THE APPLICATION BY THE TPPD


BOARD

 Upon receipt of the endorsement from the Director of the


Health Service of the result of the final medical screening,
the TPPD Board shall convene and deliberate all cases

categorized as P4 and recommend thru resolution thru the
DPRM.

 ENDORSEMENT OF THE RECOMMENDATIONS FOR


TPPD RETIREMENT TO THE COMMISSION

 All cases confirmed and recommended for TPPD retirement


shall be endorsed by the PNP to the Commission thru the
Legal Affairs Service (LAS) for evaluation.

In case of denial or disapproval of the said application for


TPPD at any stage of the Investigation and adjudication of
application for Total Permanent Physical Disability Benefits
and claim for death benefits, the applicant may file a
petition for re-evaluation to the Commission thru the Legal
Affairs Service (LAS) within fifteen (15) days from receipt of
copy of the Resolution of the TPPD Board denying such
claim.

The decision of the Commission shall be final.

 EVALUATION AND EXAMINATION OF THE


APPLICATION BY THE NAPOLCOM MEDICAL OFFICER

 The NAPOLCOM Medical Officer shall evaluate the


application and the recommendation of the PNP for the
TPPD retirement of a PNP member.

Medical Officer – refers to the Commission’s Medical


Officer, Legal Affairs Service

In cases of denied or disapproved applications for TTPD, the


NAPOLCOM Medical Officer shall nevertheless comment on
the merits of the petition.

In the evaluation of the application, the Medical Officer may


require submission of additional clinical or medical records,
personally examine the claimant PNP member or require
him to undergo laboratory tests.

Thereafter, the Medical Officer shall submit his


recommendation to the Director, Legal Affairs Service who

shall forward the complete records of the application for
TPPD to the Regional Director of the NAPOLCOM Regional
Office that has administrative jurisdiction over the police
unit of the claimant for adjudication.

 SUPPORTING DOCUMENTS TO AN APPLICATION FOR


TPPD

 Before or during the hearing of the application, the claimant


PNP member or his representative shall submit the following
documents:

a) Service record duly issued or authenticated by the PNP


Directorate for Personnel and Records Management
(DPRM);

b) Certified copy of latest appointment

c) Clearance from money and property accountability;

d) Certification of non pending case from the Office of the


Ombudsman, NAPOLCOM, PNP, IAS and People’s Law
Enforcement Board (PLEB);

e) Detailed Investigation Report of the Chief of Police or


immediate superior or supervisor, as to the cause and
extent of disability;

f) Certificate from the Chief of Police or Personnel Officer,


as the case may be, indicating the restorable deducted
leave credits for absences incurred by reason of the
injury sustained or sickness contracted which the subject
of the claim;

g) Official receipts duly registered with the Bureau of


Internal revenue for reasonable medical and
hospitalization expenses, necessary transportation and
subsistence incurred on account of service-connected
disability; Purchase of medicines in excess of Php 50.00
shall be evidenced by doctor’s prescription.

 INVESTIGATION AND ADJUDICATION OF THE CLAIM

a) Within five (5) days from receipt of the complete records


of the application, the Hearing Officer designated by the
NAPOLCOM Regional Director shall set the hearing of the
claim and shall notify the claimant/s, heirs and other
persons whose presence in the investigation is
necessary. In no case shall the hearing of the claim be
conducted beyond fifteen (15) days from the date of
receipt of the records from the Legal Affairs Service.

Hearing Officer/Investigator – an official/personnel


designated by the Commission to investigate
application for benefit claims.

b) Should serious question on the compensability of a claim


arise, the NAPOLCOM Regional Director shall direct the
Technical Service Division to conduct the necessary
inquiry, who shall forthwith submit the corresponding
Report. Said Report shall be attached in the records of
the claim and considered by the Hearing Officer in his
Report of Investigation

c) Within fifteen (15) days from the termination of the


investigation, the Hearing Officer/Investigator shall
submit his Report Investigation together with the
complete records of the claim to the Regional Director for
adjudication.

d) The Regional Director shall adjudicate the claim within


fifteen (15) days from receipt of the Report of
Investigation

e) The claimant shall be immediately furnished a copy of


the adjudication

DEATH BENEFITS
(BENEFIT UNDER R.A. NO. 4864 (POLICE ACT OF 1966) AS
AMENDED BY PRESIDENTIAL DECREE NOS. 448 AND 1184)

 WHAT IS DEATH?

 Death is the loss of life resulting from injury or sickness.

Sickness – an illness accepted as an occupational


disease, or any illness caused or aggravated by
employment, subject to proof that the risk of
contracting the same is increased by working
conditions.

 WHO MAY FILE CLAIM/APPLICATION FOR DEATH


BENEFITS?

 A claim for death benefits may only be filed by the following


in the order of precedence:

a) Surviving spouse;

b) Surviving dependent legitimate children;

c) Non-dependent legitimate and illegitimate children;

d) Surviving parents;

e) Surviving brothers and sisters.

Dependent children – any legitimate or legally


adopted child of the deceased uniformed PNP member
who is not gainfully employed and not over twenty one
(21) years of age at the time of latter’s death, or over
twenty one (21) years old, provided he is incapable of
support for himself due to mental or physical defects.

 WHAT ARE THE BENEFITS AWARDED TO THE
BENEFICIARY/IES?

 The following shall be awarded to the beneficiaries of a


deceased PNP member:

A. Surviving spouse or, if there be none, the surviving


dependent legitimate or legally adopted children:

1) Gratuity equivalent to the deceased PNP member one


year basic salary;

2) Burial expenses equivalent to three (3) month’s basic


salary of the deceased;

3) Monthly pension equivalent to eighty (80) percent of the


deceased’s basic salary for a period of five (5) years
from the date of death;

4) Reimbursement of reasonable expenses for medicines,


medical attendance, hospital fees, necessary
transportation and subsistence; and

5) Restoration of deducted leave credits for absences


incurred by reason of sickness or injury which caused
his death and the subject of the claim.

B. In the absence of the surviving spouse and dependent


legitimate children, the non-dependent legitimate children
together with illegitimate children, if any, or if there be
none, the surviving parents or in their absence, surviving
brothers and sisters of the deceased PNP member shall be
entitled to the following death benefits:

1) Gratuity equivalent to the deceased PNP member one


(1) year basic salary;

2) Burial expenses equivalent to three (3) month’s basic


salary of the deceased;

3) Reimbursement of reasonable expenses for medicines,


medical attendance, hospital fees, necessary
transportation and subsistence; and

4) Restoration of deducted leave credits for absences
incurred by reason of sickness or injury which caused
his death and the subject of the claim.

 WHERE TO FILE CLAIM

 An application letter under oath for death benefits shall be


filed with the Office of the NAPOLCOM Provincial Officer of
the province or city where the PNP member is stationed or
in the Regional Office of the Commission having
administrative jurisdiction of the unit assignment of the
deceased PNP member.

 SUPPORTING DOCUMENT TO A CLAIM FOR DEATH


BENEFITS

 A claim for death benefits shall be in writing and under


oath, filed in triplicate copies and indicating briefly the
identity of the deceased PNP member, the date and cause
of his death.

The claim must be supported by the following:

a) Service record issued or duly authenticated by the PNP


Directorate for Personnel and Records Management
(DPRM);

b) Certified copy of latest appointment;

c) Death Certificate issued by the National Statistics Office;

d) Detailed Investigation Report of the Chief of Police or


immediate superior or supervisor, as to the
circumstances or cause of death;

e) Clearance from money and property accountability;

f) Marriage Contract of surviving spouse with the deceased


and birth certificates of surviving children, if any, issued
by the National Statistics Office;

g) Certificate of No Marriage (CENOMAR) issued by the
National Statistics Office (NSO);

h) Official receipts duly registered with the Bureau of


Internal Revenue for reasonable medical and hospital
expenses, necessary transportation and subsistence
incurred on account of service-connected disability;
Purchase of medicines in excess of Php 50.00 shall be
evidenced by doctor’s prescription;

i) Certificate from the Chief of police or Personnel Officer,


as the case may be, indicating the restorable deducted
leave credits for absences incurred by reason of the
injury sustained or sickness which causes the death of
the PNP member and the subject of the claim.

j) Proofs of surviving legal heirs if claimant is other than


the surviving spouse or child;

k) If the claim is filed by a parent or by a brother or sister,


proof must be submitted indicating that the deceased
died single without any surviving child/children

 INVESTIGATION AND ADJUDICATION OF THE


CLAIM/APPLICATION

a) Within five (5) days from receipt of the application, the


NAPOLCOM Hearing Officer designated by the Regional
Director shall set the hearing of the claim and shall
notify the claimant/s, heirs and other persons whose
presence in the investigation is necessary. In no case
the hearing of the claim be conducted beyond fifteen
(15) days from the date of receipt of the application.

b) Should serious question on the compensability of a claim


arise, the NAPOLCOM Regional Director shall direct the
Technical Service Division to conduct the necessary
inquiry, who shall forthwith submit the corresponding
Report. Said Report shall be attached in the records of
the claim and considered by the Hearing Officer in his
Report of Investigation.

c) Within fifteen (15) days from the termination of the
investigation, the Hearing Officer/Investigator shall
submit his Report of Investigation together with the
complete records of the claim to the Regional Director
for adjudication.

d) The Regional Director shall adjudicate the claim within


fifteen (15) days from receipt of the Report of
Investigation

e) The claimant shall be immediately furnished a copy of


the adjudication

 WHO ARE THE BENEFICIARIES

a) The following are the only beneficiaries in the order of


precedence:

1) Surviving spouse;

2) Surviving dependent legitimate children;

3) Non-dependent legitimate children and illegitimate


children;

4) Surviving parents;

5) Surviving brother and sisters;

b) If a deceased PNP member during his lifetime contracted


a second marriage after the death of his first spouse, the
first legitimate children of the first marriage, if any, shall
be entitled to proportionate share of the benefits
applying suppletorily the provision of Article 888 of the
New Civil Code which states that “the legitime of the
legitimate children and descendants consists of one-half
of the hereditary- of the father and of the mother. The
latter may freely dispose of the remaining – share
subject to the rights of the illegitimate children and of
the surviving spouse as herein provided.”

The dependent legitimate children of the first marriage


shall, in support of their claim, submit proof evidencing

filial relationship with the deceased uniformed PNP
member.

c) If the deceased Uniformed PMP member is a


Mohammedan, the award of compensation benefits to
the beneficiaries shall be made in accordance with the
provision of P.D. 1083 (Code of Muslim Personal Law of
the Philippines).

 WHAT IS SURVIVORSHIP BENEFITS?

 When a uniformed PNP member who has been retired under


total permanent physical disability under R.A. No. 6975, as
amended, dies within five (5) years from the date of
retirement, his surviving spouse or, if there be none, his
surviving dependent legitimate children shall be entitled to
the pension for the remainder of the five-year guaranteed
period.

COMPENSABILITY AND DENIAL OF THE CLAIM

 GROUNDS FOR COMPENSABILITY

 For the injury and the resulting disability or death to be


compensable, the injury must be the result of an
employment accident satisfying of the following conditions:

1) The PNP member must have been injured at the place


where his work requires him to be and must have been
performing his official functions;

2) If the death or injury is sustained elsewhere, the


uniformed PNP member must have been executing a
lawful order from his Chief of Police or from his
supervisor, as the case maybe;

3) The death or injury is sustained by reason of the


performance of official duty; or

4) When a PNP member is accidentally injured at a point


reasonably proximate to the place of work, while he is
going to and coming from his work.

 For the sickness and the resulting disability or death to be
compensable, the sickness must be the result of an
occupational disease listed in Chapter VI of this Handbook.
Otherwise, proof must be shown that the risk of contracting
the disease is increased by the working conditions.

 NOTICE

 The uniformed PNP member or his authorized


representative shall notify his Chief of Police or immediate
supervisor during the period that he is absent due to
sickness or injuries. He shall however file an application for
leave of absence immediately upon his return to Office.

Injuries or death involving a PNP member shall be reported


to his police office or unit assignment within twenty four
(24) hours from its occurrence and an investigation relative
hereto small be immediately conducted.

The concerned police station or office shall submit to the


Commission or NAPOLCOM Regional Office a copy of the
Investigation Report within thirty (30) days from the
occurrence of the injuries or death.

 GROUNDS FOR DENIAL OF THE CLAIM

 No claim shall be approved or compensation allowed to a


uniformed PNP member of his beneficiaries when the injury
or sickness and the resulting disability or death is
occasioned by any of the following:

a) By intoxication or drunkenness or vicious immoral habits,


or unauthorized or illegal use of regulated or prohibited
drugs;

b) By willful intention to injure or kill oneself;

c) By notorious or gross negligence;

d) By unlawful aggression or provocation on the part of the


claimant or deceased PNP member.

An application for total permanent physical disability or
death benefit claims shall likewise be denied if it does not
satisfy any of the conditions on the grounds for
compensability.

 ADMINISTRATIVE LIABILITY OF THE CLAIMANT OR


THEIR REPRESENTATIVE

 Any claimant uniformed PNP member or his representative


who, for the purpose of securing entitlement to any benefit
or payment under these rules, commits fraud, collusion,
falsification or representation of facts or any other kind of
anomaly, shall be subject to criminal and administrative
action the Commission may deem appropriate and the
evidence warrants.

RULES ON THE PAYMENT AND/OR REIMBURSEMENT


OF REASONABLE MEDICAL EXPENSES

 PRIOR EXAMINATION AND EVALUATION BY THE


PNP PHYSICIAN OR NAPOLCOM MEDICAL OFFICER

 Except in emergency cases, PNP members who want to be


hospitalized must consult the PNP Physician or the
NAPOLCOM Medical Officer for examination and evaluation
of the sickness or injury, who shall then issue the necessary
referrals.

 HOSPITAL ROOM RATE

 Hospital Room tare shall not exceed Php 1,500.00 per day
except in the following cases:

a) When the condition of the patient needs to be confined in


the Intensive Care Unit (ICU) or in specialized unit

b) When special equipment is installed or used to the


patient’s survival

c) In case of emergency when the patient needs to be


brought to a nearest hospital, the cheapest room
available must be chosen. As soon as the patient’s
condition improves or when the emergency ceases, the
patient must be transferred to a room with a rate of not

more than Php1,500.00 per day. Otherwise, the excess
shall be borne by the patient

d) Any other cases analogous to the foregoing, upon


evaluation and recommendation by the PNP physician or
NAPOLCOM Medical Officer

 Professional and hospital expenses shall be evaluated by the


NAPOLCOM Medical Officer prior to its approval by the
Commission.

 MEDICINES

 Payment for necessary medicines, drugs, and other medical


preparation duly prescribed by a physician whether
purchased from a reputable drug store or supplied by the
attending physician or the hospital where the patient is
confined shall be allowed, provided that the same shall not
be more than the “retail price” prevailing in the local drug
store. Provided further, that the request for payment must
be properly supported by official receipts registered with the
Bureau of Internal Revenue and with corresponding doctor’s
prescription duly validated by the NAPOLCOM Medical
Officer. In case if purchase of medicines, the same shall be
evaluated by the NAPOLCOM Medical Officer

 LIMITATION ON REIMBURSEMENT OF EXPENSES

 The Commission shall reimburse to a PNP member who


suffered injury or contracts sickness in line of duty all the
expenses for the necessary medical, surgical and hospital
service, as the nature, seriousness, difficulty and
complication of the injury or sickness may require

The Commission shall pay only reasonable, necessary and


relevant services. Therefore, except in emergency cases, a
PNP member may undergo laboratory work-ups and such
other prescription procedures only after he/she has been
examined by the PNP physician or NAPOLCOM Medical
Officer who shall then issue the necessary referrals.

 EFFECTS OF DISAPPROVAL OR DENIAL OF THE
CLAIM

 The denial of the application for total permanent physical


disability or death benefits shall be deemed to include the
claim for reimbursement of medical and/or hospitalization
expenses incurred by the PNP member.

 MEDICAL RE-EXAMINATION

 The NAPOLCOM Medical Officer may require the PNP


member to undergo medical reexamination to determine
whether or not he/she has fully recovered from a peculiar
ailment.

 PAYMENT OF CLAIMS

 All claims for benefit shall be paid by the Regional Offices


that issued the adjudications.

However, when there is insufficiency of funds to pay the


whole or part of the benefits, a copy of the adjudication
together with such documents supporting the approval of
the claim shall be forwarded to the Central Office of the
Commission for payment, including the monthly pension, if
any.

MISCELLANEOUS PROVISION

 PRESCRIPTIVE PERIOD

 No application for total permanent physical disability by a


uniformed PNP member shall be filed within one (1) year
before his compulsory retirement except when the disability
was only sustained or suffered within the said period. A
claim for death benefit shall not be prescribed.

 EFFECTS OF PENDING ADMINISTRATIVE OR
CRIMINAL CASE

 The release of the benefits of the claimant shall be subject


to the outcome or resolution of the pending administrative
or criminal case against him/her.

 TRANSFER OF VENUE

 As a matter of policy, request for change or transfer of


venue of investigation of a claim for benefits is not allowed.
However, the Vice Chairperson and Executive Officer or the
Regional Director who has jurisdiction over the pending
claim may allow the same under of the following
circumstances:

a) The claimant has transferred his residence to another


place outside the jurisdiction of the hearing officer or the
regional office;

b) The PNP member who filed an application for disability is


reassigned to another police station or unit and it is
physically inconvenient or will cause serious detriment to
himself to attend the investigation;

c) Other cogent reasons the Vice Chairperson and Executive


Officer or the Regional Director may consider
appropriate.

Request for transfer of venue outside the jurisdiction of the


NAPOLCOM Regional Office shall be indorsed to the Office of
the Vice Chairperson and Executive Officer through the
Legal Affairs Service.

 AUTHORITY TO ADMINISTER OATH

 The Hearing Officers/Investigators shall have the authority


to administer oath in connection with investigation and
adjudication of death and total permanent physical
disability claims.

 AUTHORITY TO ISSUE SUBPOENA

 In order to effectively carry out the mandate, the Hearing


Officers/Investigators may request the Regional Director or
the Assistant Regional Director to issue subpoena ad
testificandum or duces tecum in connection with the
investigation and adjudication of claims for death and total
permanent physical disability.

APPEALS

 APPEALS

 Within fifteen (15) days from receipt of a copy of the


resolution denying a claim, the claimant may file an appeal
to the Regional Appellate Board (RAB) by filing a Notice of
Appeal with the Office of the Regional Director.

The Regional Director shall transmit the complete records of


the claim to the Regional Appellate Board (RAB) within five
(5) days from receipt of the Notice of Appeal.

The decision of the RAB affirming the resolution of the


Regional Director shall be final and executory.

 AUTOMATIC REVIEW

 Decision of the RAB reversing the resolution of the Regional


Director denying the claim for benefits shall be subject to
automatic review by the Commission En Banc. The RAB
Chairman shall forward the entire records of the claim to
the Commission thru the Chief, Legal Affairs Service within
five (5) days from the release of its decision.

The decision of the Commission En Banc is final and


executory.

SCHOLARSHIP PROGRAM
(BENEFITS UNDER R.A. No. 6963)

 Republic Act No. 6963, otherwise known as “An Act Granting


Special Financial Assistance and Benefits to the Family or
Beneficiary of any Police or Military Personnel or Fireman Killed
or Permanently Incapacitated while in the Performance of his
Duty or by Reason of his Office or Position and for Other
Purposes” was enacted on November 20, 1990.

Deceased or Permanently Incapacitated PNP


Personnel – refers to Commissioned Police Officer
(CPO) and Non-Commissioned Police Officer (NCPO)
who died in line of duty or became permanently
incapacitated while in the performance of duty or by
reason of his office or position

 WHO ARE ENTITLED TO THE SCHOLARSHIP


PROGRAM?

 The NAPOLCOM Scholarship Program applies to


kindergarten, elementary education (grades 1 to 6),
secondary education (grades 7 to 12), vocational and
college degrees in non-exclusive institution. The
scholarship privilege shall be limited to the payment of
tuition and miscellaneous fees payable to the school and
shall be remitted by the NAPOLCOM upon presentation of
required documents such as, approved enrollment or
registration form. The grant shall not apply to post-
graduate courses.

 SCHOOL LEVEL

 School levels refer to the following:

1) Kindergarten
2) Grades 1 to 6 (Elementary Education)
3) Grades 7 to 12 ( Secondary Education)
4) Vocational
5) College level

Kindergarten – means one (1) year of preparatory


education for children at least five (5) years old as a
prerequisite to Grade 1.

Grades 1 to 6 (Elementary Education) – refers to
the second stage of compulsory basic education which
is composed of six (6) years. The entrant age to this
level is typically six (6) years old.

Grade 7 – 12 (Secondary Education) – refers to the


third stage of compulsory basic education. It consists of
four (4) years of junior high school education and two
(2) years of senior high school education. The entrant
age to the junior and senior high school levels are
typically twelve (12) and sixteen (16) years old,
respectively.

Non-Exclusive Schools” – refers to schools


recognized by the Department of Education (DepEd)
and categorized as such, on the basis of the schools’
tuition and standard fees as approved by the DepEd.

 Qualified children who are not receiving financial scholarship


benefits for the kindergarten level may avail of the benefit
retroactively so long as the age of the child-beneficiary is at
least five (5) years old on February 2015.

 WHO ARE THE GRANTEES FOR SCHOLARSHIP?

Grantee” – refers to surviving legitimate and/or


illegitimate children of the deceased or permanently
incapacitated PNP uniformed personnel who are the
recipients of the scholarship grant.

 All surviving legitimate and illegitimate children of the


deceased or permanently incapacitated member of the PNP
who was killed or becomes permanently
incapacitated/disabled while in the performance of duty or
by reason of office or position from November 20, 1990 up
to the present. The deceased police officer must not have
committed any crime of human rights violations by final
judgment on such occasion.

 SCHEDULE OF TUITION AND MISCELLANEOUS


SCHOOL FEES

 The award of financial scholarship benefits for tuition fees


and miscellaneous fees to the scholar shall be paid directly
to the school in which he/she is enrolled or reimbursed to
the said scholar by the Commission upon presentation of

his/her approved enrollment or registration form and official
receipt of payment which shall not exceed the following
amounts:

a) Php 10,000.00 for Kindergarten scholar per school


year

b) Php 18,000.00 for Elementary education scholar per


school year

c) Php 24,000.00 for Secondary education scholar per


school year

d) Php 18,000.00 for Vocational Scholar per semester


(Note: The term “Vocational” includes enrollment in
Technological Education and Skills Development
Authority (TESDA) courses)

e) Php 30,000.00 for College scholar per year

Benefit – refers to the scholarship grant given to


qualified applicant.

Miscellaneous Fees – refers to the amount paid to or


collected by the school in consideration of the
acceptance and registration of student, such as
entrance, registration, library, ID, medical and dental,
student publication, student council, Citizen Military
training and graduation fees, including payment for
yearbook and graduation attire.

Tuition Fee – refers to the amount paid to and


collected by the school for classroom instructions.

School Year – refers to academic year

APPLICATION FOR SCHOLARSHIP

 REQUIREMENTS FOR FILING OF APPLICATION

A. Initial Application

1. Application letter for scholarship grant shall be filed by the


applicant or by the parent/legal guardian, in case of minor,

with the Office of the NAPOLCOM Regional Director where
the applicant resides.

2. Submit the following in at least three (3) copies:

a. Letter of application addressed to the NAPOLCOM


Regional Director concerned;

b. Certified true copy of the NAPOLCOM Adjudicated


Award;

c. Birth Certificate of the applicant duly authenticated by


the Local Civil Registrar;

d. Two (2) certificates of Good Moral Character; and

e. Report cards, Diploma, Transcript of Records, National


Elementary Achievement Test (NEAT) or National
Secondary Assessment Test (NSAT) result, Enrollment
Assessment and Official receipts of payment, if any.

B. Renewal Application

1. Applicant should submit the following in at least three (3)


copies:

a. Statement of account (in case application is for


payment or reimbursement of partial payment);

b. Official Receipt(s) of full/partial/down payment;

c. Report Card (for elementary or high school);

d. Transcript of Records (graduating college students);

e. Class Card (Non-Graduating College Students); and

f. Latest 2” x 2” ID picture.

 PROCEDURES IN THE PROCESSING OF APPLICATION

 The NAPOLCOM Regional Director upon receipt of the


application shall:

1. Schedule an interview of the applicant;

2. Evaluate the application with its supporting documents to


determine if applicant is qualified; and

3. Submit report of evaluation and approval of the


scholarship application together with a recommendation
to the NAPOLCOM Vice Chairperson and Executive Officer
(VCEO) through the Legal Affairs Service (LAS) of the
Central Office for initial payment.

 The LAS within fifteen (15) days from receipt of the records,
shall evaluate the same, prepare and submit the
corresponding Memorandum/Resolution to the VCEO for
approval of payment.

 ACADEMIC SUBJECTS

 All academic subjects, including Citizen’s Military Training


(CMT), Physical Education (PE), Civic and Social Training
(CST) and/or Religion or Theology or other subjects, if
prescribed by the school where the grantee is enrolled shall
be taken and passed during the specified curriculum period
or semester. If the grantee fails in any of these subjects,
retaking the same will be at his own expense.

Splitting of the loads with the purpose of extending his stay


during the last semester of the course is not allowed, unless
the reason for extension is meritorious as certified by the
Dean or Registrar of the School.

Cross-enrollment is allowed in case the subjects needed to


meet the full load requirements are not offered in the
institution where the grantee is enrolled.

 WEIGHTED AVERAGE

 No weighted average is required to be maintained.


However, the grantee is required to pass all the subjects
every specified curriculum period or semester.

The grantee shall submit to the Commission through the
Regional Director every end of the semester, report of
his/her studies which contain among other the following:

a) Subject completed with the corresponding grades and


weights in units

b) Other matters pertinent to the scholarship which may


be requested from time to time by the Commission.

The grantee shall take full load units as prescribed by the


course every semester or specified curriculum periods.
The scholarship grant shall be forfeited if the grantee
obtains failing grades in any of the subjects to which he is
enrolled for two (2) consecutive semesters or specified
curriculum periods.

 SHIFTING OF COURSE

 A scholar may shift courses provided that it is done not later


than the first semester of the second year of the course and
under the following conditions:

a) Shifting is done only once during the entire scholarship


grant period

b) Shifting will not prolong residence in the course.

c) Grantee does not have deficiency of more than six (6)


units. Shifting after the second year of the course is
not allowed

 TRANSFER TO ANOTHER SCHOOL

a) Transfer from one school to another is allowed under any of


the following conditions:

1) The course to which the scholar applied for enrollment is


no longer being offered upon certification by the school
authority;

2) Parents or guardians transferred their residence;

3) When it is declared by proper authorities that the area
where the school is located is unsafe and/or no longer
conducive to learning;

4) Transfer will not unreasonably delay his graduation from


the course enrolled or being taken; and

5) Majority of the subjects taken or at least eighty percent


(80%) of the units earned in the previous school can be
credited. Otherwise the grantee shall take the subjects
at his own expense.

b) Grantee who wished to transfer from one school to another


must secure prior approval from the NAPOLCOM

 DROPPING OF SUBJECTS

a) Dropping of subjects must be with the approval of the


School Registrar, copy furnished the NAPOLCOM

b) Dropping of subject may be allowed under the following


conditions:

1) It should not unreasonably prolong the period for the


completion of the course to which the grantee is
enrolled.

2) Dropping of subjects is beyond the control of the


scholar to be certified by the school authority.

3) Registrar’s certification that the subject is/are officially


dropped.

4) Refund for dropped subject should be remitted directly


to the NAPOLCOM

 COMPLETION

a) Three (3) incomplete grades in one school year shall be


considered scholastic deficiency and shall likewise be a
ground for suspension of the grant

b) The grantee should complete his deficiencies during the
semester or summer classes immediately following the
school term wherein he/she obtained the incomplete grade
in order to become a regular student during the following
school year

c) Failure to complete his deficiencies within the prescribed


period is a valid ground for termination of scholarship.

d) Re-enrollment in a repeat subject shall be at the grantee’s


expense

 DEFERMENT

a) A grantee may defer his scholarship grant upon prior


approval of the Vice Chairman and Executive Officer,
NAPOLCOM

b) Deferment of the scholarship grant may be permitted in


any of the following instances:

1) Poor health or serious illness to be supported by duly


notarized Medical Certificate

2) Psychological/emotional problems with certification from


the Guidance Counselor or Dean of the Student Affairs of
the school

3) Death of father, mother or guardian

4) Other causes considered meritorious by the NAPOLCOM.

c) Deferment should not exceed one (1) semester

d) A scholarship grant is forfeited if not enjoyed by the


grantee after a period of one (1) semester

e) A scholar should likewise apply in the NAPOLCOM


Scholarship Program for availment of the grant duly
supported by a medical certificate from a physician that
he/she is physically and mentally fit to resume studies.

 SUMMER CLASSES FOR GRADUATING STUDENTS

 Attendance in summer classes shall be financed by the


NAPOLCOM Scholarship Program provided that the student
is set to graduate during the summer term or during the
first semester of the next school year, and provided further
that the subjects, as part of the prescribed curriculum, are
offered only during summer terms.

 PAYMENT OF SCHOOL BILLS

 The grantee should submit to the NAPOLCOM the school


bills and confirmation of subjects to which the grantee is
enrolled duly signed by authorized school official
immediately after assessment to facilitate the release of
payment directly to the school concerned.

 LIMITATIONS

 This grant shall not apply to post graduate (4-year) courses


including courses leading to the Degree of Doctor of
Medicine and similar courses.

Any grantee who has been expelled from the school for
valid cause shall lose his scholarship privilege.

 ANTI-GOVERNMENT ACTIVITIES

 A grantee shall not be involved in any activity that is anti


government in nature. Violation of this particular provision
shall automatically cause the immediate discontinuance of
the scholarship grant without prejudice to appropriate legal
action that may be taken against the grantee.

FURTHER AMENDING NAPOLCOM MEMORANDUM CIRCULAR


NO. 95-001, AS AMENDED BY NAPOLCOM MEMORANDUM
CIRCULAR NO. 95-023, ON THE COVERAGE OF THE WORD
“GRANTEE” IN SECTION 1 (b) THEREOF

WHEREAS, Section 6, Article XVI of the Constitution and Section


14 of republic Act No. 6975, as amended, provide that the National
Police Commission (NAPOLCOM) shall exercise administrative control
and operational supervision over the Philippine National Police (PNP);

WHEREAS, R.A. No, 6963, entitled, “An Act Granting Special


Financial Assistance and benefits to the Family or Beneficiary of
Any Police or Military Personnel or Fireman Killed o
Permanently Incapacitated While in the Performance of His
Duty or by Reason of His Office or Position and For Other
Purposes”, provides for two (2) types o benefits, namely: (i) special
financial assistance to the family or beneficiary of the deceased or
permanently incapacitated police personnel and (ii) scholarship
assistance to all surviving children of the said police personnel;

WHEREAS, it is clear from the above that special financial


assistance is intended for the benefit of concerned police personnel’s
family which under Section 2 of R.A. No. 6963 refers to his/her
“surviving legal spouse and his/her legitimate children, or parents, or
brothers and sisters, or aunts and uncles, in that respective order”;

WHEREAS, with respect to scholarship assistance, Section 8 of


the same law extends said benefit to “all surviving children” of the
police personnel concerned, without distinguishing whether they are
legitimate or illegitimate;

WHEREAS, in view of the above, special financial benefits shall be


exclusively enjoyed by legitimate children of the concerned police
personnel while scholarship assistance benefits may be extended to
both his/her legitimate and illegitimate children;

NOW, THEREFORE, premises considered, the Commission,
pursuant to its constitutional and statutory mandates, HEREBY
RESOLVES TO AMEND, AS IT HEREBY AMENDS, Section 1(b) and
Section 2 of NAPOLCOM Memorandum Circular No. 95-011, as
amended by NAPOLCOM Memorandum Circular No. 95-023, to read as
follows:

“SECTION 1.- Definition of Terms

(b) “Grantee”- refers to surviving legitimate and/or


illegitimate children of the deceased or permanently
incapacitated PNP uniformed personnel who are the
recipients of the scholarship grant.

SECTION 2. - Who may file an application for Scholarship


Grant.

(a) Surviving legitimate and illegitimate children.

This Memorandum Circular shall take effect upon approval.

AMENDING ITEM F, SECTION 1 OF NAPOLCOM MEMORANDUM


CIRCULAR NO. 95-011, ENTITLED, “PRESCRIBING THE RULES
AND REGULATIONS IN THE IMPLEMENTATION OF THE
NAPOLCOM SCHOLARSHIP PROGRAM FOR SURVIVING
CHILDREN OF DECEASED AND/OR PERMANENTLY
INCAPACITATED PNP PERSONNEL, UNDER R.A. NO. 6963
AND NAPOLCOM RESOLUTION NO. 94-047”

WHEREAS, the Constitution and Section 14 of Republic Act No.


6975, as amended, provides that the National Police Commission
(NAPOLCOM) shall exercise administrative control and operational
supervision over the Philippine National Police (PNP);

WHEREAS, Section 8, R.A. No. 6963, entitled, “An Act


Granting Special Financial Assistance and Benefits to the
Family or Beneficiary of Any Police or Military Personnel or
Fireman Killed or Permanently Incapacitated While in the
Performance of His Duty or by Reason of His Office or
Position and For Other Purposes”, provides that:

“Section 8. All surviving children of the


deceased or permanently incapacitated police or military
personnel or fireman shall be extended scholarship up
to college in a nonexclusive institution, subject to the
policies on the tuition of said institution. The scholarship
privilege shall be limited to the payment of tuition and
miscellaneous fees payable to the school and shall be
remitted by the National Police Commission or the
Department of National Defense, as the case may be,
upon presentation to it of the approved enrollment or
registration form.” (emphasis ours)

WHEREAS, item f, Section 1 of NAPOLCOM Memorandum
Circular No. 95-011, entitled, “Prescribing the Rules and
Regulations in the Implementation of the NAPOLCOM
Scholarship Program for Surviving Children of Deceased
and/or Permanently Incapacitated PNP Personnel under R.A.
No. 6963 and NAPOLCOM resolution No. 94-047”, provides
that the entitlement of all surviving children to the scholarship if
from elementary, high school and college level;

WHEREAS, with the enactment of R.A. No. 10533, entitled,


“An Act Enhancing the Philippine Basic Education System by
Strengthening Its Curriculum and Increasing the Number of
Years for Basic Education, Appropriating Funds Therefor and
For Other Purposes” or the K to 12 Program, basic education now
encompasses the following school levels;

a) Kindergarten – means one (1) year of preparatory


education for children at least five (5) years old as a
prerequisite for Grade I.

b) Grades 1 to 6 (Elementary Education) – refers to the second


stage of compulsory basic education which is composed of
six (6) years. The entrant age to this level is typically six
(6) years old.

c) Grades 7 to 12 (Secondary Education) – refers to the third


stage of compulsory basic education. It consists of four 94)
years of junior high school education and two (2) years of
senior high school education. The entrant age to the junior
and senior high school education. The entrant age to the
junior and senior high school levels are typically twelve (12)
and sixteen (16) years old, respectively.

WHEREAS, in order to cope with the continued inflationary


costs of tuition and miscellaneous school expenses prescribed by the
different institutions of learning and taking into consideration the K
to 12 Program or the enhanced basic education program, the
Commission finds it necessary to increase the scholarship benefits
to its grantees/scholars as well as to adjust standing policy on

entitlement for the grant of scholarship to the surviving children of
deceased or permanently incapacitated police officers.
NOW, THEREFORE, the Commission, pursuant to its
constitutional and statutory mandates, HEREBY RESOLVES TO
AMEND, AS IT HEREBY AMENDS, item f of NAPOLCOM Memorandum
Circular No. 95-011 as follows:

“SECTION 1. Definition of Terms.

reimbursed to the said scholar by this Commission upon
presentation of his/her approved enrollment or registration form
and official receipt of payment which shall not exceed the following
amounts:

a. P 10,000.00 for Kindergarten scholar per school year

b. P 18,000.00 for Elementary education scholar per


school year

c. P 24,000.00 for Secondary education scholar per school


year

d. P 18,000.00 for Vocational school per semester

BE IT RESOLVED, FINALLY, the qualified children who are not,


heretofore, receiving financial scholarship benefits for the
kindergarten level may avail of such benefit retroactively so long as
the age of the child beneficiary is at least five (5) years old at the
time of passage of this Memorandum Circular.

All Memorandum Circulars or issuances or any part hereof,


which are inconsistent with this Memorandum Circular are repealed
or amended accordingly.

AMENDING SECTIONS 6 AND 7 OF RULE IV OF NAPOLCOM


MEMORANDUM CIRCULAR NO. 2011-009 ENTITLED
“REVISED RULES GOVERNING THE INVESTIGATION AND
ADJUDICATION OF BENEFIT CLAIMS OF UNIFORMED
MEMBERS OF THE PHILIPPINE NATIONAL POLICE (PNP)”

WHEREAS, the Commission issued Memorandum Circular No.


2011-009 entitled “Revised Rules Governing the Investigation and
Adjudication of Benefit Claims of Uniformed Members of the
Philippine National Police (PNP)”;

WHEREAS, the said Memorandum Circular provides that all


cases confirmed and recommended for Total Permanent Physical
Disability (TPPD) retirement by the TPPD Board shall be endorsed by
the PNP to the Commission thru the legal Affairs Service (LAS) for
evaluation;

WHEREAS, there is no clear provision on the recourse of


applicants in case their application for TPPD has been denied or
disapproved by the Medical Screening Committee for Physical or
Mental Incapacity (MSCPMI) and the denial was duly approved by
the Board;

WHEREAS, in order to give full opportunity to concerned PNP


members to exhaust all possible administrative remedies to
determine the merit of their application for TPPD, there is a need to
amend Section 6 (Endorsement of the Recommendations for TPPD
Retirement to the Commission) and Section 7 (Evaluation and
Examination of the Application by the NAPOLCOM medical Officers)
of Rule IV thereof to provide an appeal mechanism to a higher
administrative body;

NOW, THEREFORE, the Commission, pursuant to its
constitutional mandate to administer and control the PNP, HAS
RESOLVED TO AMEND, AS IT HEREBY AMENDS Sections 6 and 7 of
Rule IV of memorandum Circular No. 2011-009, to read as follows:

“Sec. 6. Endorsement of the Recommendation for


TPPD retirement to the Commission. _ All cases
confirmed and recommended for TPPD retirement shall
be endorsed by the PNP to the Commission thru the
Legal Affairs Service (LAS) for evaluation.

In case of denial or disapproval of the said


application for TPPD at any stage of Section 4 and
Section 5, the applicant may file a petition for re-
evaluation to the Commission thru the Legal Affairs
Service (LAS) within fifteen (15) days from receipt of a
copy of the Resolution of the TPPD Board denying such
claim.

The decision of the Commission shall be final.

“Sec. 7. Evaluation and Examination of the


Application by the NAPOLCOM Medical Officer. – The
NAPOLCOM Medical Officer shall evaluate the application
and the recommendation of the PNP for the TPPD
retirement of a PNP member.

In cases of denied or disapproved applications for


TPPD, the NAPOLCOM Medical officer shall nevertheless
comment on the merits of the petition.

In the evaluation of the application, the Medical


Officer may require submission of additional clinical or
medical records, personally examine the claimant PNP
member or require him to undergo laboratory tests.

Thereafter, the Medical officer shall submit his


recommendation to the Director, Legal Affairs Service

who shall forward the complete records of the application
for TPPD to the Regional Director of the NAPOLCOM
Regional Office that has administrative jurisdiction over
the police unit of the claimant for Adjudication.

All issuances and existing rules and regulations


inconsistent with this Circular are hereby repealed and
modified accordingly.

This Memorandum Circular shall cover all petitions that


are presently filed with the Commission for re-evaluation.

ADOPTED, this 22nd day of April in the year two

MEMORANDUM CIRCULAR NO. 2011-009

REVISED RULES GOVERNING THE INVESTIGATION AND


ADJUDICATION OF BENEFIT CLAIMS OF UNIFORMED
MEMBERS OF THE PHILIPPINE NATIONAL POLICE (PNP)

Pursuant to the provisions of R.A. No. 6975, as amended, the


National Police Commission hereby adopts and promulgates the
following rules governing the investigation and adjudication of
benefit claims of uniformed PNP members.

RULE I
TITLE AND CONSTRUCTION

Section 1. Title of the Rules. – These Rules shall be known and


cited as the “Revised Rules Governing the Investigation and
Adjudication of Benefit Claims of Uniformed members of the
Philippine National Police (PNP).”

Section 2. Coverage. – These Rules shall apply to claims for


death and permanent total disability benefits of the uniformed
members of the PNP.

All claims for temporary disability or sickness benefits of the


PNP uniformed members shall be filed with the PNP and acted in
accordance with its existing Rules and Regulations relative thereto.

Section 3. Construction. – These Rules shall be liberally


construed in order to promote and attain the objectives of obtaining
a just, reasonable and speedy investigation and adjudication of
benefit claim.

RULE II
DEFINITION OF TERMS

Section 1. Definition of Terms. – For purposes of these Rules,


the following terms shall mean:

a) Commission – refers to the National Police Commission
created under R.A. No. 6975, as amended;

b) Death – the loss of life resulting from injury or sickness;

c) Dependent Children – any legitimate or legally adopted child


of the deceases uniformed PNP member who is not gainfully
employed and not over twenty one (21) years of age at the
time of the latter’s death, or over twenty one (21) years
old, provided he is incapable of support for himself due to
mental or physical defects;

d) Disability – any loss or impairment of the normal functions


of the physical or mental faculties of a uniformed PNP
member which reduces or eliminates his capability to
continue with his present employment;

e) Injury – any harmful change in the human organism arising


from any incident sustained at work, while at the workplace,
or elsewhere executing an order from the PNP, or sustained
by reason of the performance of duty;

f) Medical Officer – refers to the Commission’s Medical Officer,


Legal Affairs Service;

g) Total Permanent Physical Disability – any impairment of the


mind or body which renders the disabled uniformed PNP
member incapable of performing substantially the duties of
a police officer and which is expected to be long, continued
and of indefinite duration, provided, that irreparable loss of
the power of speech, or sense of hearing, or loss of one or
both hands and feet, or loss of one eye or both eyes, or loss
of limbs, or brain injury resulting in incurable imbecility or
insanity shall be considered total permanent physical
disability.

In all cases, the disability shall be deemed permanent if


it has persisted for a period exceeding six (6) months,
without fixed healing period and renders the uniformed PNP
member incapable of performing the duties and functions;
Provided further, that in case the disability is found to be
permanent beyond doubt upon medical examination of said

member, the waiting period of six (6) months shall no
longer be applied;

h) Sickness – an illness accepted as an occupational disease,


or any illness caused or aggravated by employment, subject
to proof that the risk of contracting the same is increased
by working conditions;

i) Supplies – consists of medicines and other medical or


surgical items used relative to the medication or treatment
of the injury or sickness of the uniformed PNP member;

j) Uniformed PNP member – an officer or non-officer of the


PNP appointed in accordance with R.A. No. 6975, as
amended.

RULE III
GROUNDS FOR COMPENSABILITY

Section 1. Grounds for Compensability. - (a) For the injury and


the resulting disability or death to be compensable, the injury must
be the result of an employment accident satisfying any of the
following conditions:

1) The PNP member must have been injured at the place


where his work requires him to be and must have been
performing his official functions;

2) If the death or injury is sustained elsewhere, the PNP


member must have been executing a lawful order from his
Chief of Police or from his supervisor, as the case may be;

3) The death or injury is sustained by reason of the


performance of official duty; or

4) When a PNP member is accidentally injured at a point


reasonably proximate to the place of work, while he is going
to and coming from his work.

(b) For the sickness and the resulting disability or death to


be compensable, the sickness must be the result of an occupational
disease as determined by the Commission, other proof must be

shown that the risk of contracting the disease is increased by the
working conditions.

Sec. 2. Notice – The uniformed PNP member or his authorized


representative shall notify his Chief of Police or immediate
supervisor during the period that he is absent due to sickness or
injuries. He shall however file an application for leave of absence
immediately upon his return to Office.

Injuries or death involving the PNP member shall be reported


to his police office or unit assignment within twenty four (24) hours
from its occurrence and an investigation relative thereto shall
immediately be conducted.

The concerned police station or police shall submit to the


Commission or NAPOLCOM Regional Office a copy of the
Investigation Report within thirty (30) days from the occurrence of
the injuries or death.

RULE IV
INVESTIGATION AND ADJUDICATION OF APPLICATION FOR
TOTAL PERMANENT PHYSICAL DISABILITY BENEFITS

Section 1. Who may File Claim for Disability. – An application


for Total Permanent Physical Disability (TPPD) may be filed by the
uniformed PNP member himself or in case of incapacity, his duly
authorized representative.

In case a uniformed PNP member who has been found to be


disabled refuses to apply for total permanent physical disability
retirement, he/she shall be separated or attrited pursuant to the
provision of Section 29 of R.A. No. 8551 as implemented by
Memorandum Circular No. 2008-005 “Prescribing Policies,
Procedures and Guidelines Governing the Attrition System for
Uniformed Personnel of the PNP”.

Sec. 2. Where to file Claim. – (a) All uniformed PNP members


assigned with the National headquarters, National Support Units
(NSUs) and other PNP Special Units shall submit their individual
APPLICATION LETTER FOR TOTAL PERMANENT PHYSICAL
DISABILITY (TPPD) retirement under oath to the Directorate for
Personnel and Records Management (DPRM) thru the Pension

Retirement and Benefits Administration Service (PRBS) for recording
and appropriate action.

(b) All other PNP members assigned with the Police regional
Offices shall submit their individual APPLICATION LETTER FOR TPPD
to the Regional Personnel and Human resource Development
Divisions (RPHRDD)

Sec. 3. Endorsement of Application to the Health Service. –


The concerned Regional Personnel and Human Resource
Development Division (RPHRDD) shall within fifteen (15) days from
receipt of the application for TPPD endorse the same to the Regional
Health Service for the conduct of initial medical screening.

After the initial medical screening, the Regional health Service


shall submit its medical report to the Chief, RPHRDD who shall in
turn endorse the application for TPPD together with the said report
to the DPRM.

All application of PNP members for TPPD endorsed/submitted


to the DPRM shall be referred to the health Service for final medical
screening.

Sec. 4. Conduct of Medical Screening. – The Director of the


Health Service thru the Chief, PNP General Hospital shall assign a
physician who specializes in the field of medical expertise involving
the case of each applicant for TPPD to conduct the medical
examination.

Such medical examination shall be conducted in the Regional


Health Service Unit where the applicant/claimant is assigned if it is
physically difficult for him or it will seriously affects his health
condition to report to the PNP General Hospital for examination.
All results of medical findings in each case are submitted to
the Director of the Health Service. Cases where the applicants are
categorized as P4 shall be indorsed by the Director of Health Service
to the Medical Screening Committee for Physical or Mental
Incapacity (MSCPMI) for final medical screening.

MSCPMI conducts final medical screening and submits results


of deliberations to the Director of Health Service who shall re-
endorse each case back to DPRM thru PRBS.

Sec. 5. Deliberation of the Application by the Total Permanent
Physical Disability (TPPD) Board. – Upon receipt of the endorsement
from the Director of the Health Service of the result of the final
medical screening, TPPD Board shall convene and deliberate all
cases categorized as P4 shall be indorsed by the Director of Health
Service of the result of the final medical screening, the TPPD Board
shall convene and deliberate all cases categorized as P4 and
recommend thru resolution to the DPRM.

Sec. 6. Endorsement of the Recommendation for TPPD


Retirement to the Commission. – All cases confirmed and
recommended for TPPD retirement shall be the endorsed by the PNP
to the Commission thru Legal Affairs Service (LAS) for evaluation.

Sec. 7. Evaluation and Examination of the Application by the


NAPOLCOM Medical Officer. – The NAPOLCOM Medical Officer shall
evaluate the application and the recommendation of the PNP for the
TPPD retirement of a PNP member.

In the evaluation of the application, the Medical Officer may


require submission of additional clinical or medical records,
personally examine the claimant PNP member or require him to
undergo laboratory tests.

Thereafter, the Medical Officer shall submit his


recommendation to the Director, Legal Affairs Service who shall
forward the complete records of the application for TPPD to the
Regional Director of the NAPOLCOM Regional Office that has
administrative jurisdiction over the police unit of the claimant for
Adjudication.

Sec. 8. Supporting Documents to an Application for Total


Permanent Physical Disability. – Before or during the hearing of the
application, the claimant PNP member or his representative shall
submit the following documents:

a) Service record duly issued or authenticated by the PNP


Directorate for Personnel and Records Management
(DPRM);

b) Certified copy of latest appointment

c) Clearance from money and property accountability;

d) Certification of non pending case from the Office of the
Ombudsman, NAPOLCOM, PNP, IAS and People’s Law
Enforcement Board (PLEB);

e) Detailed Investigation Report of the Chief of Police or


immediate superior or supervisor, as to the cause and
extent of disability;

f) Certificate from the Chief of Police or Personnel Officer, as


the case may be, indicating the restorable deducted leave
credits for absences incurred by reason of the injury
sustained or sickness contracted which the subject of the
claim;

g) Official receipts duly registered with the Bureau of Internal


revenue for reasonable medical and hospitalization
expenses, necessary transportation and subsistence
incurred on account of service-connected disability;
Purchase of medicines in excess of Php 50.00 shall be
evidenced by doctor’s prescription.

Sec. 9. Investigation and Adjudication of the Claim. – (a)


Within five (5) days from receipt of the complete records of the
application, the Hearing Officer designated by the NAPOLCOM
Regional Director shall set the hearing of the claim and shall notify
the claimant/s, heirs and other persons whose presence in the
investigation is necessary. In no case shall the hearing of the claim
be conducted beyond fifteen (15) days from the date of receipt of
the records from the Legal Affairs Service.

(b) Should serious question on the compensability of a claim


arise, the NAPOLCOM Regional Director shall direct the Technical
Service Division to conduct the necessary inquiry, who shall
forthwith submit the corresponding Report. Said Report shall be
attached in the records of the claim and considered by the Hearing
Officer in his Report of Investigation.

(c) Within fifteen (15) days from the termination of the


investigation, the Hearing Officer/Investigator shall submit his
Report Investigation together with the complete records of the claim
to the Regional Director for adjudication.

(d) The Regional Director shall adjudicate the claim within
fifteen (15) days from receipt of the Report of Investigation.

(e) The claimant shall be immediately furnished a copy of


the adjudication.

RULE V
INVESTIGATION AND ADJUDICATION OF CLAIM FOR DEATH
BENEFITS

Section 1. Who may File Claim/Application for Death Benefits.


- A claim for death benefits may only be filed by the following in the
order of precedence:

a) Surviving spouse;

b) Surviving dependent legitimate children;

c) Non-dependent legitimate and illegitimate children;

d) Surviving parents;

e) Surviving brothers and sisters.

Sec. 2. Where to File Claim – An application letter under oath


for death benefits shall be filed with the Office of the NAPOLCOM
Provincial Officer of the province or city where the PNP members is
stationed or in the Regional Office of the Commission having
administrative jurisdiction of the unit assignment of the deceased
PNP member.

Sec. 3. Supporting Documents to a Claim for Death Benefits. –


A claim for death benefits shall be in writing and under oath, filed in
the triplicate copies and indicating briefly the identity of the
deceased PNP member, the date and cause of his death.

The claim must be supported by the following:

a) Service record issued or duly authenticated by the PNP


Directorate for Personnel and Records Management
(DPRM);

b) Certified copy of latest appointment;

c) Death Certificate issued by the National Statistics Office;

d) Detailed Investigation Report of the Chief of Police or


immediate superior or supervisor, as to the circumstances
or cause of death;

e) Clearance from money and property accountability;

f) Marriage Contract of surviving spouse with the deceased


and birth certificates of surviving children, if any, issued by
the National Statistics Office;

g) Certificate of No Marriage (CENOMAR) issued by the


National Statistics Office (NSO);

h) Official receipts duly registered with the Bureau of Internal


Revenue for reasonable medical and hospital expenses,
necessary transportation and subsistence incurred on
account of service-connected disability; Purchase of
medicines in excess of Php 50.00 shall be evidenced by
doctor’s prescription;

i) Certificate from the Chief of police or Personnel Officer, as


the case may be, indicating the restorable deducted leave
credits for absences incurred by reason of the injury
sustained or sickness which causes the death of the PNP
member and the subject of the claim.

j) Proofs of surviving legal heirs if claimant is other than the


surviving spouse or child;

k) If the claim is filed by a parent or by a brother or sister,


proof must be submitted indicating that the deceased died
single without any surviving child/children

Sec. 4. Investigation and Adjudication of the


Claim/Application. – (a) Within five (5) days from receipt of the
application, the NAPOLCOM Hearing Officer designated by the
Regional Director shall set the hearing of the claim and shall notify
the claimant/s, heirs and other persons whose presence in the
investigation is necessary. In no case the hearing of the claim be

conducted beyond fifteen (15) days from the date of receipt of the
application.

(b) Should serious question on the compensability of a claim

RULE IV
BENEFITS AND BENEFICIARIES

Section I. Death Benefits of PNP Beneficiaries. – The following


shall be awarded to the beneficiaries of a deceased PNP member.

A. Surviving spouse or, if there be none, the surviving


dependent legitimate or legally adopted children:

1) Gratuity equivalent to the deceased PNP member one year


basic salary;

2) Burial expenses equivalent to three (3) month’s basic


salary of the deceased;

3) Monthly pension equivalent to eighty (80) percent of the


deceased’s basic salary for a period of five (5) years from
the date of death;

4) Reimbursement of reasonable expenses for medicines,


medical attendance, hospital fees, necessary transportation
and subsistence; and

5) Restoration of deducted leave credits for absences incurred
by reason of sickness or injury which caused his death and
the subject of the claim.

B. In the absence of the surviving spouse and dependent


legitimate children, the non-dependent legitimate children together
with illegitimate children, if any, or if there be none, the surviving
parents or in their absence, surviving brothers and sisters of the
deceased PNP member shall be entitled to the following death
benefits:

1) Gratuity equivalent to the deceased PNP member one (1)


year basic salary;

2) Burial expenses equivalent to three (3) month’s basic


salary of the deceased;
3) Reimbursement of reasonable expenses for medicines,
medical attendance, hospital fees, necessary transportation
and subsistence; and

4) Restoration of deducted leave credits for absences incurred


by reason of sickness or injury which caused his death and
the subject of the claim.

Sec. 2. Total Permanent Physical Disability. - The following


TPPD benefits shall be awarded to a PNP member who incurred such
disability in line of duty or service-connected sickness or injury:

1) Gratuity equivalent to the claimant’s one (1) year basic


salary;

2) Lifetime monthly pension equivalent to eighty (80) percent


of the claimant’s basic salary;

3) Reimbursement of reasonable expenses for medicines,


medical attendance, hospital fees, necessary transportation
and subsistence; and

4) Restoration of deducted leave credits.

Sec. 3. Effectivity Date of Retirement of Uniformed PNP


Members Based on Total Permanent Physical Disability. - The

retirement of a PNP member by reason of TPPD takes effect only
upon approval of the adjudication by the concerned NAPOLCOM
Regional Director.

If a uniformed PNP member has been compulsorily retired


pursuant to Section 39 of R.A. No. 6975, as amended, prior to the
approval of his claim by the Commission for TPPD benefits, it having
been established that he incurred such disability before his
compulsory retirement, the effectivity payment of pension by the
Commission shall likewise commence upon the approval of the
adjudication.

In no case shall a uniformed PNP member be allowed to file


both optional retirement and an application for total permanent
physical disability.

Prior to the approval of the application by the Commission, the


uniformed PNP member shall continue to report for duty and render
police service and receive his salary as such, unless he is physically
incapable of performing his duties or he has already reached his
compulsory retirement in which case he shall automatically cease to
report for duty and to receive salary.

Sec. 4. Beneficiaries in Death Claims. - a) The following are


the only beneficiaries in the order of precedence:

1) Surviving spouse;

2) Surviving dependent legitimate children;

3) Non- dependent legitimate children and illegitimate


children;

4) Surviving parents;

5) Surviving brother and sisters;

b) If a deceased PNP member during his lifetime contracted a


second marriage after the death of his first spouse, the first
legitimate children of the first marriage, if any, shall be entitled to
proportionate share of the benefits applying suppletorily the
provision of Article 888 of the New Civil Code which states that “the
legitime of the legitimate children and descendants consists of one-

half of the hereditary- of the father and of the mother. The latter
may freely dispose of the remaining – share subject to the rights of
the illegitimate children and of the surviving spouse as herein
provided.”

The dependent legitimate children of the first marriage shall, in


support of their claim, submit proof evidencing filial relationship with
the deceased uniformed PNP member.

c) If the deceased Uniformed PMP member is a Mohammedan,


the award of compensation benefits to the beneficiaries shall be
made in accordance with the provision of P.D. 1083 (Code of Muslim
Personal Law of the Philippines).

Sec. 5. Survivorship Benefits. – When a uniformed PNP


member who has been retired under total permanent physical
disability under R.A. No. 6975, as amended, dies within five (5)
years from the date of retirement, his surviving spouse or, if there
be none, his surviving dependent legitimate children shall be
entitled to the pension for the remainder of the five-year
guaranteed period.

RULE VII
LIST OF COMPENSABLE ILLNESS/DISEASE LEADING TO THE
DEATH OR TOTAL PERMANENT PHYSICAL DISABILITY

Section 1. Categories of Compensable Illness. - Compensable


illness may be either:

a) Those listed as occupational disease; or

b) Those not listed as occupational disease but the risk of


contracting the same is proven to have increased by the
working conditions.

The following are classified as occupational diseases:

1) Skin cancer

2) Cataract leading to blindness

3) Rabies

4) Tuberculosis and its complications

5) Poisoning

a) Carbon dioxide poisoning


b) Carbon monoxide poisoning
c) Lead poisoning

6) Diseases caused by abnormalities in temperature and


humidity

a) Heat stroke
b) Frostbite/Freezing

7) Cerebrovascular accidents – as long as it is not due and/or


aggravated by chronic alcoholism and/or cigarette
smoking

a) CVA embolism
b) CVA thrombosis
c) CVA thrombo-embolism
d) CVA hemorrhage

8) Parasitism – Compensability should be based on the


principle of

a) Greater risk of acquiring the disease in the place of


work than in the place of usual residence

b) Disease was acquired in endemic areas (i.e., areas


where said disease is prevalent)

9) Cardiovascular diseases

a) Acute myocardial infarction


b) Congestive heart failure class IV-E

10) Pneumonia

Viral Pneumonia
Bacterial Pneumonia

11) Peptic ulcer diseases – as long as it is not due to chronic
alcoholism

14) Diarrhea and its complications

15) Cancer of the brain

16) Diabetes and its complications

The following ailments are not occupational diseases and


subject to proof that the risk of contracting the same are increased
by the working conditions:

1. Viral hepatitis
2. Cancer of the liver
3. Cancer of the lungs
4. Cancer of the pancreas
5. Cancer of the stomach and intestine
6. Liver cirrhosis and its complications

RULE VIII
SCOPE OF MEDICAL ATTENDANCE AND HOSPITALIZATION
BENEFITS

Section 1. Scope of Service. - Medical and Hospitalization


benefits shall embrace the following:

a) Medical

1) Professional attendance and treatment


2) Consultative professional fees (medical)

1) Surgical operations or interventions, after-care and


follow-up

4) Diagnostic services/procedures as may be necessary to
diagnose or effect a cure

d) Supplies

1) Drug, medication or medical supplies


2) Any other goods or supplies prescribed for medical
diagnose, care or treatment

RULE IX
RULES ON THE PAYMENT AND/OR REIMBURSEMENT
OF REASONABLE MEDICAL EXPENSES

Section 1. Prior Examination and Evaluation by the PNP


Physician or NAPOLCOM Medical Officer. - Except in emergency
cases, PNP members who want to be hospitalized must consult the
PNP Physician or the NAPOLCOM Medical Officer for examination and
evaluation of the sickness or injury, who shall then issue the
necessary referrals.

Sec. 2. Hospital Room Rate. - Hospital Room tare shall not


exceed Php 1,500.00 per day except in the following cases:

a) When the condition of the patient needs to be confined in


the Intensive Care Unit (ICU) or in specialized unit;

b) When special equipment is installed or used to the patient’s


survival;

c) In case of emergency when the patient needs to be


brought to a nearest hospital, the cheapest room available
must be chosen. As soon as the patient’s condition

improves or when the emergency ceases, the patient must
be transferred to a room with a rate of not more than
Php1,500.00 per day. Otherwise, the excess shall be borne
by the patient;

d) Any other cases analogous to the foregoing, upon


evaluation and recommendation by the PNP physician or
NAPOLCOM Medical Officer

Professional and hospital expenses shall be evaluated by the


NAPOLCOM Medical Officer prior to its approval by the
Commission.

Sec. 3. Medicines. - Payment for necessary medicines, drugs,


and other medical preparation duly prescribed by a physician
whether purchased from a reputable drug store or supplied by the
attending physician or the hospital where the patient is confined
shall be allowed, provided that the same shall not be more than the
“retail price” prevailing in the local drug store. Provided further, that
the request for payment must be properly supported by official
receipts registered with the Bureau of Internal Revenue and with
corresponding doctor’s prescription duly validated by the NAPOLCOM
Medical Officer. In case if purchase of medicines, the same shall be
evaluated by the NAPOLCOM Medical Officer.

Sec. 4. Limitation on Reimbursement of Expenses. - The


Commission shall reimburse to a PNP member who suffered injury
or contracts sickness in line of duty all the expenses for the
necessary medical, surgical and hospital service, as the nature,
seriousness, difficulty and complication of the injury or sickness may
require

The Commission shall pay only reasonable, necessary and


relevant services. Therefore, except in emergency cases, a PNP
member may undergo laboratory work-ups and such other
prescription procedures only after he/she has been examined by the
PNP physician or NAPOLCOM Medical Officer who shall then issue the
necessary referrals.

Sec. 5. Effect of Disapproval or Denial of the Claim. - The


denial of the application for total permanent physical disability or
death benefits shall be deemed to include the claim for

reimbursement of medical and/or hospitalization expenses incurred
by the PNP member.

Sec. 6. Medical Re-examination. - The NAPOLCOM Medical


Officer may require the PNP member to undergo medical
reexamination to determine whether or not he/she has fully
recovered from a peculiar ailment.

RULE X
GROUNDS FOR DENIAL OF THE CLAIM AND LIABILITY
OF CLAIMANTS OR THEIR REPRESENTATIVE

Section 1. Grounds for the Denial of the Claim. - No claim shall


be approved or compensation allowed to a uniformed PNP member
of his beneficiaries when the injury or sickness and the resulting
disability or death is occasioned by any of the following:

a) By intoxication or drunkenness or vicious immoral habits,


or unauthorized or illegal use of regulated or prohibited
drugs;

b) By willful intention to injure or kill oneself;

c) By notorious or gross negligence;

d) By unlawful aggression or provocation on the part of the


claimant or deceased PNP member.

An application for total permanent physical disability or death


benefit claims shall likewise be denied if it does not satisfy any of
the conditions on the grounds for compensability.

Sec. 2. Administrative Liability. - Any claimant uniformed PNP


member or his representative who, for the purpose of securing
entitlement to any benefit or payment under these rules, commits
fraud, collusion, falsification or representation of facts or any other
kind of anomaly, shall be subject to criminal and administrative
action the Commission may deem appropriate and the evidence
warrants.

RULE XI
APPEALS

Section 1. Appeals. - Within fifteen (15) days from receipt of a


copy of the resolution denying a claim, the claimant may file an
appeal to the Regional Appellate Board (RAB) by filing a Notice of
Appeal with the Office of the Regional Director.

The Regional Director shall transmit the complete records of


the claim to the Regional Appellate Board (RAB) within five (5) days
from receipt of the Notice of Appeal.

The decision of the RAB affirming the resolution of the


Regional Director shall be final and executory.

Sec. 2. Automatic Review. - Decision of the RAB reversing the


resolution of the Regional Director denying the claim for benefits
shall be subject to automatic review by the Commission En Banc.
The RAB Chairman shall forward the entire records of the claim to
the Commission thru the Chief, Legal Affairs Service within five (5)
days from the release of its decision.

The decision of the Commission En Banc is final and executory.

RULE XII
MISCELLANEOUS PROVISIONS

Section 1. Prescriptive Period. - No application for total


permanent physical disability by a uniformed PNP member shall be
filed within one (1) year before his compulsory retirement except
when the disability was only sustained or suffered within the said
period. A claim for death benefit shall not be prescribed.

Sec. 2. Effects of Pending Administrative or Criminal Case. -


The release of the benefits of the claimant shall be subject to the
outcome or resolution of the pending administrative or criminal case
against him/her.

Sec. 4. Transfer of Venue. - As a matter of policy, request for


change or transfer of venue of investigation of a claim for benefits is
not allowed. However, the Vice Chairperson and Executive Officer or
the Regional Director who has jurisdiction over the pending claim
may allow the same under of the following circumstances:

a) The claimant has transferred his residence to another
place outside the jurisdiction of the hearing officer or the
regional office;

b) The PNP member who filed an application for disability is


reassigned to another police station or unit and it is
physically inconvenient or will cause serious detriment to
himself to attend the investigation;

c) Other cogent reasons the Vice Chairperson and Executive


Officer or the Regional Director may consider
appropriate.

Request for transfer of venue outside the jurisdiction of the


NAPOLCOM Regional Office shall be indorsed to the Office of the
Vice Chairperson and Executive Officer through the Legal Affairs
Service.

Sec. 5. Authority to Administer Oath. - The Hearing


Officers/Investigators shall have the authority to administer oath in
connection with investigation and adjudication of death and total
permanent physical disability claims.

Sec. 6. Authority to Issue Subpoena. - In order to effectively


carry out the mandate, the Hearing Officers/Investigators may
request the Regional Director or the Assistant Regional Director to
issue subpoena ad testificandum or duces tecum in connection with
the investigation and adjudication of claims for death and total
permanent physical disability.

Sec. 7. Payment of Claims. - All claims for benefit shall be paid


by the Regional Offices that issued the adjudications.

However, when there is insufficiency of funds to pay the whole


or part of the benefits, a copy of the adjudication together with such
documents supporting the approval of the claim shall be forwarded
to the Central Office of the Commission for payment, including the
monthly pension, if any.

Sec. 8. Repealing Clause. – Memorandum Circular No. 2000-


005, all rules and regulations, orders or circulars issued by the
Commission, which are inconsistent with the provisions of this

Memorandum Circular, are thereby repealed, amended or modified
accordingly.

RULES AND REGULATIONS GOVERNING THE INVESTIGATION


AND ADJUDICATION OF BENEFIT CLAIMS OF UNIFORMED
MEMBERS OF THE PHILIPPINE NATIONAL POLICE (PNP)

Pursuant to the provisions of Section 76 of RA 6975, as


amended, the National Police Commission hereby adopts and
promulgates the following rules and regulations governing the
investigation and adjudication of benefit claims of uniformed PNP
members.

RULE I
Title and Construction

Section 1. Title of the Rules – These rules shall be known and


cited as the “Rules And Regulations Governing the
Investigation And Adjudication Of Benefit Claims of
Uniformed Members Of The Philippine National Police
(PNP).”

Section 2. Coverage – These Rules shall apply to claims for


death and permanent total disability benefits of uniformed members
of the PNP.
All claims for temporary disability or sickness benefits of uniformed
PNP members shall be filed and acted upon in accordance with the
existing PNP Rules and Regulations relative thereto.

Section 3. Construction – These Rules shall be liberally


construed in order to promote and attain the objectives of obtaining
a just, reasonable and speedy investigation and adjudication of
benefit claims.

RULE II
Definition of Terms

Section 1. Terms Defined – For the purposes of these Rules,


these relevant terms are hereby defined to mean as follows:

a. Commission – refers to the National Police Commission
created under RA 6975, as amended.

b. Hearing Officer – an official designated by Napolcom to


investigate applications for benefit claims.

c. PNP uniformed member – an officer or non-officer of the PNP


appointed in accordance with RA 6975, as amended.

d. Disability – any loss or Impairment of the normal functions of


the physical or mental faculties of a PNP member which
reduces or eliminates his capability to continue with his
present employment.

e. Permanent Total Disability – any Impairment of the mind or


body which renders the disabled uniformed PNP member
Incapable of performing substantially the duties of a police
officer and which is expected to be long, continued and of
indefinite duration, Provided, that Irreparable loss of the
power of speech, or sense of hearing, or loss of the limbs, or
brain injury resulting in incurable imbecility shall be
considered permanent total disability.

In all cases, the disability shall be deemed permanent if it


has persisted for a period exceeding six (6) months, without
fixed healing period and renders the PNP members incapable
of performing his duties and functions; Provided Further, that
in case the disability is found to be permanent beyond doubt
upon medical examination of said member, the waiting
period of six (6) months may be waived.

f. Injury – any harmful change in the human organism from


any incident sustained at work, while at the work place, or
elsewhere while executing an order from the employer, or
sustained by reason of the performance of duty.
g. Sickness – an illness accepted as an occupational disease, or
any illness caused or aggravated by employment, subject to
proof that the risk of contracting the same is increased by
working conditions.

h. Death – the loss of life from injury or sickness.

i. Supplies – medicines and other medical, or surgical items.

RULE III
GROUND FOR COMPENSABILITY AND DOCUMENTARY
REQUIREMENTS

Section 1. Grounds for Compensability – (a) For the injury and


resulting disability or death to be compensable, the Injury must be
the result of an employment accident satisfying any of the following
conditions:

a. The PNP member must have been injured at the place where
his work requires him to be and must have been performing
his official functions;

b. If the death or injury is sustained elsewhere, the PNP


member must have been executing a lawful order from his
Chief of Police or from his supervisor, as the case may be;

c. The death or injury is sustained by reason of the


performance of official duty;

d. For the sickness and the resulting disability of death to be


compensable, the sickness must be the result of an
occupational disease as determined by the Commission,
otherwise, proof must be shown that the risk of contracting
the disease is increased by the working conditions.

Section 2. Supporting Documents in a Claim for Permanent


Total Disability – A claim for permanent total disability of a PNP
member shall be in writing and under oath, filed in triplicate copies,
and shall state the name and residence of the claimant, brief
summary of the claim, the grounds thereof, and the relief sought.

The following must be attached to the application:

a. Recommendation for the permanent total disability of a


disabled PNP member by the PNP Chief on his duty
authorized representative;

b. Service record duly authorized;

c. Certification from the appropriate medical officer or
Compensation Rating Medical Officer that the PNP member is
unfit to further perform the duties of his office;

d. Detailed Investigation report from Chief of Police or


Immediate superior or supervisor, as to the cause and extent
of the disability;

e. Certified true copy of appointment;

f. Certification of clearance from money and property


accountability;

g. Certificate from the Chief of Police or Personnel Officer, as


the case may be, indicating the restorable deducted leave
credits for absences incurred by reason of the injury
sustained or sickness contracted which is the subject of the
present claim;

h. Official receipt duly numbered and dated for reasonable


medical and hospitalization expenses, necessary
transportation and subsistence incurred on account of
service-connected disability; Purchase of medicine in excess
of P50.00 shall be evidenced by Doctor’s prescription.

Section 3. Supporting Documents in a Claim for Death Benefits


– A claim for death benefits shall be in writing and under oath, filed
in triplicate copies and indicating briefly the identify of the deceased
PNP member, the date and cause of his death.
The following must be attached to the claim:

a. Service Record duly authenticated;

b. Death Certificate duly certified by the Local Civil Registrar;

c. Detailed Investigation Report from the Chief of Police or


immediate superior or supervisor as to the circumstances or
cause of death;

d. Certified true copy of decedent’s appointment;

e. Certificate from the Chief of Police or Personnel Officer,


indicating the restorable deducted leave credits for absences

incurred by reason of sickness or injury which caused his
death and the subject of the claim;

f. Official receipts duly dated and numbered of reasonable


expenses incurred for medicines, medical attendance,
hospital fees, including necessary transportation and
subsistence; Purchase of medicine in excess of P50.00 shall
be evidenced by doctors prescription;

g. Certificate of clearance from money and property


accountability;

h. Marriage Contract of surviving spouse and birth certificates of


surviving children, if any, properly certified by the Local Civil
Registrar;

i. Proofs of surviving legal heirs if claimants is other than the


surviving spouse or child;

If the claim is filed by a surviving parent or by a brother or


sister, proof must be submitted indicating that the deceased
died single without any surviving child/children.

RULE IV
COMMENCEMENT OF PROCEEDINGS

Section 1. Who May File Claim for Disability – A claim for


Permanent Total Disability may be filed by the PNP member himself
or in case of physical incapacity, his duty authorized representative.

On the other hand, a claim for death benefits may be filed by


the following in the order of precedence:

a. Surviving spouse;
b. Surviving dependent legitimate children;
c. Non-dependent legitimate children and illegitimate children;
d. Surviving parent;
e. Surviving brothers and sisters;

Section 2. Where to File Claim – A claim for permanent total


disability or death benefits of a PNP member shall be filed with the
Office of the National Provincial Officer of the province or city where

the PNP member is stationed or in any of the regional offices of the
Commission.

Section 3. Notice – Written notice of sickness, injury, or death


shall be given to the Chief of Police, as the case may be, by the PNP
member or his representative, within thirty (30) days from the
occurrences of the contingency.

Section 4. Investigation of Claim – Within five (5) days from


the receipt of the application, the National Provincial Officer or
designated Hearing Officer shall cause the Issuance of Notice of
Hearing to the claimants, heirs, and other persons whose presence
in the investigation is necessary. In no case shall the hearing of the
claim be delayed for more than fifteen (15) days form the date of
filing.

Should a serious question on the compensability of a claim


arise, the Napolcom Regional Director concerned may direct the
Regional Investigating Unit (RIU) to conduct the necessary inquiry,
and forthwith, submit the corresponding Report of Investigation
(ROI). Said ROI shall be forwarded to the Napolcom Provincial
Officer or designated Hearing Officer as part of the records of the
claim.

After its investigation, the Napolcom Provincial Officer or


designated Hearing Officer shall forward its Report of Investigation
on the claim, as well as the supporting paper and documents, within
fifteen (15) days from termination of its proceedings to the
Napolcom Regional Office for adjudication.

Section 5. Transfer of Venue – As a matter of policy, a request


for change or transfer of venue of investigation of a claim for
benefits is not allowed. However, the Napolcom Regional Director
who has jurisdiction over the said claim may allow the same under
any of the following conditions:

a. The claimant transferred his residence to another place which


is outside the jurisdiction of the designated Hearing Officer.

b. The PNP member who filed a claim for permanent total


disability is reassigned to another police station and it is
physically impossible for him or will cause serious harm to
himself to attend the investigation.

c. Other cogent reasons the Napolcom Regional Director may
consider appropriate.

Request for transfer of venue outside the jurisdiction of the


Napolcom Regional Office shall be indorsed to the Office of the
Vice-Chairperson/Executive Officer for consideration through the
Legal Affairs Service.

Section 6. Adjudication and Payment – All claims for benefits


are adjudicated and paid at the Napolcom Regional Offices.

However, when there is insufficiency of funds to pay the whole


or a part of the benefits, a copy of the Adjudication together with
such documents supportive of the approval of the claim shall be
forwarded to the Central Office for payment, including the monthly
pension, if any.
Section 7. Appeal – Within ten (10) days from receipt of the
decision denying a claim, the claimant may file an appeal with the
Napolcom Regional Appellate Board (RAB) by filing a Notice of
Appeal with the Napolcom Regional Office. The decision of the RAB
on police benefits claim is final and executory.

Section 8. Prescriptive Period – A claim for compensation


benefits shall not prescribe.

RULE V
BENEFITS AND BENEFICIARIES

Section 1. Death Benefits of PNP Beneficiaries – The following


benefits shall be awarded to the beneficiaries of a PNP member, to
wit:

a. Surviving spouse or, if there be none, the surviving


dependent legitimate children.

1. Gratuity equivalent to decedent’s one year basic salary;


2. Burial expenses equivalent to three month’s basic salary;
3. Monthly pension equivalent to 80% of decedent’s basic
salary for a period of five (5) years from the date of
death;

4. Reimbursement of reasonable expenses for medicines,
medical attendance, hospital fees, necessary
transportation and subsistence;
5. Restoration of deducted leave credits for absences
incurred by reason of sickness or injury which caused his
death and the subject of the present claim.

b. In the absence of the surviving spouse and dependent


legitimate children, the non-dependent legitimate children
together with illegitimate children, if any, or if there be none,
the surviving parents or in their absence, surviving brothers
and sisters of the deceased PNP member, shall be entitled to
the following death benefits:

1. Gratuity equivalent to decedent’s one year basic salary;


2. Lifetime monthly pension equivalent to 80% of member’s
basic salary;
3. Reimbursement of reasonable expenses for medicines,
medical attendance, hospital fees, necessary
transportation and subsistence;
4. Restoration of deducted leave credits.

Section 3. Effectivity Date of Retirement of PNP Members on


the Ground of Permanent Total Disability – The act of the PNP Chief
of recommending the retirement of a PNP member on account of
permanent total disability is a step or a requisite in the whole
process of filing a claim for permanent total disability benefits with
the Napolcom Provincial Officer or designated Hearing Officer. His
retirement by reason of total permanent disability takes effect only
on the date of approval of said claim by the Commission.

If a PNP member has been compulsory retired pursuant to Sec.


39 of RA 6975 prior to the approval of his claim by the Commission
for permanent total disability benefits, if having been established
that he incurred such disability before his compulsory retirement,
the effectivity date of payment of pension by the Commission shall
likewise commence on the effective date of the PNP compulsory
retirement.

Prior to the approval of the claim by the Napolcom, the PNP


member concerned shall continue to render police service and
receive his salary as such, unless he has already reached his

compulsory retirement age in which case he shall automatically
cease to report for duty and to receive salary.

Section 4. Beneficiaries in Death Claims – a) The following are


the beneficiaries in the order of precedence, to wit:

1. Surviving spouse
2. Surviving dependent legitimate children
3. Non-dependent legitimate children and illegitimate children
4. Surviving parents
5. Surviving brothers and sisters (PD 1184)
b) If a deceased PNP member during his lifetime contracted a
second marriage after the death of his first spouse, the
surviving dependent legitimate children of the first
marriage, if any, shall be entitled to a proportionate share
of the benefits applying suppletorily the provision of Article
888 of the New Civil Code which states that “legitimate,
illegitimate children and descendants consists of one-half of
the hereditary estate of the father and mother. The latter
may freely dispose of the remaining half, subject to the
rights of illegitimate children and of the surviving spouse as
hereinafter provided.”

The dependent legitimate children of the first marriage


shall, in support of their claim, submit proof evidencing filial
relationship with the deceased PNP member.

c) If the deceased PNP member is a Mohammedan, the award


of compensation benefits to the beneficiaries shall be made
in accordance with the provision of PNP 1083 (Code of
Muslim Personal Law of the Philippines.)

Section 5. Survivorship Benefits – When a PNP member who


has been retired under permanent total disability under RA 6975, as
amended, dies within five (5) years from the date of his disability
retirement, his surviving spouse or, it there be none, his surviving
dependent legitimate children shall be entitled to the pension for the
remainder of the five-year guaranteed period.

RULE VI
SCOPE OF MEDICAL ATTENDANCE AND HOSPITALIZATION
BENEFITS

Section 1. Scope of Service – Medical and hospitalization


benefits shall embrace the following:

a. Medical
a. Professional attendance and treatment
b. Consultative Professional Fees (Medical)

b. Surgical
a. Surgical operation or intervention, after-care and follow-up
b. Consultative Professional Fees (Surgical)

c. Hospital
a. Accommodation and subsistence
b. Ambulance and operating room services
c. Clinical laboratory service
d. Diagnostic services/procedure as may be necessary to
diagnose or effect a cure.

d. Supplies
a. Drugs, medication or medical supplies
b. Any other goods or supplies prescribed for medical
diagnose, care or treatment

RULE VII
RULES FOR PAYMENT AND/OR REIMBURSEMENT OF
REASONABLE MEDICAL EXPENSES

Section 1. Prior Examination and Evaluation by the Clinic


Physician – Except in emergency cases, PNP members who want to
be hospitalized must consult the Clinic Physician or Compensation
Rater for examination and evaluation of the sickness or injury, who
shall then issue necessary referrals.

Section 2. Hospital Room Rate – Hospital Room rate shall not


exceed P1,500/day except in the following cases:

a. When the condition of the patient needs to be confined in the


ICU or in a specialized unit;

b. When special equipment is installed or used for the patient’s
survival;

c. In cases of emergency when the patient needs to be brought


to a nearest hospital, the cheapest room available must be
chosen. As soon as the patient’s condition improves or when
the emergency ceases, the patient must be transferred to a
room with a rate of not more than P1,500/day. Otherwise,
the excess shall be borne by the patient;

d. Any other cases analogous to the foregoing, upon evaluation


and recommendation by the Clinic Physician or Compensation
Rater.

Professional and hospital bills shall be evaluated by the


Compensation Rater prior to approval by the Commission.

Section 3. Medication. – Payment of necessary medicines,


drugs and other medical preparation duly prescribed by a physician
whether purchased from a reputable drug store or supplied by the
attending physician shall be allowed provided that the same shall
not be more that the “retail price” prevailing in the local drug stores.
Provided, further, that request for payment must be properly
supported by official receipts, duly dated, numbered, and with
corresponding doctor’s prescription duly authenticated by the Clinic
Physician or Compensation Rater. In case of purchase of
medicines, the same shall be subject to the evaluation by the
Compensation Rater.

Section 4. Limitation on Reimbursement of Expenses. – The


Commission shall reimburse to a PNP member who suffers injury or
contracts sickness in line of duty all necessary medical, surgical and
hospital services, as the nature, seriousness, difficulty and
complication of the injury or sickness may require.

The Commission shall pay only reasonable, necessary, and


relevant services. Therefore, except in emergency cases, a PNP
member may undergo laboratory work-ups and such other
prescription procedures only after he/she has been examined by the
Clinic Physician who will then issue the necessary referrals.

Section 5. Effect of Disapproval of Claim. – If the claim is


disapproved, payment of medical and/or hospitalization services

rendered shall be borne by the PNP member concerned or his/her
heirs.
Section 6. Medical Reexamination. – The Clinic Physician or
Compensation Rater may require a PNP member to undergo medical
reexamination to determine whether or not he/she has fully
recovered from a particular ailment.

RULE VIII
LIABILITY

Section 1. Grounds for Denial or Claim. – No compensation


shall be allowed to a PNP member or dependents when the injury,
sickness, disability or death is occasioned by any of the following:

a. By intoxication or drunkenness or vicious immoral habits, or


intemperate use of regulated or prohibited drugs.

b. By willful intention to injure or kill oneself.

c. By notorious negligence.

d. By unlawful aggression or provocation on the part of the PNP


member.

Section 2. Administrative Sanction. – Any PNP member or his


representative who, for the purpose of securing entitlement to any
benefit or payment under these Rules, commits fraud, collusion,
falsification, misrepresentation of facts or any other kind of anomaly
shall be subject to criminal and administrative action this
Commission may deem appropriate.

Section 3. Repealing Clause. – All rules and regulations, orders,


or circulars issued by the Commission, which are inconsistent with
the provision, of this Memorandum Circular, are hereby repealed,
amended or modified accordingly.

Approved, this 8th day of June, in the Year Two Thousand in

This Rule shall take effect immediately.

PRESCRIBING THE RULES AND REGULATIONS IN THE


IMPLEMENTATION OF THE NAPOLCOM SCHOLARSHIP
PROGRAM FOR SURVIVING CHILDREN OF DECEASED AND/OR
PERMANENTLY INCAPACITATED PNP PERSONNEL, UNDER
R.A. 6963 AND NAPOLCOM RESOLUTION NO. 94-047

Pursuant to the provisions of R.A. No. 6963 in relation with


Napolcom Resolution No. 1994-047 dated December 14, 1994,
which grants scholarship privileges to all surviving children of any
police personnel who is killed or becomes permanently incapacitated
while in the lawful performance of his duty and in order to ensure
uniform and effective implementation thereof, the following rules
and regulations are hereby promulgated for strict compliance of all
concerned:

Section 1. Definition of Terms – for purpose of implementing


the Napolcom Scholarship Program, the following definition of terms
is hereby adopted:

a. “Deceased or Permanently Incapacitated PNP Personnel” –


refers to Commissioned Police Officer and Non-Commissioned
Police Officer (NPOC) who died in line of duty or became
permanently incapacitated while in the performance of duty
or by reason of his office or position.

b. “Grantee” – refers to surviving legitimate children, or in their


absence, illegitimate children of the deceased or permanently
incapacitated PNP member who are recipients of the
scholarship grant.

c. “Benefit” – refers to the scholarship grant given to qualified


applicant.

d. ”School Year” – refers to academic year.

e. ”Non-Exclusive Schools” – refers to schools recognized by the
Department of Education, Culture and Sports (DECS), and
categorized as such, on the basis of the schools’ tuition and
standard fees as approved by the DECS.

f. “School Level” – refers to elementary, high school and


college level.

g. “Tuition Fee” – refers to the amount paid to and collected by


the school for classroom instructions.

h. “Miscellaneous Fees” – refers to the amount paid to or


collected by the school in consideration of the acceptance and
registration of student, such as entrance, registration, library,
ID, medical and dental, student publication, student council,
Citizen Military training and graduation fees, including
payment for yearbook and graduation attire.

Section 2. Who May File an Application for Scholarship Grant.

a. Surviving legitimate children


b. In their absence, illegitimate children

Section 3. Requirements for filing of Application – Application


for scholarship grant shall be filed with the Office of the Napolcom
Regional Director where the applicant resides, and supported by the
following in at least three (3) copies;

a. Letter application;
b. Certified true copy of the Napolcom Adjudication Award;
c. Birth Certificate of the applicant duly authenticated by the
Local Civil Registrar;
d. Two (2) Certificates of Good Moral Character;
e. Report Cards, Diploma, Transcript of Records, National
Elementary Achievement Test (NEAT) or National Secondary
Assessment Test (NSAT) result, if applicable, and Enrollment
Assessment Receipt.

Section 4. Procedure in the Processing of Application.

a. The Napolcom Regional Director upon receipt of the


application shall:

1. Schedule an interview of the applicant;
2. Evaluate the application with its supporting documents if
applicant is qualified; and
3. Submit Report of Evaluation with recommendation
together with the records to the Vice Chairperson and
Executive Officer (VCEO) through the Legal Affairs Service
(LAS).

b. The LAS within fifteen (15) days from receipt of the records,
shall evaluate the same and prepare and submit the
corresponding Memorandum/Resolution to the VCEO for final
disposition.

Section 5. Academic Subjects – All academic subjects,


including Citizen’s Military Training (CMT), Physical Education (PE),
Civic and Social Training (CST) and/or Religion or Theology or other
subjects, if prescribed by the school where the grantee is enrolled
shall be taken and passed during the specified curriculum period or
semester. If the grantee fails in any of these subjects, retaking of
the same will be at his own expense.

Splitting of the loads with the purpose of extending his stay


during the last semester of the course is not allowed, unless the
reason for extension is meritorious as certified by the Dean or
Registrar of the School.
Cross-enrollment is allowed in case the subjects needed to meet
the full load requirements are not offered in the institution where
the grantee is enrolled.

Section 6. Weighted Average – No weighted average is


required to be maintained. However, the grantee is required to
pass all the subjects every specified curriculum period or semester.

The grantee shall submit to the Commission through the


Regional Director every end of the semester, report of his/her
studies which contain among others the following:

a. Subject completed with the corresponding grades and weight


in units.
b. Other matters pertinent to the scholarship which may be
requested from time to time by the Commission.

The grantee shall take full load units as prescribed by the
course every semester or specified curriculum period.

The scholarship grant shall be forfeited if the grantee obtains


failing grades in any of the subjects to which he is enrolled for two
(2) consecutive semesters or specified curriculum periods.

Section 7. Shifting of Course – A scholar may shift courses


provided it is done not later than the first semester of the second
year of the course and under the following conditions:

a. Shifting is done only once during the entire scholarship grant


period.
b. Shifting will not prolong residence in the course.
c. Grantee does not have deficiency of more than six (6) units.
Shifting after the second year of the course in not allowed.

Section 8. Transfer to Another School

a. Transfer from one school to another is allowed under any of


the following conditions:

1. The course to which the scholar applied for enrollment is


no longer being offered upon certification by the school
authority;
2. Parents or guardians transferred their residence;
3. When it is declared by proper authorities that the area
where the school is located is unsafe and/or no longer
conducive to learning;
4. Transfer will not unreasonably delay his graduation from
the course enrolled or being taken; and
5. Majority of the subjects taken or at least eighty percent
(80%) of the units earned in the previous school can be
credited. Otherwise the grantee shall take the subjects at
his own expense.

b. Grantee who wished to transfer from one school to another


must secure prior approval from the Napolcom.

Section 9. Dropping of Subjects

a. Dropping of subjects must be with the approval of the School


Registrar, copy furnished the Napolcom.

b. Dropping of subject may be allowed under the following
conditions:

1. It should not unreasonably prolong the period for the


completion of the course to which the grantee is enrolled.
2. Dropping of subjects is beyond the control of the scholar
to be certified by the school authority.
3. Registrar’s certification that the subject is/are officially
dropped.
4. Subject(s) dropped should be taken immediately during
the summer classes at the scholar’s expense.
5. Refund for dropped subjects should be remitted directly to
the Napolcom.

Section 10. Completion

a. Three (3) incomplete grades in one school year shall be


considered scholastic deficiency and shall likewise be a
ground for suspension of the grant.

b. The grantee should complete his deficiencies during the


semester or summer classes immediately following the school
term wherein he/she obtained the incomplete grade in order
to become a regular student during the following school year.

c. Failure to complete his deficiencies within the prescribed


period is a valid ground for termination of scholarship.

d. Re-enrollment in a repeat subject shall be at the grantee’s


expense.

Section 11. Deferment

a. A grantee may defer his scholarship grant upon prior


approval of the Vice-Chairman and Executive Officer,
NAPOLCOM.

b. Deferment of the scholarship grant may be permitted in any


of the following instances:

1. Poor health or serious illness to be supported by duly


notarized Medical Certificate.

2. Psychological/emotional problems with certification from
the Guidance Counselor or Dean of the Student Affairs of
the school.
3. Death of father, mother or guardian.
4. Other causes considered meritorious by the Napolcom.

c. Deferment should not exceed one (1) semester.

d. A scholarship grant is forfeited if not enjoyed by the grantee


after a period of one (1) semester.

e. A scholar should likewise apply in the Napolcom Scholarship


Program for availment of the grant duly supported by a
medical certificate from a physician that he/she is physically
and mentally fit to resume studies.

Section 12. Schedule of Tuition and Miscellaneous School Fees

a. The tuition fee shall not be more than the following amount
per school year:

1. P10,000.00 for college scholar;


2. P8,000.00 for vocational course scholar;
3. P6,000.00 for high school scholar; and
4. P4,000.00 for elementary scholar.

The miscellaneous school fee shall not be more than the


following amounts:

a. P4,000.00 for collage and vocational scholar.


b. P2,000.00 for high school and elementary scholar.

Section 13. Summer Classes for Graduating Students –


Attendance in summer classes shall be financed by the Napolcom
Scholarship Program provided the student is set to graduate during
the summer term or during the first semester of the next school
year, and provided further that the subjects, as part of the
prescribed curriculum, are offered only during summer terms.

Section 14. Payment of School Bills

a. The grantee should submit to the Napolcom the school bills


and confirmation of subjects to which the grantee is enrolled

duly signed by authorized school official immediately after
assessment to facilitate the release of payment directly to the
school concerned.

Section 15. Limitations – This grant shall not apply to pre-


school and post graduate (4-year) courses including courses leading
to the Degree of Doctor of Medicine and similar courses.

Any grantee who has been expelled from the school for valid
cause shall lose his scholarship privilege.

Section 16. Anti-government Activities – A grantees shall not


be involved in any activity that is anti-government in nature.
Violation of this particular provision shall automatically cause the
immediate discontinuance of the scholarship grant without prejudice
to appropriate legal action that may be taken against the grantee.

Section 17. Effectivity – This Memorandum Circular shall take


effect upon approval.

RESOLUTION NO. 1994-047

ESTABLISHING THE NAPOLCOM SCHOLARSHIP PROGRAM


FOR SURVIVING CHILDREN OF PNP MEMBERS

WHEREAS, Republic Act No. 6963 mandates, among others,


the grant of scholarship privilege to all surviving children of any
police or military personnel who is killed or becomes permanently
incapacitated while in the performance of his duty by reason of his
office or position in a police or military action;

WHEREAS, the aforesaid law provides that the amounts


necessary to fund the scholarship assistance shall be taken from the
proceeds of the license fees for firearms collected by the Philippine
Constabulary (now the Philippine National Police); and provides,
that the collection from the said license fees for one (1) year
following the approval of the said law shall constitute the initial fund
reserve for the scholarship privilege, to be replenished or enhanced
by collections in the succeeding years;

WHEREAS, the said Act further provides that the funds


collected from the firearms licensing fees shall be turned over to the
National Police Commission which shall administer the same for the
purpose of extending the said scholarship grant in the case of INP
members and firemen, and the Department of National Defense in
case of military personnel;

WHEREAS, with the passage of Republic Act No. 6975, the


former INP members with the exception of firemen and the
jailguards who are now under the Bureau of Fire Protection and
Bureau of Jail Management and Penology of the DILG, respectively,
and the members of the Philippine Constabulary who opted to join
the Philippine National Police and were absorbed as such now
constitute the PNP;

NOW, THEREFORE, BE IT RESOLVED AS IT HEREBY


RESOLVED, that pursuant to the mandate of R.A. 6963 and the
constitutional and statutory power of the Commission to

administratively supervise and control the PNP, a NAPOLCOM
SCHOLARSHIP PROGRAM FOR SURVIVING CHILDREN OF PNP
MEMBERS is hereby established the funds of which shall be taken
from the Firearms License Fees collected by the Firearms and
Explosive Office (FEO), PNP, Camp Crame, Quezon City, and in
furtherance of its purpose, the following shall be undertaken

1. The NAPOLCOM shall administer and manage the


program including its funds;

2. The NAPOLCOM thru the Legal Affairs Service shall


oversee and supervise the implementing of the
program including the processing of the applications
for the grant of such scholarship privilege;

3. Implementing of the program as well as


disbursements of funds shall be in accordance with
the rules and regulations to be adopted and approved
by the NAPOLCOM.

4. Non compliance with and/or violation of the


provisions of this Resolution and the corresponding
rules and regulations to be promulgated relative
thereto shall be a ground for administrative sanction.

This Resolution revokes Resolution, 94-003 dated January 13,


1994 in so far as the funding requirement of the PNP Provident
Trust Fund (PNPPTF) and Scholarship Program for deserving PNP
dependents mentioned in item 1(b) is concerned.

This Resolution takes effects upon approval.
