This is to solemnly affirm and declare that: -

1. That we, M/S ALMIGHTY GOLD / PROP. RAJAT LAVANIA

having our registered office or principal place of business at
30 ANUPAM GREENS SIKANDRA,NAGAR NIGAM FOOD SAFETY ZONDE 05,AGRA,UTTAR ( P
"Seller") are a registered seller and doing business as ALMIGHTY GOLD
on amazon.in of, amongst others, food products ("Food Products") for sale to end-
customers;

2. That we acknowledge and agree to abide by all the terms of the Business Solution
Agreement as entered with Amazon Seller Services Private Limited ("Amazon");

3. That we undertake to comply with all applicable laws, including but not limited to Food
Safety and Standards Act, 2006, rules & regulations framed thereunder and any other
guidelines issued by the Food Safety and Standards Authority of India ("FSSAI") for
listing and selling of Food Products in India ("Food Laws");

4. That we hereby declare that we have a valid and subsisting Food Business Operator
registration/license issued by the FSSAI for all types of Food Products which we sell or
intend to sell in future on amazon.in, a copy of which has been provided to Amazon;

5. That we hereby undertake to display our FSSAI Registration/License No. on amazon.in

with other mandatory information as provided and required under Food Laws;

6. That we hereby agree and acknowledge that it is our sole responsibility to display (a) a
high definition image of the principal display panel providing requisite information as per
provisions of Food Safety and Standards (Packaging and Labelling) Regulations 2011
excluding ‘best-before’ or ‘use-by’ date, date of manufacturing/packaging, batch code/lot
number and MRP; and (b) all mandatory food packaging and labelling information
provided on the label of the food delivered to the customer.

7. That we hereby declare that;

a. no misleading information pertaining to seller/brand owner/manufacturers or

misleading images of food products are made available or displayed on amazon.in;

b. the information provided is accurate, clear, unambiguous and is not misleading in

any manner including but not limited to any claims made in customer testimonials
or blogs hosted on our seller website or social media page;

c. all claims made are in accordance with the Food Laws;

d. no health claims or false claims are made on the products being displayed for sale;

e. the Food Products under organic food category are in compliance with Food Safety
and Standards (Organic Foods) Regulation, 2017;

f. none of the listed Food Products are banned or recalled for reasons including but
not limited to:

(a) prohibited from sale in India, both online and offline;

(b) recalled from the market, in a voluntary or mandatory manner;
(c) inadequate product labeling and safety warnings; and
(d) do not meet mandatory food safety standards.

8. That we hereby declare and affirm that in the event there are any contravention of Food
Laws in relation to the Food Products or their sale, we will be solely responsible for such
contravention, provide all necessary support and cooperation to FSSAI for any
investigation and agree to be subject to all necessary action to be taken by FSSAI in this
regard.

✔ We hereby solemnly affirm that the above statements and declaration are true to the best of our
knowledge and belief and if at any subsequent date any of the said declarations are found to be
false or incorrect, we shall be liable to civil as well as criminal prosecution as may be stipulated
under applicable laws.

✔ We understand and agree that the above undertaking is binding on us and such persons who are
responsible for the acts done by the entity/company/firm from time to time.
