MEDIATOR:- Welcome dear friends ...Before entering into the discussion I would like to introduce my
colleagues.

This is Miss Veena Raj, the Chief Minister of Vindhya Desh …She is Miss. Deepa, Representative of The
Central Government…She is Miss Jyothis, Representative of Kagna Rashtra Samithi.. This is Miss
Anurakhi, Representative of the Employees… She is Miss Nikhila, Student’s Representative.

We are going to discuss about the current issue, the formation of Kangna State in the Vindhya Desh. I
would like to give you a brief summary of the issue. At the time of the amalgamation of Indraprasth
State and Vindhya State, Vindhya promised to safeguard the interests of the Kangna region based on the
“Gentleman’s Agreement”. Even after 5 decades they will not get justice. So they started the movement
for a separate State.
Nobody can give a solution to this issue when both sides are equally opposite. In such impossible
situation, nobody can give a compromising solution. The best suggestion in this situation is to call the
main leaders of all the parties from both regions and ask them to have a debate and to arrive at a final
compromise, which shall be implemented by the Central Government. Dear friends let’s start the
discussion.

Rep. Central Govt: - Why are we hearing separate Kangna slogan again?

Rep. Students: - The demand for a separate state of Kangna isn’t new. Kangnites have very clearly
expressed their opposition a decade before Vindhya Desh was formed. They reasoned that in a united
Vindhya Desh they will not get justice. Even after five decades, this demand is continuing. The reason for
this is the experience of past 48 years that justice will not be done to Kangna and belief that it will
continue to be denied to Kangnites in united Vindhya Desh.

C.M:-Isn’t Kangna slogan the creation of unemployed politicians?

Rep. Employees: -Kangna demand is a peoples’ movement born out of their problems. Are all the people
robbed unabatedly, continuously for the 48-years and raising their voice again, unemployed political
leaders? Who are the unemployed political Leaders? Are they the farmers that have been suffering for
lack of drinking water, irrigations water, and cuts in electric supply? Are they the workers who lost their
livelihood due to lack of new industries, and closure of existing industries? Are they the unemployed
youth whose job opportunities are hijacked by outsiders? Are they the innumerable people who have
been labeled and suppressed as terrorists because they raised their voice for Kangna? When people are
subject to robbery and injustice and take to the streets, it is natural for leaders to enter the fray. Just
because out of power politicians support Kangna statehood, does it stop being peoples’ movement? In
any movement, politicians in and out of power join in. Some even deceive and attempt to side line the
movement, but they can’t stop the movement. Movements continue until justice is served to the
people. The educated that are the pillars of this movement aren’t unemployed. They aren’t even after
employment for themselves.

C.M:- 45% of the state income comes from Kangna region. When it comes to utilization of funds, the
share of Kangna is only 28%. Normally canals, rivers, dams and other irrigation facilities are in Kangna.
Then the separation will badly affect the development and welfare of the human beings.
There are other backward areas in the state. Why should only Kangna people have a separate state of
their own?

Rep. KRS:-Just as Kangna, other backward areas in the state have been discriminated. True. But,
additionally Kangna has been systemically robbed. Diversion of this regions natural resources, water,
underground resources and their income to other areas, the robbing of jobs from the region’s people,
Colonization aren’t directed at other areas. Additionally the Kangnites have been subject to ridicule with
respect to the language and the politicians have been looked down upon to the extent they lost their
own self image. To preserve their self respect and to protect their region’s natural resources, people of
Kangna want their own state.

Rep. Central Govt:- Isn’t it detrimental to Indian national unity if small states are continuously created?

Rep. Students: - Out of the 35 states currently in India (28 states and 7 Union Territories), 70% are
smaller than Kangna. Kangna’s population is 30 million plus. There are 25 states that are smaller than
Kangna. If these twenty-five don’t cause national unity issues, why would creation of a larger state be
any dangerous?

Rep. Central Govt:- What would you do, if the backward districts in Kangna want a separate state of
their own after formation of Kangna state?

Rep. KRS:- Backwardness of Kangna is a major reason for the Kangna state demand but not the
sole reason. All ten Kangna districts have same historical background, geographic closeness, cultural
commonality, language unity, and mutual understanding among the people. These factors are all
foundation for unity of thought. In our country there are some other backward districts in various states.
Are they all demanding a separate statehood? It is meaningless and baseless argument.

Mediator:- Why do people with one language need two states?

Rep. Employees: - If one language, one state is the norm, why do we have 9-Hindhi speaking
states? Next to Hindi, Kongini is the most spoken language in India. What is wrong with having two
states that speak Kongini?

C.M:-Breaking the country into such smaller units increases regionalism in Indian politics. Further it is a
multi-crore task for the government and funds for the formation of so many states cannot be
accommodating in the forthcoming budget. Although the claim for separate state is ridiculous,
governments must understand the need to maintain uniform and sustained growth throughout the
state.

Instead of asking for a separate state, why can’t you fight for development within the frame work of
united Vindhya Desh?

Rep. KRS:-The promises of Kangna development have been made for the past 48 years in united Vindhya
Desh. Before and after the formation of Vindhya Desh, Which promises were kept? Which agreements
were respected? Which projects were implemented? Which principles were they bound to? From the
first day of Vindhya Desh formation, till to-day, agreements are being broken. What were the united
Vindhya Desh wishers do? Did they even express any concerns? How long should the Kangna people
bear this and put up with this injustice?

Rep. Central Govt: - Moreover living together is better than separate.

Rep. Students: - Getting seperate Kangna would give them privacy of handling thier own things.
Mediator: - I think it is the time to wind up our discussion. Can you suggest the merits and demerits of
the formation of the new state?

Disadvantages:-

Rep. Central Govt: -Having less MP seats in a state would results less authority in the central
government

C.M:-Moreover living together is better than seperate..would get down......

Other financial matters are seen by intelligence....

Most of the educational institutions, diary development corporations, irrigation facilities and certain
other developmental projects are in Kangna region.

Advantages:-

Rep. Students: - Getting separate Kangna would give them privacy of handling their own things.
Rep. KRS: -When government doesn’t satisfy their needs in the whole state they to get satisfied with a
separation.

Rep. Employees: -Following divide and conquer method would results best in any formulae...

Rep. Students: - Smaller states are easy to handle and control.

Rep. Employees: -It is difficult on the part of centre as well as state to handle security of larger states.as
it is said that small family is a happy family,similarly small state should be a happy state.

Rep. KRS: -Dividing big state will benefit citizens for better availing of government programmes without
any regional negligence.

Rep. Students:- Kangna has been a demand for many years. If it is formed then this will prove democracy
in India.

Rep. Employees:- Inspite of assurances provided by the successive governments at the center about
upliftment of Kangna people and to safe guard thier job rights in their region, for the past 50 years
nothing was implemented. The Kangna people are drastically marginalized in the utilization of water
resources and infrastructure. Our demand is legible.

Mediator :-

The peace of a state or nation or world is very important subject, which is concerned to God.

Since the creation of Kangna is not merely a constitutional issue, historical, political and social aspects
pertaining to the issue were also discussed. There is a subjective study on the creation of State of
Kangna rather than having a generalized knowledge about the constitutional provisions enshrined in the
Constitution of India dealing with creation of new states.

According to Article 3 of the Constitution of India, Formation of new States and alteration of areas,
boundaries or names of existing States: Parliament may by law

(a) Form a new State by separation of territory from any State or by uniting two or more States or
parts of States or by uniting any territory to a part of any State;

(b) Increase the area of any State;

(c) Diminish the area of any State;

(d) Alter the boundaries of any State;

(e) alter the name of any State.

Rep. KRS:- Article 2 reads as, “Admission or establishment of new States.—Parliament may by law admit
into the Union, or establish, new States on such terms and conditions as it thinks fit’’

Provided that no Bill for the purpose shall be introduced in either House of Parliament except on the
recommendation of the President and unless, where the proposal contained in the Bill affects the area,
boundaries or name of any of the States, the Bill has been referred by the President to the Legislature of
that State for expressing its views thereon within such period as may be specified in the reference or
within such further period as the President may allow and the period so specified or allowed has expired
Explanation I In this article, in clauses (a) to (e), State includes a Union territory, but in the proviso, State
does not include a Union territory Explanation II The power conferred on Parliament by clause (a)
includes the power to form a new State or Union territory by uniting a part of any State or Union
territory to any other State or Union territory

Power under Article 3 and 4 is the solemn constitutional power and it is obvious that no constitutional
power can be exercised arbitrarily and at will without there being a fundamental constitutional
paradigm or basis to the exercise of power.

C.M:- Our Constitution says that if process of carving out a state affects the boundaries of existing state,
(in case of Kangna, it will definitely affect the boundaries of Vindhya Desh as ten districts have to be
removed), the President is bound to refer the Bill to be introduced in Parliament, to the Vindhya Desh
Assembly. While such reference is mandatory, the President need not decide as per the opinion
expressed by such state legislative Assembly. This means, even if there is an opposition to the ‘referred
bill’ or such reference is not responded within prescribed time, or when such a bill is approved, the
President can go ahead with formation of a new state. However, it is a political requirement for building
a strong opinion in favour of a new state to prevail over the Union to fulfil the aspirations of the people.

Rep. KRS:- The Constitution, however, is silent on the subject of the criteria for forming States doing
nothing more than giving the power of formation of States to Parliament. While giving power exclusively
to Parliament may be conducive to the integrity and unity of India, it gives no guidance to Parliament or
a body created by Parliament as to the principles for the formation of States.

Political will and Parliament Bill are enough for formation of Kangna State as per the Constitutional
procedures and requirements. Neither the consent of Vindhya Desh Assembly, nor the Amendment to
the Constitution is required for carving out a new territory from the boundaries of present Vindhya Desh
state.

Mediator:-From the above discussion we can come to the conclusion that the formation of the Kangna
state is essential and justifiable.

SETTLEMENT:-

In spite of the following demerits (i) Division of the state will affect the number of M.P seats (ii) Division
will affect the development of the state because most of the educational institutions, diary development
corporations, irrigation facilities and certain other developmental projects will be divided to the other
state. But considering the following merits (i) Getting separate Kangna would give them privacy of
handling their own things (ii) When government doesn’t satisfy their needs in the whole state they to
get satisfied with a separation (iii) Smaller states are easy to handle and control (iv) it is difficult on the
part of centre as well as state to handle security of larger states (v) dividing big state will benefit citizens
for better availing of government programmes without any regional negligence; entitles us to arrive at a
conclusion that the formation of the Kangna state is essential and justifiable for the development of
both the states.
