FOREWORD
We are committed to achieving refotm of the agency's services and
have much to do within a short time. This MTRCB Operations
Manual has been produced to erisure that MTRCB is organized to
achieve the tasks ahead, that we utilize wisely the resources to its
optimum use, and that we communicate our successes within and
outside the organization.

Adherence to the requirements of tlis Manual is mafldatory and is

critical to the MTRCB demonstrating good govemalrce in the
delivery of its services to its stakeholders. Without the application
of the agency's policies and procedutes, we canflot tetain credibility
with MTRCB staff and with the many stakeholdem who depend on
MTRCB for the good administration of P.D 1986.

Guided by our past experience and with the cooperation of the

Board Members and the organic staff, this Manual was drafted to
teflect the most receflt policies, to make it relevant and usefril as
possible. For ease of reference, we simplified our presentation
ofthe procedures and for various types of services.

The Movie and Television Review and Classification Board
is a governmeot agency created under Republic Act No. 3060. It
was renarned and reconstituted as the Board of Revieur for Motion
Pictures and Television under Executive Ordet Nos. 585,745 and
757. It uras fiEthec atrrended by Presidential Decree 1986 urhich
introduced the expanded pourersi of the MTRCB.

INTRODUCTION TO THE MANUAL

1.0 The Manual

The MTRCB operations Maaual contains guidelines in the

irr'rpleraeatation of Presideatial Deeree No. 1986 aad its
Implementing Rules and Regulations.

The Manual is intended for the use of the Chailperson, Vice

Chairyerson, Executive Director, Board Members and the
Agency's organic staff.

A list of persons who are issued with copies of this Manual

is in Annex 1A.

2.0 Purpose and Couerage

The maia pupose of the Manual is to support the efficienry

and effectiveness of the ageacy by clariflriag iastitutional
roles, responsibilities, accourtabilities, as well as recording
guidelines and related ptocedues and interaction betweea
and among the officers and saff involved.

The Manual is provided to support the implementation of

the agency's thrust in accordance to the laurs. It serves as a

Users ate, therefore, eacouraged to ideatify areas aeediag
revision and sugest necessary improvements to Technical

This Manual should be revievred after it has been in use for

a period of 12 moaths arrd shall be subiect to such revisions
as may be deemed necessary

Chapter 3

DEFINITION OFTERMS
1.0 BOARD-The Movie and Television Review and
Classification Board (I\{TRCB) ceated under Presidential
Decree No. 1986

2.0 CHAIRPERSON-The Chalperson of the Board, or in the

Chaiqperson's absence or rncapaaty, the Vice Chailperson,
or in the Vice Chailperson's absence or iocapacity, afly
Member of the Board designated to act for andin behalf of
the Chairyersoa.

3.0 COMPLAINT-A concise statementof the facts constituting

the proponent's cause or causes of action, specifying the
pq or parties charged and the violations allegedly
cornrnitted, and stating the narne and residence of the
complainant.

4.0 GENERAL VIEUf[NG-making motion pictures available

to the general public for its viewing through convenient film
packs or similar matedals sold, leased, or lent in commercial
outlets, public lending clubs, and sirnilar organizatioa.

5.0 MOTION PICTURE-A sedes of pictures projected on a

screen in rapid succession, with objects shown in successive
positions slightly changed so as to produce the optical effect
of a coatisuous picarre in which the obiects movq urhether
the picture be black and white or colored, silent or with
accompanying sound, on whatever medium and with
whatever mechanism or equipment they are projected, and
in whatever rraatedal they are preserved or rccorded for
iastaot profectioa. For the pqpose of F.D. No. 1986, the
materials in which the motion picture is coatained,
preserved, or recorded, forrns an integral part of the motion
picture.

7.0 REVIE!fl-The process of prcviewing motion pictures,

television programs arrd related publicity matdrials to

distributiofl, sale, lease and exhibition in theater or nofl-
theatrical distribution netrror:ks; and to detenrrine the
material's classification rating.

8.0 REVIEW COMMITTEE-a group that actually underakes

the ask of reviewiag and- classifing motion pictures,
television programs and publicity matedals, composed of x
least tkee (3) Board Mernbem, in ease of matetials submittcd
for Ffust Review, or of five (5) Board Members, in case of
materials submitted for Second Review.

9.0 TELEVISION BROADCAST-Public showing by

transmitting sound or images by television or similar
equipmeng including cable televisioa, md othet limited

10.0 THEATRICAL DISTRIBUTION-PubIic showing and/ or

GENERAL DESCRIPTION OF GROUPS

I1.0 Offio of tbe Charpernn (OTC)

The OTC provides overall leadership and direction to the

agen€y for it to aehieve overdl goals arld obieetives. The
OTC's specific firnctions indude:

11.1, pedodic review and redefinition of the overall thrusq

directions and goals of the Agency;
11.2 exercise of administrative, technical operational and
firnetiosal supervision aad cont*ol over all groups aad
units of the Agency; and
1.1,.3 fornulation, issuance of and monitodng of the
implementation of policies aad guidelines ia ensuring
the Agency's viabilig internal efficiency, professional
credibility, ffid coa+iauiag relevaace.

The OTC likewise provides the necessary staff work and

support to the Agenct's Board Membets, as well as initiates
and monitors the implementation of Board decisions.

l2.A Ofro of tbe Executiw Director (OED)

The OED oversees the implementation of the Agenqy's

mandate and fuoctions as provided by law and as direltedby
the ChairFerson through the development and institution of
polisy iastturmests, developmeat Programs and interveatioa
proiects. The OED's specific functions include:

the operations of the Agency and such other reports
as rnay be required by the Board.

13.0 Reuiew and Classification Diuision (RCD)

The RCD processes registration of entities and facilitates

review of matedals submitted and release theCetificate of
Registration and Perrrrit to Exhibiq as the cas€ may be, to
ea.tities authorized by law to ea.gage ia the rsevie aad
television industry, to include Importers, Exportets, Film
Studios or Laboratories, Television Networ:ks, Local
Television Operator, Local and Foreign Movie Producers,
Television Ptogram Producers, Distdbutors or Booking
Ageats, M+viehouses, and other aeti+ities fatliag under the
supervision and regulation of the Board as provided in
Section 3 (d) of P.D 1986.

14.0 Adninistratiw a*d Finance Diaision (AFD)

The AFD assists in the achievement of strategic thrusts by

providing administrative and financial services to the
Agency's executive management and opemting units. AFD
is also in-charge in coordiaatingwith oversight agencies such
as Coemissiore olr ,{"udit (COA), Departmeat of Budget aad
Management Q)BM), Department of Finance Qo$,
Bureau of Intemal Revenue (BIR), Govemment Service
Insurance System (GSIS), Home Development Mutual
Fuad GIDI4F), Philippine Health Itsurance Co{p.
philHealth), ffid othet ovenight/regulatory bodies of the
Govetnment.

14.1 The l{nance Section of AFD is responsible for [a]

accounting [b] budget allocation; and [c] management
reporting fnduding proiect financial performance);
and [d] treasury serviees.

14.2 The Administrative Section of AFD takes charge of

all co{porate administrative logistical matters,
including [aJ procuremeat/ purchasing; [b] property

policy coflcerns. It also revieurs znd provides
reconrmendations to addtess potential litigation *iriog from
the implementation of P.D lgAO. Another ser:vice that the
I-AD provide is the coaduet of legal reseateh and studies.
I-AD also maifltaifl a database ofl, and monitor laws,
administrative issuances, court decisions, and other legal
issuances relative to P.D 1986.

and will issue the Order of Payment (Attachment2).

3.4. The applicant shall then pay the prescribed fees to the
Cashiei.

Once payment has been made, the applicant shall go

back to the registration officer in charge.

3.6. The registration offi.cer receivingthe application form

with receipt shall print the Certificate of
Registration (Attachment 4).

3.7. Once the Certificate of Registmtion is printed the

3.0. Procedure

3.1. Persons/entities applFng a Permit to Exhibit

(Attachment 5) with the Boacd shall subrnit a duly
accomplished and notadzed Application Form
(Attachment 1) with the required documents to the
RCD. All requirements must be submitted in order to
advance to the next pfocedure.

3.2. The details provided by the applicant in its application

form shall be encoded into the computer system by
the assigned rcgisttation officer.

3.3. The registration officer shall process the assessment

and will issue the Otder of Payment (Attachment2).

3.4. The applicant shall then pay the prescdbed fees to the
Cashier.

3.5. Once payment has been made, the applicant shall go

back io the registation officer drid submit the
matetial for tevievr

3.6. The rcgistration officet shall then endorse the

material fot revieur to the MTRCB Chailperson. The
MTRCB Chairperson will thea assign thri:e (3) Board
Members whowill serve as the Revieui Committee to
re+ieqr the matedal submitted.

3.7. Once the members of the Review Committee is

detemrined, the RCD will then forward the details
(such as the date and timE to the Preview Section fot
the assigrurrent of P"revieur Assistants.

,.8. The Previeur Assistant assigned will then give each

member of the Revieur Committee ooe (1) Voting Slip
(A,ttachment 5) which will be filled up by the Board
Meanbes after the review of the lclateria].

i.9. After the preview of the matedal, the Committee will

decision in witing through a Committee Report
(Attachment 6), which shall sa& the reasons for
classification following the content para{neters set by
the Board.

material classification rating different from the

file a Motion for Reclassificatioa urithin five (5)
calendar days from the receipt of notice of the
decision. Upon receipt of the Motion for
Reclassification and/or Reconsideration, the
Chafuperson or the BOARD shall designate a
Committee on Second Review composed of five (5)
Board Members to conduct a second review of the
material.

3.10. The PreviewAssistantwill then encode the deails of

the Committee Report and will prirlt the Penrrit to
Exhibit (Artachment I

3.1 l. The Penrrit to Exhibit is then forrxrarded to the Chief

Regisuation Officet for review.

,.12. Once reviewed by the Chief Regisuation Officer, the

Pemit to Exhibit is then fomrarded to the MTRCB
Chaiqpersoa for signatue.

2.0. Proadure
2.1. Ptoceedings before the Board are cofiunence upon
the filiag of the Complaint.

2.2. The Complaint must be in writing vedfied and signed

by the complainant and must contain the following:
2.2,1, The names and addresses of the parties and
their capacity to sue oc be sued;
2.2.2. A statement of televant facts, including all
relevant dates;
2,2.3. A statement of lawls violated; and
2.2.4. Therchef/s prayed for, aad the preliminary
order, preventive measure order, or
temporary ordet soughg if any.

2.3. All complaints and otherpapers shallbe filedwith and

received by the Receiving Section of the Irgal Affairs
Divisioa.

2.4. The I-AD saff receiving the complaint shall record

the complaint in a Logbook and shall assign a case
refetence numbel

2.5. After the recording in the logbook, the complaint

shall be indexed on a card that shall indicate such
infotrnation as the flature of the case, the names of
the litigaats aad their couasel (s), aad the date aad
time of filing. The Attorney V or Attorney III from
LAD shall then refet the complaint to the Chaitman
ot the Heating and Adiudication Committee for its
proper instruction.

2.6. The Chairman or Hearing and Adfudication

proceedings through the adoption of best
practices conferenc e; and

2.6.4. hear and detenrrine the claims and defenses

in the case irr full adversarial ptoceeding in
the event of failue of any mode of non-
adversarial dispute tesolution.

2.7. If the complaiat is pdm, facie meritorious, the

Chaiman or the Hea"irg and Adiudication
Committee shall order the I-AD to issue a notice or
summons to the respondent requiring the latter to
eppear fot a Maadatory Coaf,eresee.

2.8. Should that f,hairperson or the Heariag and

Adfudication Committee find upon the considi:ration
of the affidavits and other evidence submitted by the
parties thet a deeisioa may be rcadeted thereos
without the need of a fomral hearing the Chairyersoo
or the Committee may proceed to rendet a decision.

The decision of the Chairperson or the Hearing and

Adiudication Committee shall be in writing and shall
state cleady and distinctly the facts of the case and the
basis for the decision.

2.10. The LAD shall then notifr the parties of the decision
personally or by registered mail addressed to the
parties' counsel of record, if any, or to their last
kqowa address.

2.1l. The parrry adversely affected may file one motion for
reconsideration of the decision within fifteen (15)
days aftet recelpt of the decision.

2.12. If the motion for reconsideration is denied, the parry

adversely affected by the decision of the Board may
appeal to the Office of the President within fifteen
(15) days ftom the official receipt of said decision,
deducting the time dudng which a motion for
reconsideration, if any, is pending.
