Discuss some flaws of rice share tenancy Act.

Ans:

The original rice share tenancy act. Was passed by the Philippine legislature in 1933. The rice share
tenancy act as amended in 1946 is a much misunderstood piece of ligeslation in the Philippines today, and
unfortunately that misunderstanding has been perpetuated by many western reporters on Philippine
affairs. The act’s many admirable provisions were unfortunately rendered useless by final one. The tenacy
problem was geographically as peculiar to central Luzon as it was agronomically to rice.
The major flaw of the law was that it could be used only when tha majority of municipal councils in a
province petitioned for its implementation. land owners usally controlled such council so, no province
attempted task that the law be applied. When President Quezon noticed how landowners circumvented
the law, he ordered that the law be mandatory in central Luzon provinces but the contracts were good
only for one year .

Activity3 p107. Distinguish some loopholes of Republic act. No. 3884. Explain each.

Ans:
the agricultural land reform code (ra 3844) was an advancement of land reform in the Philippines and was
inacted in 1963 under president Diosdado Macapagal. It abolished tenancy and established a leashold
system in which farmers paid fixed rentals to landlords, rather than a percentage of harvest. In agricultural
lease
Hold, the farmers cultivates the the land belonging to, or possessed by, another with the latter’s consent
for price certain in a money or in produce or both. It also established the land bank of the Philippines to
help with land reform, particularly the purchase of agricultural estates for division and resale to small
landholders, and the purchase of land by the agricultural lessee.

While the law was a significant advance over previous legislation, the bill was weakened by numerous
amendments imposed by congress, which was dominated by landlords. It was also weakened by the
failures of congress to allocate necessary funds for effective implementation of the law. The act ha been
further amended several times subsequent to becoming law by later legislation.
