Exercise No. 10

1. A offers to sell his one and only motorcycle for P15,000 and B agrees to buy it for said
amount. Is the contract perfected? Explain.
 According to Art. 1315, if B agrees to A’s offer, about selling the car and at the
same it’s price, the contract is perfected because there is a meeting of minds
upon the subject matter and cause of the contract.
2. Suppose in the above problem, B wants to buy the motorcycle for P12,000. What is the
effect?
 According to Art. 1308, the contract is binding upon both contracting parties and
either of them can enforce the contract against the other. If A’s offer got accepted
by the offeree, which is to buy the motorcycle for P12,000, then the contract will
be valid. However, if the offeree turned down A’s offer, the contract will be void
because the contract does not bind the both parties.
3. On November 15, 2020, A sold to B his one and only car for P200,000 to be delivered
and paid on November 30, 2020. Is there a perfected contract between A and B? When
is the contract perfected?
 According to Art. 1315 and 1316, if there is no real contacts involved in both
parties, the contract is perfected by mere consent even though there is no
delivery and payment of the price happened. From the moment both parties had
meeting of minds, then the contract is perfected.

perfected between X and Y? Explain.
 According to Art. 1315, if both parties bind themselves to each despite knowing

contract is perfected and valid between X and Y.
