Further, itis to bring in your kind notice that Concessionaire’sagain submitted Construction Time Schedule showing the planned progress of the project highway vide letter referred at sr. no: 03, in which mile stone dates have been revised without taking in account that EOT has not been approved yet. Therefore, Concessionaire does not get relieved from its obligation of achieving project mile stone-1 AAs, so far 28.63% of the contract period has been elapsed already and as per your submitted MPR for the Month of January 2021, the overall Physical Progress achieved as on 31.01.2021is 5.44%, whichclearly shows that no concrete actions have been takenin these passed months to scale up construction activities,in spite of several notification by IE. Also,Concessionaire has failed to achieve Project Milestone-I. Again, we would like to remind you that as per Clause 2.1 Schedule-G of CA, the Project Milestone-1 shall occur on the date falling on the 160®Day (One Hundred and Sixtieth) from the Appointment Date (24.07.2020), hence the Project Milstone-I shall have occurred on i, 30.12.2020, in which Concessionaire shall have commenced construction of the project and achieved 20% physical progress Moreover, Pursuant to CA clause 12.3.2 “The Concessionaire shall construct the Project in accordance with Project Completion Schedule set forth in Schedule-G. In the event that the Concessionaire fails to achieve any Project Milestone within a period of 90 (Ninety) days from the date set forth for such Project Milestone in Schedule-G, unless such failure has occurred due to Force Majeure or for reasons attributable to the Authority, it shall pay Damages to the Authority in a sum calculated at the rate of 0.1% of the amount of Performance Security for delay of each day until such Project Milestone is achieved; provided that if any or all Project Milestones or the Scheduled Completion Date are extended in accordance with the provisions of this Agreement.” On ‘ oO eae - Page dota Engineers Pv.
