JUDGE: Everyone but the jury may be seated. Bailiff, please swear in the jury .
Bailiff (to the jury): Please raise your right hands. Do promise that you will listen to this case
and render a true and fair verdict for this defendant?

JUDGE: Ladies and gentlemen of the jury, this case involves the accusing a crime commits under
the Article 308 of the Revised Penal Code also known as Theft and the story is all about the
disappearance of (Victim’s) Money from her/his Bag on November 19 2021. In this case,
(Victim), who is a 4rth Year College and a BS Criminology at San Sebastian College Re-Colletos
De Cavite’s School is the plaintiff and (Defendant) who is also a 4rth Year College and a BS
Criminology at San Sebastian College Re-Colletos De Cavite’s School is the defendant. (Victim) is
asking you to decide whether or not (Defendant) stole her Money from her/his Bag, leaving
only a Wallet and a few 25 centavos coins. (Victim’s ) lawyer, do you wish to make an opening
statement?
PLAINTIFF'S LAWYER: The evidence in this case will prove that on Friday, November 19,
(Defendant) took my client's Bag from the classroom while my client taking the bathroom.
When (Victim) opened her/him Bag in the cafeteria, her/his notebooks and her/his modules is
messy and he/she found out that her/his wallet is opened and all of his/her money is gone the
only thing left in the wallet is a few 25 centavos coins.
DEFENDANT'S LAWYER: Ladies and gentlemen of the jury, my client, (Defendant), has been
wrongly accused of stealing (Victim’s) money. He was asked by (Witness 1) to carry the bag a
minutes of (Victim) into the outside while he/she cleaning the classroom on November 19.
He /She did carry the Bag at outside while waiting (Witness 1) to be done of cleaning the
classroom but he/she didn’t opened the Bag of (Victim)

VICTIM: I'm a 4rth Year College and a BS Criminology at San Sebastian College Re-Colletos De
Cavite’s School.
PLAINTIFF'S LAWYER: Could you describe how much the money that you have and brought to
school on November 19 2021.
VICTIM1: I brought P1,550 and 4, 25centavos in my wallet, Notebooks, Pens and Modules
inside my bag
PLAINTIFF'S LAWYER: What was in Bag when you opened it in the cafeteria?
VICTIM: I had seen Messy Books and 4 of my Modules actually it was 5 Modules and my 4, 25
centavos coins.
PLAINTIFF'S LAWYER: (VICTIM), can you show me the bag, that, what is marked as Evidence # 1
and ask if that is your Bag that you found empty on November 19 in the cafeteria.

WITNESS1: I am a Student and still studying at San Sebastian College Recoletos de-Cavite
School as a 4rth Year College And BS Criminology.
PLAINTIFF'S LAWYER: So On November 19, 2021 did you have classmates named (Victim) and
(Defendant) in your class?
WITNESS1: Yes.
PLAINTIFF'S LAWYER: Did you ask (Defendant) to take (Victim’s) Bag outside of the classroom
on November19, 2021?
WITNESS1: Yes, that was because I had to clean the classroom before we left.
PLAINTIFF'S LAWYER: About how long was (Defendant) gone from the classroom?
PLAINTIFF'S LAWYER: When (Defendant) returned to the class did anything unusual happen?
WITNESS1: Yes. He/ She and (kahit sinong klassmeyt niyo puta) started giggling at the corner of
the classroom
DEFENDANT'S LAWYER: Yes. (Witness1), you don't know why my client and (kahit sino to ah)
were giggling, do you?
WITNESS1: No.
DEFENDANT'S LAWYER: How many other people could have touched Bag while it was in the
classroom?
WITNESS1: Oh, I don't know, probably anyone in the other courses, first or second year I think
who are there before we return at the classroom.
COURT REPORTER: (to the witness) Raise your right hand. Do you solemnly swear that the

WITNESS 2: I do.
PLAINTIFF'S LAWYER: State your name.

PLAINTIFF'S LAWYER: Did you notice anything unusual about him/her on November19?
WITNESS 2: I noticed he had so much money almost P1,500 I guess and counting it repeatedly
and feeling uncomfortable
DEFENDANT'S LAWYER: (Witness2), did you notice this much of money he/she had on, before
or after lunch on Number 19?
COURT REPORTER: (to the witness) Raise your right hand. Do you solemnly swear that the
testimony you are about to give is the truth, the whole truth and nothing but the truth, so help
you God?
WITNESS 3: I do.
WITNESS 3: “name”
PLAINTIFF'S LAWYER: (Witness3), do you work at San Sebastian College Recolletos de- Cavite
School?
WITNESS 3: Yes, I am the janitor man at the school.
PLAINTIFF'S LAWYER: Did you find anything when you go inside of the classroom after they left
at the classroom on November 19?
WITNESS 3: No, but I found at the outside of the classroom a module who named of (Victim)
after the (defendant) left of the classroom.
PLAINTIFF'S LAWYER: (Witness3) , (Victim) can you show me the module that had been missing
what is marked as Evidence #2 and ask if you can identify this.
WITNESS 3: Yes, that is the module that I found outside of the classroom on November 19?
JUDGE: Evidence #2 is offered into evidence. Do you want to cross-examine this witness,
defense counsel?
DEFENDANT'S LAWYER: Yes. (Witness3), what time did you the module?
WITNESS 3: No.
JUDGE: Defense counsel, you may present your case to the jury.

DEFENDANT'S LAWYER: (Defendant) , did you stole of P1,550 of money, from (Victim’s) Bag
while he/ she is taking a bathroom on November 19?
DEFENDANT: No.
DEFENDANT'S LAWYER: Did you saw one of your classmates staring at you on that day?
DEFENDANT: Yes.
DEFENDANT: I think he’s confuse about (Kahit sino to) and I were talking in class.
COURT REPORTER: (to the witness) Raise your right hand. Do you solemnly swear that the

WITNESS 4: I do.
WITNESS 4: Yes.
JUDGE: Sustained.
WITNESS 4: Yes.
WITNESS 4: Yes, Actually He treated me any food that I mention to him because he owes me
and I’m so confused why he had so much money so I asked him and he told to me to not to
worry about it and he just let me choose any of the stuff or food that I want and he willing to
buy it for me.
JUDGE: Plaintiff's counsel, would you care to make a closing argument to the jury?
PLAINTIFF'S LAWYER: Your honor, ladies and gentlemen of the jury, the evidence you have
heard proves that (DEFENDANT) had possession of (Victim’s) Money after he left the classroom
on the second floor on November 19. The evidence also shows that when (Victim) opened her
Bag in the cafeteria all that was left were a Messy Notebooks, 4 of her/his Modules actually its
5 and a 4 25 centavos coins You heard (Witness) saw (Defendant) felt uncomfortable like
anxious and that (Defendant) and (kahit sino to ah) were "giggling" about something when he
returned from the outside of the classroom. Don't you think it was about a trick he had played
on (Victim)? You also know that (Witness 3) found 1 of module of (Victim) found out at the
outside of the classroom later that day. I ask you to do the right thing and bring back a verdict
in favor of (Victim) and against (Defendant).
DEFENDANT'S LAWYER: Yes, your honor. Ladies and gentlemen of the jury, (Defendant) is an
innocent guy. Do you think he could take so much Money while (Victim) taking a Bathroom for
a minute or in just five minutes? While there is someone like (witness1) see him / her clearly
from inside of the classroom? Do you think he can’t treat (Witness 4) by his own money and do
you think that he doesn’t have the rights for keeping his earning or not to telling to him/ her
that the money where from it came from? (Witness2) said he is uncomfortable while counting
the money repeatedly but she/ he didn't know if that was before or after that (defendant)
counts the money. Plenty of first and second year are possible stole (Victim’s Money).
Remember, (Witness1) said some of the first and second year and they didn’t know what is the
course is, left at the classroom before they return at the classroom. I ask you to do the right
thing and bring back a verdict in favor of (Defendant) and against (Victim).
