AN ORDINANCE AMENDING ORDINANCE NO. 0239 S. 1997, AN


ORDINANCE CREATING THE CALOOCAN COOPERATIVE
DEVELOPMENT AND COORDINATING OFFICE, PRESCRIBING ITS
POWERS AND FUNCTIONS AND APPROPRIATING NECESSARY
FUNDS THEREOF.

WHEREAS, the Local Government Code, Section 34, 35, 36, strengthened the
fundamental law of the land to fully recognize the essential and crucial role of the non-
governmental organizations (NGOs) with demonstrated capacity in the decision, policy
making and implementing processes of the government;

WHEREAS, Republic Act No. 6939 or the Cooperative development Authority Act
fosters the creation and growth of cooperatives for promoting self-reliance and
harnessing the people’s power for economic development and social justice. It further
provides among others, that all departments, branches, subdivisions and
instrumentalities and agencies shall ensure the provision of technical guidance, financial
assistance and other services to enable the cooperative sector into viable and
responsive enterprises towards economic expansion;

WHEREAS, it is the declared policy of the State as prescribed in Article 2 of Republic


Act 9520 otherwise known as the Cooperative Code of 2008 to promote the viability and
growth of cooperatives as instruments of equity, social justice and economic
development and recognizes cooperatives as associates organized for economic and
social betterment of their members, operating business enterprises based on mutual
aid, and founded upon accepted cooperative principles and practices;

WHEREAS, the City of Caloocan acknowledges importance of the Cooperative sector


and the role it primarily plays as responsible for the institutional development of local
cooperatives. Accordingly, the approval of City Ordinance No. 0239 s. 1997, duly
authored by no less than City Councilor Oscar G. Malapitan in1997, shows the full
recognition of the administration to the rights of the Cooperative sector to initiate and

foster within its own ranks cooperative promotion, organization, training, information
gathering, audit and support services with government assistance where necessary;

WHEREAS, now Chief Executive, City Mayor Oscar G. Malapitan, declared the policy of
the City to adopt the principle of consultative and participatory democracy as an
effective device to gain cooperation from non-governmental organizations for economic
prosperity, political unity and social justice within the City of Caloocan and to conform
with such declaration, it is vital to amend Ordinance No. 0239 s. 1997 to make feasible
for implementation.

NOW THEREFORE BE IT ENACTED, by the Sangguniang Panlungsod, in its


session duly assembled, THAT:

Section 1 of Ordinance 0239 s. 1997 is hereby amended and


shall now be read as:

SECTION 1. The Caloocan City Cooperative Development Office


is hereby created under the Office of the City Mayor to carry out the
provisions of this Ordinance.

Section 2 of Ordinance No. 0239 s. 1997, is hereby amended


and shall now be read as:

SECTION 2. POWERS AND FUNCTIONS – The Caloocan


Cooperative Development Office shall perform the following functions:

C. Support the voluntary organization and consensual development


of activities that promote cooperative movements;

Item F is hereby deleted and the succeeding items shall be


consequently adjusted accordingly as items F, G, H, I and J.

Section 4 of Ordinance No. 0239 s. 1997, in order to conform


with the updated qualification standard and position titles as
prescribed in the Plantilla Positions, the staffing pattern is hereby
amended and shall be read as :

SECTION 3. ADMINISTRATIVE AUTHORITY – The Caloocan City Cooperative


Development and Coordinating Office shall be headed by an Executive Director whose
rank and benefit shall be that of the Department Head of the City. The Executive
Director must be a citizen of the Philippines, a resident of Caloocan City, must be a
graduate of Bachelor of Laws or Masters in Public Administration or a graduate of a
Cooperative course from a recognized university with relevant experience in
Cooperative Management and Development. The Executive Director shall be appointed
by the City Mayor with the concurrence of the Sangguniang Panlungsod. The position of
the Executive Director shall be coterminous with the appointing authority.

SECTION 4. STAFFING PATTERN – In order that the office may effectively


discharge the powers and functions as mandated by this Ordinance and in order to
provide effective and adequate assistance to cooperatives existing in the two Districts of
Caloocan City, the following positions are hereby created:

Salary Grade

Two (2) Cooperative Specialist II 15


Two (2) Cooperative Specialist I 11
Two (2) Clerk III 6

SECTION 4. STAFFING PATTERN- In order that the office may


effectively discharge the powers and functions as mandated by this
Ordinance and in order to provide effective and adequate assistance to
cooperatives existing in the two Districts of Caloocan City, the following
positions are hereby created:
Salary Grade

Two (2) Cooperative Specialist II 15


Two (2) Cooperative Specialist I 11
Two (2) Clerk III 6

In order to alter the amount of Three Hundred Thousand Pesos


appropriated in Section 5 of Ordinance 0239 s. 1997, the
appropriation is hereby amended and shall be read as:

SECTION 5 APPROPRIATIONS – The amount of TWO MILLION


PESOS (P 2,000,000.00) is hereby appropriated which shall be taken from
the General fund of the City for the maintenance and operating
expenditure for its full operation.

SECTION 6. REPEALING CLAUSE – Any Ordinance, Resolution


or Executive Order inconsistent with this Ordinance or any provision hereof
is hereby repealed or amended.

SECTION 7. SEPARABILITY CLAUSE – Any provision of this


Ordinance declared to be unconstitutional or invalid shall not affect the
remaining portions or provisions hereof.

SECTION 8. EFFECTIVITY - This Ordinance shall take effect


fifteen Days (15) after its publication in a newspaper of general
circulation.
