Councillor Q&A — Temporary Homeless Shelters
A: These shelters cannot remain on-site indefinitely and will be removed. A deadline has not yet been
finalized. Placing anything in a park for the purpose of temporary or permanent accommodation is not
permitted under By-Law P-600 Section 8(2)).
From the outset, the approach has been to not force the eviction of residents from homeless
encampments until adequate housing has been identified and offered by the province, and/or the
health and safety of the residents or public are at risk. This approach does not condone or support the
installation of infrastructure associated with encampments.
Staff have continued to work closely with the province and community-based partners, as they make
every attempt to help identify adequate housing for those in the temporary shelters. The municipality is
continuing to work with these partners on housing and homelessness in our region to support
individuals experiencing homelessness.
Q: There is a temporary shelter in a municipal park near me. What is being done about this?
A: The municipality is working with partners at the province, as well as Street Outreach Navigators, to
identify potential housing options for residents. These shelters cannot remain on-site indefinitely and
will be removed.
Placing anything in a park for the purpose of temporary or permanent accommodation is not permitted.
A: The province, working alongside community partners such as Street Outreach Navigators, have
offered occupants of the temporary shelters a range of housing options. Services to assist residents
experiencing homelessness are voluntary. Occupants can choose whether to accept or decline available
options.
0: Someone is building a temporary shelter/shed in my area. What is being done about this?
A: If the municipality receives a report that a temporary shelter/shed is being newly built, the
municipality will dispatch staff and attempt to halt the construction of the structure. Placing anything in
a park for the purpose of temporary or permanent accommodation is not permitted (By-Law P-600
Section 8(2)).
If a new structure is built, and a resident has moved in before construction can be halted, the
municipality will take the necessary steps to have the shelter removed, working alongside Street
Outreach Navigators and the province.

A: A deadline has not yet been finalized for the removal of these temporary shelters. The municipality
continues to work with partners to identify and offer alternative options for those currently living in
temporary structures.
A: As shelters were constructed in the colder months, they were able to remain on-site while staff
continued to work with these individuals and community-based partners to identify adequate housing
for these residents. Potential removal of the shelters has been further postponed until COVID-related
public health restrictions are eased.

Street Outreach Navigators and the province as they explore alternative housing options.

Municipal statement
Wednesday, August 18, 2021 (Halifax, NS) — The following is a statement from the Halifax Regional
Municipality regarding homeless encampments located on municipal property and this morning's
presence of municipal staff and Halifax Regional Police officers in a number of municipal parks:
Over the last several months, the municipality has taken a progressive approach to education and
awareness related to the installationof tents and temporary shelters in municipal spaces. These efforts
have included ongoing offers of support and services through the Street Outreach Navigators and the
housing support workers, posting signage in municipal parks and visits to sites by municipal staff, who
have advised tent occupants that placing anything in a park for the purpose of temporary or permanent
accommodation is not permitted.
Further, the municipality has worked with the province, as well as community-based partners including
the Street Outreach Navigators and housing support workers, to offer those experiencing homelessness
with support — including a range of housing options and/or temporary accommodation. The Province of
Nova Scotia continues to work to secure temporary accommodation options that can bridge to
permanent housing. Temporary accommodation options — including hotel stays and shelter beds — are
being made available to occupants of encampments located on municipal property.
Along with offers of support, including housing options and/ or temporary accommodation, the first step
in our approach continues to be focused on education and we will use our enforcement options only if
necessary.
The situation at a number of parks, due to the recent proliferation of tents, has created an increased risk
to the health and safety of both the tent occupants and the public, and must be addressed. The
municipality has received numerous reports from residents including public nuisance complaints and
concerns for public safety. In light of this, steps were taken earlier this week to provide tent occupants
with written notice to vacate and remove all belongings from municipal property immediately. The
municipality is hopeful that occupants of homeless encampments will voluntarily vacate and remove
their belongings from the parks.
This morning, representatives from Municipal Compliance officers are following up with tent occupants
to aid the safe removal of tents from municipal parks. Staff members from Parks and Recreation and
Halifax Regional Police are onsite to assist with removal efforts if required.
All members of the public have a right to use and enjoy the entirety of municipal parks, not just the
portions otherwise occupied by temporary dwellings. With the safety of all residents as a top priority, it
is the municipality's obligation to address the hazardous conditions posed by this encroachment through
appropriate enforcement of existing laws and regulations.
The municipality continues to balance its obligation to enforce the rules and regulations with its
commitment to an empathy-based approach to homeless encampments that recognizes the human
dignity of people experiencing homelessness. This approach does not condone or support the
installation of infrastructure associated with encampments and requires that steps be taken to address
demonstrated risks to the health and safety of occupants or the public.

As housing insecurity continues to be an issue in the region, work with community partners and other
levels of government has significantly accelerated, and collaboration has expanded to help address both

Thanks Shaune for the intel. We made a conscious decision to not telegraph our operation to those
agencies given the serious risks of doing so. Three sites we evacuated without a problem but had we
telegraphed those, the scenario we saw at the Library would be times four instead of one. Everyone
wants to help which is great but there was zero chance we would put our operation and staff at risk
by doing what they suggest, i.e. telling them in advance.

In speaking with one of the service providers, they were of the view that while hotel rooms may
have been offered at some point many of the people in tents and sleeping structures have not been
able to be successfully housed, even as a bridging solution, in hotels. So, while we have said they
turned down the option the service providers may have been able to come up with other
alternatives if they were aware that H R M was going to move on the tents yesterday. Instead Adsum,
Out of the Cold, Eric the street navigator (who was on vacation), North End Clinic have taken
positions against the municipality.

I wasn't at the sites yesterday but based on information I heard throughout the day and this morning
from people who were directly involved here's the situation:
As per the operational plan put in place by Parks and Recreation, people at all of the tent sites had
been visited by staff (P&R, Compliance, HRP Community Response Officers) in the past two weeks,
advised they needed to move along, and provided information sheets with contacts for housing
options and other supports. Navigators and provincial staff were made aware that this was
happening so that support workers could follow-up and visit those sites throughout the two week
period. This led to the notices being issued at all sites on Monday, when the support information
was again provided by staff. Navigators and the province were informed of the day that notices were
being issued. As you know, this is a continuation of the work that had been happening for the past
few months with folks in the crisis shelters as well as those in tents (where possible). As has been the
case all along, some individuals have accepted support and/or options, some have not.
Because yesterday was an HRP operation it had to be kept confidential until the work began early in
the morning. Therefore, social response folks were not given advance notice and were not made
aware of the operation until around 7:00 am. HRM staff again had the information sheet available
for residents at the sites and the intent was, once they were made aware, that outreach workers
would work throughout the day (as they always do and will continue) to try to offer housing options.
Eric is right in that it was a bit of a scramble yesterday for them to coordinate on short notice,
especially since he had been on vacation. Overall, the challenge with the tent encampments,
compared to the crisis shelters, is that there is a larger volume of people and the residents are more
transitory so numbers / conditions at sites change on a daily basis.

The Mayor understands that one of our navigators tweeted that they returned from vacation to find
people evicted, and he had to scramble to find lodging for them. That would appear, on the face of
it, to not jive with our statement that everyone was offered a place to stay. There is no doubt that

INFORMATION NOTE
Overview:
Over the last several months, there has been an ongoing increase in complaints and calls for police service in the
areas of and surrounding a number of illegal encampments on municipal properties and parks across HRM.
These complaints relate to assaults, domestic disputes, thefts, indecent acts, liquor offences, break and enters,
and allegations of threatening behaviour. This note provides background on yesterday's enforcement actions
related to these encampments, information related to a number of questions that have been raised and the
surrounding context.
Following months of unsuccessful attempts at direct education, awareness and engagement efforts with
occupants, yesterday, while assisting Compliance staff, HRP officers used enforcement options to respond to the
ongoing situation related to these dwellings. These actions came on the heels of verbal warnings to occupants as
well as formal written notices provided earlier in the week to vacate these dwellings.
Yesterday, along with compliance officers, HRP members were able to peacefully vacate three of the highest risk
encampments in Halifax. While attending the location on Spring Garden Road, protesters' actions and the
gathering created unsafe conditions for themselves, the public and our officers. Since then, we have heard many
claims, questions and some misinformation on social media and from some members of the public. As these
messages are shared, we also encourage people to also take a close look at many videos and visuals that have
surfaced to gain a perspective on the complexity of the situation our officers were met with yesterday.
Many members of the public have claimed that the protestors were peaceful. The reality is that many were
confrontational, assaultive and caused hazardous situations. The protestors' behavior on site included throwing
projectiles at our officers and municipal staff, coming to the protest with chemical irritants and damaging
municipal property. As a structure was being removed, they threw themselves in the path of heavy equipment
and officers doing their work on scene. This not only hampered the removal efforts but could have led to serious
injury for anyone in the vicinity, themselves and the officers.

addressed below by topic:

Use of sensory irritant:
As part of attempts to disperse the crowd in a rapidly evolving event with many hazardous conditions — including
assaults on officers — a sensory irritant was deployed. There were several people in the area of its deployment.
Due to the nature of this equipment, it can carry the chemical broadly in an area and is not designed for
targeted attack. In every instance that a use of force option is used, the rationale and details are fully
documented. We will be looking at all those details. However, if any members of the public have any direct
information or additional details, they can bring it forward to professional standards division.
Officer identification:
Officers are expected to display name tags when in operational duties as part of their uniform. We cannot speak
to the specifics of each one of the instances that have been cited related to office identification. However, as
always, if anyone has any additional detail, information or concerns that they would like to bring forward, we
encourage them to reach out to our professional standards division.
Media's access:
We respect the rights of media, expect their participation in matters of public interest and make every effort to
facilitate their access. At this time, we have no specific information in relation to claims that officers asked
media for credentials, as has been claimed. However, here is some context. This was a rapidly evolving situation
and officers were in the process of containing a volatile situation and establishing an operational perimeter to
allow for the safe removal of temporary dwellings. A number of reporters decided to set-up very close to the
area where there was active removal work going on and that posed hazardous conditions. Police were
responsible for the safety of everyone at the scene. For safety reasons, an officer repeatedly asked a reporter
who moved from this area to move back to nearby area above some steps. In this case, when the reporter
continued to not comply, they were advised, as any members of the public would have been in that situation, of
the possibility of an arrest should they not comply.
I want to conclude by saying that we have an obligation towards the overall safety of the public, other users of
municipal properties and residents of nearby communities:We cannot allow trespass and misuse of municipal
property as being a "normal" occurrence in our city as we have seen of late with tents and structures appearing
arbitrarily on many sites across the municipality. Our approach has been and will remain focused on
engagement and education while offering alternatives to those experiencing homelessness. Enforcement will
always be a last resort when it comes to this issue as we have seen over the last six months.

The hotel stays have to be coordinated through the Navigators and Provincial staff who were

Hi Jacques,
There has been a number of conflicting comments about the actions of the contractor
on Wednesday. I have investigated to get an understanding of the actual situation and
thought I would also send you my finding so you have it.
The contractor had all necessary equipment, including the flatbed truck, skid
steer/bobcat, the extender arms which were needed for the larger shelters and
cables/ties to secure the shelters on the truck. That was the same equipment which
was used to remove the earlier shelters and each was able to be loaded in a few
minutes.
By the time the 3 sites were completed on Wednesday, it was around mid-morning and
more people were starting to be aware of the work. At the Common, a small group of
people started to gather to watch and they followed staff/police when they headed to
the library site. At that site, the crowd was starting to grow and numbers increased
quickly after they got there. With all of the people, it took close to an hour for the
contractor to be able to get through the crowd and then back to the truck with the first
shelter. By that time, the crowd had grown considerably and were surrounding the
flatbed truck and equipment. The contractor was concerned about the safety of their
workers and potential damage to their equipment, since HRM vehicles were being
damaged. Since the first removal took extra time and the crowd was continuing to
grow, there was also concern they were not going to be able to get through the crowd
and back to the truck without issues. So they decided to take the first shelter to the
nearby depot and come back. They were hoping the crowd would be dispersed or
under control by the time they got back. But, when they got back, they could not get
anywhere near the site.
Parks staff suggested securing the structure and then coming back after the crowd
dispersed to load it. But police felt it needed to be removed since everyone was on site
and it could be challenging to get it later. So the plan changed to disassemble it with
tools.
We will be reviewing future plans both internally and with the contractor to look for
better/quicker ways to be able to remove multiple structures at one time, especially if
there is a crowd at the site.

The Province bought or is buying the former RCMP site @ Bayer's & Oxford from Canada Lands. The
site is currently level, vacant and dormant. HRM is currently sourcing ATCO construction trailers
equipped with bedrooms and kitchens to somehow partner/cost-share with the Province on
temporary housing for homeless people currently living in tents and sheds. Paul, please advise if the
Province can agree to use that site on which to locate the temporary housing units until the 92 total
supportive housing units are available on 472(1)(a)(ii)

Province through its existing staff and NPF social agencies would provide wrap-around services to the

I have spoken with many leading multi-residential property owners who are interested in exploring
the amassing of up to 20-30 rental units dispersed across the City as long as the Province or HRM
hold the head lease and the tenants can be removed immediately if they do something egregious. I
suspect the Residential Tenancies Act would have to be reviewed to see it applies to either the
Province or HRM. The owners will not play if they are required to follow a 2-3 month process under
the Act to evict the tenant. Please advise me Tracey whether the Province sees that as a viable
solution for some client types. The idea includes the property owners hiring the tenants as unskilled
labour for which there is a serious shortage now with the Province provided wrap around services as
required.

HRP advises that as we have said all along, our approach on this issue always begins with education and engagement.
HRP continues to reinforce the message that camping in a municipal property or park is illegal. In every case a notice is
served, occupants are provided a list of resources and the necessary time they need to leave. HRP has no intention nor
are they prioritizing the mass removal of encampments now; however, enforcement will continue to take place as
necessary on a case by case basis and always starting with engagement and conversation. It is based on public safety
concerns related to specific locations that we are aware of as well as those we are hearing day to day. Accordingly, we
have removed two tents this week from the Halifax Commons as well as we had a conversation with the occupant of a
third, who indicated he required more time. HRP will continue to engage.

Here is the motion as signed off by me, John Jerry and Mary.
That Halifax Regional Council Waive the Rules of Order to suspend the notice provisions
associated with motions and:
O Direct the CAO to implement a range of emergency supportive housing and
emergency shelter accommodations for those who are unhoused in collaboration
with and based on feedback from community-based social services providers and
the Province of Nova Scotia to address immediate and emergent needs including
measures such as the fit-up of spaces for temporary accommodations, renting of
hotel and other spaces and further, and to coordinate and collaborate with
community-based social services providers and the Province of Nova Scotia in that
respect;
o Direct that the CAO be authorized to spend up to $500,000 from Fiscal Services in
respect of addressing these needs, and report on the use of said funds quarterly at a
minimum; and,
O Further direct the CAO to work with Department of Community Services and
community service providers on a needs-analysis including determining how many
people are unhoused, how many of them are currently tenting or occupying other
forms of shelter within parks and other public lands in Halifax Regional Municipality
and how many can be accommodated in a safer manner.

Thanks for this Councillor. Looping in some of my colleagues for their awareness and consideration.
The concept you lay out is interesting but raises questions regarding where we would allow
encampments and have to be mindful of the current by-law that does not allow camping in parks.
We have no issue with those that currently exist in 1-2 tent clusters, subject to health and safety
issues that may arise, but intend to keep the 4 previous hotspots clear of tents unless otherwise
directed by Council via changes to the Parks by-law. We have identified some other sites subject to
further discussion internally and with Council and P&R are considering others:
ir Sanford Fleming (designated area in wilderness section of park)
avencraig Park (designated area in wilderness section of park)
190 Barrington (at Cornwallis, next to Metro Turning Point)
,eary and Windmill Road (just north of Alderney Gate surface parking lots, some tenting there now.
Yesterday the Mayor and I and staff collaborated on a proposed motion, signed off by the Mayor,
CAO, Legal, Finance and GREA, for recommendation to Council on Tuesday (assuming Council agrees
to it as an added item) that would facilitate the engagement with community and agencies as you
suggest. Here is the motion to be circulated by the Clerk shortly:

All this work is in anticipation of 90+ supportive housing units becoming available sometime this Fall.
There are timing, construction, financial and client risks associated with those so the temporary

we do not know what the Province will do but can say recent discussions with the Transition team
and the DM of DCS have been encouraging.
Lastly, Mary met with the community agencies yesterday and I anticipate sharing the debrief results

When I described what was going on here, the size of the camps, the sheds, he paused and said
"that is madness" and described what they have done in Hamilton.
Short version is— they have a written agreement with a timeframe with service agencies and
activists and first voice, that resulted in this:
• No more than five tents in an encampment.
• No encampments on sidewalks, roadways or boulevards.
• Encampments must not encumber an entrance or exit or deemed fire route.
• Encampments must at least 50 meters from a playground, school or childcare centre.
• No encampments within any property with an environmental or heritage designation.
• Situations where health and safety concerns exist for those living within or adjacent to an
encampment will be addressed in a reasonable fashion, in good faith, on a case-by-case basis
by the city in its sole discretion, and in a way that balances everyone's needs. In those
situations, the city will consult with its encampment task force and street outreach team.

So I would like to suggest invite the stakeholders to an in person meeting and lay it out. Status
quo does not work, for the interim we need this kind of framework. Nominate a few third party
experts to help bring down the temperature.
These situations aren't zero-sum but groups like Mutual Aid are treating them as such, so let's flip
the dialog. HMA is not a service agency, would not be a part of this discussion as it won't happen on
twitter. Let's offer to help find the money to support this work along with
