AFFIDAVIT OF UNDERTAKING (RECOGNIZANCE)

I, BONIFACIO GOMEZ JR., Filipino, of legal age and a resident of

Brgy. Pusok, Lapu-Lapu City, Cebu, Philippines after having been duly
sworn to in accordance with law do hereby depose and say that:

1. I am a Barangay Kagawad of Brgy. Pusok, Lapu-Lapu City, Cebu, Philippines

where the accused Rechie Odvina Condes is a resident. I was informed by the
relatives of the accused Rechie Odvina Condes that the latter is charge with
violation of the provision of Republic Act 9165 before the Regional Trial
Court of Lapu-Lapu City, Cebu, Branch 73; (For violations of Sec. 5 & Sec.11
of Art. II of R.A. 9165)

2. I was informed also that the accused already pleaded guilty for the lesser
offenses and already applied for probation. Considering that the approval for
probation will take time due to number of detainees who also applied. From
this I am willing to help the accused; and I am ready and willing to assume
and fulfill my duty and responsibility to supervise and guide the latter Rechie
Odvina Condes during his release on recognizance pending the approval of
application for his probation.

3. I am likewise solemnly promising and undertaking before this Honorable

Court to produce and present Rechie Odvina Condes before this Honorable
Court or to the Probation Officer whenever required to do so during the
pendency of the approval of his application for probation.

4. I am executing this affidavit to attest to the truth of the foregoing and to

support the Release on Recognizance of Rechie Odvina Condes and for
whatever legal purpose it may serve.
