Versus

Respondent:- Sajjan Prasad sahu S/o Ratan lal sahu R/o house no. 180, Kanhaiya
ward Jhanda Chowk Sundarpur, Jabalpur (M.P.)

Application under section 138 of Negotiable Instrument Act (1881)

Aforesaid applicant begs to submit as under:-

1. That, the complainant is having friendly relation with the non-applicant.

2. That, the respondent had sought financial assistance of amount Rupees 17,920/- (Seventeen
Thousand, nine hundred and twenty rupees) before the applicant by stating the reasons
including retardation in business as well as their personal condition as on dated . The non-
applicant thereby promises to pay the debt amount within the period of three months
thereafter respondent refused to pay back the entire amount within the period of time given by
the applicant.

3. That, after the completion of three months when the complainant tried to recover their
aforesaid amount from the respondent thereafter the respondent issued a cheque bearing of
rupees amount 17,920/- (Kotak Mahindra Bank cheque no. is 000003- Branch- Saaliwada
Jabalpur) instead of paying amount in cash on dated 21/09/2021 and the copy of Cheque is
annexed as annexure A-1.

4. That, the respondent states during the time of issuing a aforesaid cheque (Kotak Mahindra Bank
cheque no. is 000003- Branch- Saaliwada Jabalpur) that the complainant will encashed with
mentioned amount in a cheque but at the time of encashment of cheque

5. That, at the of encashment of cheque were dishonored as we know that this activity becomes an
offence under section 138 of Negotiable Instruments Act (1881)

6. That, if non-applicant won’t pay the entire aforesaid amount hence only he responsible for the
further consequences as well as for legal proceedings.

7. That, the non-applicant also

PRAYER
It is therefore the hon’ble court may be pleased that kindly grant direction to non-
applicant to pay the aforesaid entire amount with interest to the applicant in the
interest of justice.
