I. Mohd. Rasheed Khan S/o Ahamad Khan aged: 52 years, Occupation: Manager.
Star Multipurpose Co-operative Society Ltd., Nalgonda branch R/o H No 5-12-24,
Rahmath Nagar street, Nalgonda town, Nalgonda district do hereby solemnly affirm and
state on oath as follows:
1. I am the deponent herein and working as branch manager in the Opposite Party No.2
Company and as such I am well acquainted with the facts stated hereunder. I am filing
this evidence affidavit for myself and also on behalf of Opp. Party No.1.

2. I submit that the complainant is not a consumer of the opposite party. There is no
relation of consumer and service provider between the complainant and the opposite
parties. The contents set out in the complaint under reply are totally false, frivolous and
vexatious, devoid of truth and not maintainable either in law or on facts as such the same
is liable to be dismissed in limine with costs. The complainant did not approach the
Hon'ble Commission with clean hands and he suppressed material facts in order to
overcome from his own mistakes and making the Opp. Parties victims. As such the
complaint of the petitioner is liable to be dismissed.

3. I submit that complainant had contacted the office of Sahara Credit Co-operative
society Limited (herein after referred to as "Society") to become member and after
understanding the bye-law and objects of the Society he had obtained membership
No.18171201156 of the society as such being a member of society he got rights to take
part in the schemes of Society.

4. The Hon’ble National Commission in Revision Petition No.4871 of 2012 “M/s


Anjana Abraham Chembethi Vs The Managing Director, the Kotthrukulam
Farmers Services Co-operative Bank, decided on 02-09-2013 held that dispute between
member and society is not a consumer dispute under the Consumer Protection Act and
the Consumer Forum has no jurisdiction to try the dispute arising between Co-operative
Society and its members. That in presence case the dispute, if any, between the
complainant and the Opposite Party is between member and society, therefore in the light
of laws laid down by the Hon’ble National Commission in the above case, this Hon’ble
Forum has no jurisdiction to try the present complaint. Thus the present complaint is not
maintainable before the Hon’ble District Forum and is liable to dismissed with costs.

5. I submit that as per the “Arbitration agreement” exists between my Company and
the complainant, the complainant is not a consumer of my Company, and my Company is
duly registered Society and the complainant is a member of the society. Thus relation
between the complainant and the opposite party is a member and society. Therefore for
any dispute between society and member, this consumer complaint is not maintainable.

6. I submit that if the complainant who is member of the society has any grievance or
dispute with the society, the complainant is bound to refer his dispute before Arbitrator as
per Arbitration agreement under clause 10 of the scheme Sahara Special which is
reproduced herein as under:

“In case of any dispute between Cooperative Society and Member account
holder the same shall be decided by arbitration as per "Multi State Cooperative
Society Act, 2002" Arbitration proceedings and proceedings arising out of the
award shall be binding on both the parties"

7. I submit that the company never postponed the payment on one pretext or the other,
and the complainant has not approached my office with the original membership
certificate and other relevant documents, accordingly the said payment was delayed. The
complainant was asked to bring the original membership certificate and other relevant
documents, but instead of producing the same in my office, he filed the complaint.
8. I submit that the complainant failed to submit the original membership certificate and
other relevant documents before my Company to get the maturity amount, and without
submitting the said documents payment cannot be made, as such there is no question of
suffering mental agony and financial loss to the complainant, and my Company is always
ready to make payment, but the complainant himself not furnished the original
documents, as such there is no deficiency in service on the part of my Company, except
payment of maturity amount which is payable as per the terms and conditions of the
scheme, as such as per the “Doctrine of probability” the present complaint is liable to be
dismissed.
9. The following documents may be marked as exhibits in my favour,

10. In view of the above stated facts and circumstances the complainant is not entitled

dismiss the present complaint with exemplary costs.

3. I submit that complainant had contacted the office of Sahara Credit Co-operative
society Limited (herein after referred to as "Society") to become member and after
understanding the bye-law and objects of the Society he had obtained membership
No.718176000469 of the society as such being a member of society he got rights to take
part in the schemes of Society. He also took membership No.18171800671 in the Opp.
Party No.3’s society.
4. The Hon’ble National Commission in Revision Petition No.4871 of 2012 “M/s
Anjana Abraham Chembethi Vs The Managing Director, the Kotthrukulam
Farmers Services Co-operative Bank, decided on 02-09-2013 held that dispute between
member and society is not a consumer dispute under the Consumer Protection Act and
the Consumer Forum has no jurisdiction to try the dispute arising between Co-operative
Society and its members. That in presence case the dispute, if any, between the
complainant and the Opposite Party is between member and society, therefore in the light
of laws laid down by the Hon’ble National Commission in the above case, this Hon’ble
Forum has no jurisdiction to try the present complaint. Thus the present complaint is not
maintainable before the Hon’ble District Forum and is liable to dismissed with costs.
5. I submit that as per the “Arbitration agreement” exists between my Company and
the complainant, the complainant is not a consumer of my Company, and my Company is
duly registered Society and the complainant is a member of the society. Thus relation
between the complainant and the opposite party is a member and society. Therefore for
any dispute between society and member, this consumer complaint is not maintainable.

6. I submit that if the complainant who is member of the society has any grievance or
dispute with the society, the complainant is bound to refer his dispute before Arbitrator as
per Arbitration agreement under clause 10 of the scheme Sahara Special which is
reproduced herein as under:
“In case of any dispute between Cooperative Society and Member account
holder the same shall be decided by arbitration as per "Multi State Cooperative
Society Act, 2002" Arbitration proceedings and proceedings arising out of the
award shall be binding on both the parties"

7. I submit that the company never postponed the payment on one pretext or the other,
and the complainant has not approached my office with the original membership
certificate and other relevant documents, accordingly the said payment was delayed. The
complainant was asked to bring the original membership certificate and other relevant
documents, but instead of producing the same in my office, he filed the complaint.
8. I submit that the complainant failed to submit the original membership certificate and
other relevant documents before my Company to get the maturity amount, and without
submitting the said documents payment cannot be made, as such there is no question of
suffering mental agony and financial loss to the complainant, and my Company is always
ready to make payment, but the complainant himself not furnished the original
documents, as such there is no deficiency in service on the part of my Company, except
payment of maturity amount which is payable as per the terms and conditions of the
scheme, as such as per the “Doctrine of probability” the present complaint is liable to be
dismissed.

relation of consumer and service provider between the complainant and the opposite

society Limited (herein after referred to as "Society") to become member and after
understanding the bye-law and objects of the Society he had obtained membership
No.18171201157 of the society as such being a member of society he got rights to take
part in the schemes of Society.

4. I submit that as per the “Arbitration agreement” exists between my Company and
the complainant, the complainant is not a consumer of my Company, and my Company is
duly registered Society and the complainant is a member of the society. Thus relation
between the complainant and the opposite party is a member and society. Therefore for
any dispute between society and member, this consumer complaint is not maintainable.

5. I submit that if the complainant who is member of the society has any grievance or
dispute with the society, the complainant is bound to refer his dispute before Arbitrator as
per Arbitration agreement under clause 10 of the scheme Sahara Special which is
reproduced herein as under:

holder the same shall be decided by arbitration as per "Multi State Cooperative

6. I submit that if the complainant who is member of the society has any grievance or
dispute with the society, the complainant is bound to refer his dispute before Arbitrator as
per Arbitration agreement under clause 10 of the scheme Star BB which is reproduced
herein as under:
“In case of any dispute between Cooperative Society and Member account
holder the same shall be decided by arbitration as per "Multi State Cooperative
Society Act, 2002" Arbitration proceedings and proceedings arising out of the
award shall be binding on both the parties"

7. I submit that the company never postponed the payment on one pretext or the other,
and the complainant has not approached my office with the original membership
certificate and other relevant documents, accordingly the said payment was delayed. The
complainant was asked to bring the original membership certificate and other relevant
documents, but instead of producing the same in my office, he filed the complaint.

8. I submit that the complainant failed to submit the original membership certificate
and other relevant documents before my Company to get the maturity amount, and

without submitting the said documents payment cannot be made, as such there is no
question of suffering mental agony and financial loss to the complainant, and my
Company is always ready to make payment, but the complainant himself not furnished
the original documents, as such there is no deficiency in service on the part of my
Company, except payment of maturity amount which is payable as per the terms and
conditions of the scheme, as such as per the “Doctrine of probability” the present
complaint is liable to be dismissed.

1. I am the deponent herein and working as branch manager in the Opposite Party No.1
Company and as such I am well acquainted with the facts stated hereunder. I am filing
this evidence affidavit for myself and also on behalf of Opp. Party No.2.

2. I submit that the complainant is not a consumer of the opposite party. There is no
relation of consumer and service provider between the complainant and the opposite
parties. The contents set out in the complaint under reply are totally false, frivolous and
vexatious, devoid of truth and not maintainable either in law or on facts as such the same
is liable to be dismissed in limine with costs. The complainant did not approach the
Hon'ble Commission with clean hands and he suppressed material facts in order to
overcome from his own mistakes and making the Opp. Parties victims. As such the
complaint of the petitioner is liable to be dismissed.

3. I submit that complainant had contacted the office of Star Multipurpose Credit Co-
operative society Limited (herein after referred to as "Society") to become member and
after understanding the bye-law and objects of the Society he had obtained membership
No.718176000675 of the society as such being a member of society he got rights to take
part in the schemes of Society.

4. I submit that my Company issued the copy of By-laws to the complainant, but the
complainant pleads that he didn’t understand the English language and he is not aware of
contents of By-laws, but as per the established law “ignorance of law is no excuse”,

hence the present complaint is hit by the principle of “IGNORANTIA JURIS NON
EXCUSAT” and the same is liable to be dismissed.

5. I submit that as per the “Arbitration agreement” exists between my Company and
the complainant, the complainant is not a consumer of my Company, and my Company is
duly registered Society and the complainant is a member of the society. Thus relation
between the complainant and the opposite party is a member and society. Therefore as
per the established law “any dispute between a society and a member is not a
consumer dispute under Consumer Protection Act, 1986”.
