RENTAL AGREEMENT

This Rental Agreement made and executed at Bangalore on 1st DAY of November, TWO
THOUSAND TWENTY ONE  (01/11/2021) by and between:

Mr.  ANUP AGRAWALLA, represented by Mr SUDHIR MENON residing at Vaishnodevi


Nilaya, Sir M V Nagar, Kalkere Main Road, Ramamurthynagar Post, Bangalore 560016
(hereinafter referred to as the OWNER) OF THE ONE PART.

AND

Mr. SAYAN MUKHERJEE (hereinafter referred to as the TENANT) OF the OTHER PART.
The terms OWNER and TENANT shall mean and include their respective heirs, executors,
administrators, legal representatives, successors, and assigns of their part as parties wherever
context admits it and includes the same.

Whereas, the OWNER is the sole and absolute owner of the residential property Flat No. 301,
Maithri Opulence, 6th A Main, G M Palya, Bangalore-560075 which is more fully described
at the Schedule hereunder (hereinafter referred to as “the FLAT”). Whereas the TENANT being
in need of residential accommodation for a temporary period approached the OWNER to permit
the TENANT to use the FLAT as a temporary residence for himself & his immediate family on a
monthly rental basis and, the OWNER has agreed to let out the FLAT subject to the following
terms and conditions.

NOW THIS TENANCY AGREEMENT WITNESSETH AS FOLLOWS:

1. The TENANT has deposited an amount of Rs. 1,25,000/ (Rupees one lakh and twenty five
thousand only) towards security deposit on 18/11/19 by online transfer(IMPS) to A/c no.
149201011002353 against transaction number: 114200734, as per previous agreement certificate
no. IN-KA42949495069705R

2. The TENANT shall pay a monthly rent of Rs 25500/-(Rupees Twenty five Thousand and
five hundred only) on or before 5th day of every English calendar month, by NEFT to the
account Mr Sudhir Menon. Such monthly rent is paid in advance for every month of stay.

3. In addition, the TENANT shall timely pay to the Maithri Opulence Apartment Owners’
Association, the applicable maintenance charges in respect of the FLAT not exceeding Rs 3200
(Rupees Three thousand two hundred only ) per month before 5 th day of every English calendar
Month in advance. Penalties if any, arising out of delayed payment of monthly maintenance
charge will be paid by the tenant as per applicable rules of the Maithri Opulence Apartment
Owners’ Association. Any such penalty shall not form a part of the upper limit of Rs 3200
mentioned above. For the entire period of agreement any maintenance/water & common area
repair/association charges not exceeding the aggregate value of INR 3200 multiplied by the
number of months of actual tenancy will be paid promptly within due timelines by the TENANT.

4. If the TENANT fails to pay the monthly rent or the charges as mentioned in clause 3 above,
for two consecutive months, the OWNER may, at his sole discretion terminate this Rental
Agreement forthwith. Upon such termination, the TENANT will be obliged to vacate the FLAT
within such time as the OWNER may allow. The TENANT will, however, continue to remain
liable for the rent & maintenance charges for the month in which the termination occurs.

5. Two Sets of Keys (all doors, wardrobes and drawers) will be given to the TENANT.

6. The TENANT agrees to use the FLAT solely for residential purposes for himself & his
immediate family only. Further, the TENANT agrees to ensure that no unlawful activities are
carried out by him or his family members staying in the mentioned FLAT or his visitors or his
service providers. Any action and damages arising out of any such unlawful activity will be
solely the responsibility of the TENANT and the OWNER will not be party to it in any way.
Such damages include any penalties levied by the association too.

7. Subject to payment of the security deposit as specified at clause 1 above, the term of this
agreement of rent shall commence from 20th November, 2020 and it will remain in force for a
period of 11 calendar months. At the end of this period, if the OWNER & TENANT mutually
agree to continue the rental, a fresh Agreement shall be signed by & between the OWNER &
TENANT for a further 11 months. However, such fresh agreement will be signed subject to the
rent for the future period being increased by minimum 5% over & above the rent for the
immediately preceding rental period.

8. During the term of this Agreement, the Security deposit will not accrue / earn any interest and
this amount will be refundable to TENANT by OWNER at the time of vacation of the FLAT by
the TENANT. The Security deposit will, however, be refunded after deduction of the following
(i) arrears of dues of the TENANT such as electricity Bill, maintenance charges, rents etc., (ii)
painting charges (subject to a maximum amount of half month rent) & charges for fixing any
damages that may occur to the FLAT during the rental period.

10. In addition to the above, the TENANT shall carry out, in a timely manner, any repairs
necessitated by normal wear and tear during his occupancy. This will include electrical fittings,
Fixed Furniture fittings and Plumbing. Regular servicing of the major electrical equipments like
air conditioner, kitchen chimney and geysers will be carried out by the TENANT.

11. At the end of the rental period, the TENANT shall handover vacant possession of the FLAT
to the OWNER in as good tenantable condition as it is / was when the TENANT took possession
thereof under this Agreement.

12. The said Flat is furnished with standard fixtures and fittings more particularly described in
Schedule II herein under written and the same has been inspected by the TENANT and admitted
to be in good order and condition. Permission is hereby given by the OWNER to the TENANT
to make reasonable use of the fixtures fittings. Any breakage or damage or improper use to the
said equipment will be charged to the TENANT.

13. During the period of this Agreement, the TENANT shall pay Electricity Charges to the
concerned authorities and keep the bills intact & make them available to the OWNER, upon
request, along with proof of payment.

14. The TENANT shall not sub-let or under let or part with the possession of the FLAT to any
third party without the express written consent of the owner.

15. The TENANT shall not carry out any structural or other modifications / changes to the FLAT
without the express written consent of the OWNER.

16. The OWNER has got every right to inspect the said FLAT after giving notice for which the
TENANT shall have no right to object.
17. Either party shall give 2(two) month’s prior notice of intention to terminate this rental
agreement.

SCHEDULE

The premises bearing  Flat No. 301, Maithri Opulence, 6 th A Main, G.M. Palya, Bangalore-
560075 consisting of three bed rooms, drawing room, dining hall, family sit-out, kitchen, three
bathrooms, 3 balconies and a private terrace along with the following amenities :

1. Built-in wardrobe with fixed mirror in all bedrooms along with fixed storage and study
table; One bedroom has overhead storage lofts

2. Built-in wall units with glass doors in Hall along with TV case and sitting furniture (not
sofa);

3. Bed in all the 3 bedrooms with mattress in 2 bedrooms including a Godrej AC in the
master bedroom.

4. Built-in Modular Kitchen and loft;

5. Electric chimney.

6. Ceiling fans in all bedrooms & one each in the hall, dining.

7. Water geysers in two bathroom with wall mounted fans

8. Bathtub in master bedroom.

9. Washing sink near kitchen and separate washing sink in each bathroom with mirror.

10. Exit to private terrace covered with Grill.

11. Curtain rods across all bedroom and dining.

12. A second gate (iron) for additional security at the main door.

The above premises also include one car parking spot bearing number 301 on the ground floor of
the apartment building and a common access two-wheeler parking.

In witness whereof this agreement of rent signed by parties, on the day, month and year above
mentioned.
