F.No.B3/1/KNL/97,- The Waqf Institution namely Dargah Hazrath Syed Shah Ishaq
Sanaullah Quadri situated at Roza Village, Kurnool Town & District is a registered Waqf
Institution and published in the A.P. Gazette, dt : 24-12-1963.

In the reference 1 st read above, the then Board has appointed Janab Syed Shah
Khaleelullah Khadri as a Mutawalli vide Board’s order P.No.A1/194/65 and published
in the A.P. Gazette No.34, Dt : 31-08-1978.

In the reference 6 th read above, after death of Janab Syed Shah Khaleelullah Khadri,
his sons 1) Janab Syed Taj Mohammed Quadri @ Anwar Basha Quadri and 2) Janab Syed
Jamalullah Quadri @ Dade Basha Quadri were submitted their representation for
appointment of Mutawallies to the subject Waqf Institution and the then Board has passed
resolution for appointment of 1) Janab Syed Taj Mohammed Quadri @ Anwar Basha
Quadri and 2) Janab Syed Jamalullah Quadri @ Dade Basha Quadri as Joint Mutawallies
to the subject Waqf Institution and issued Proceedings vide reference 5 th read above.

In the reference 6 th read above, a joint representation received from 1) Janab

Syed Taj Mohammed Quadri @ Anwar Basha Quadri and 2) Janab Syed Jamalullah
Quadri @ Dade Basha Quadri, joint Mutawallies of Dargah with a request to re-issue
proceedings with revised orders.

In view of the above circumstances, the matter was referred to the Legal Adviser,
APSWB who after examining the matter has given legal advice for re- issuance of
proceedings by removing word “JOINT” as hereditary by custom in favour of 1) Janab
Syed Taj Mohammed Quadri @ Anwar Basha Quadri and 2) Janab Syed
Jamalullah Quadri @ Dade Basha Quadri as Mutawallies to the subject Waqf Institution in
accordance with contemplation of Waqf Act.

Accordingly, 1) Janab Syed Taj Mohammed Quadri @ Anwar Basha Quadri and 2) Janab
Syed Jamalullah Quadri @ Dade Basha Quadri are hereby incorporated as Mutawallies U/Sec. 42
of the Waqf Act, 1995 to the Dargah Hazrath Syed Shah Ishaq Sanaullah Quadri, situated at
Roza Village, Kurnool Town & District.

The Mutawallies should discharge their legitimate duties strictly as determined in

Section 50 of Waqf Act, 1995 read with Rules 20 of A.P. Waqfs Rules, 2000 and should
follow the instructions issued by the Board for time to time. They should submit the Accounts
Budget income & Expenditure statement and pay Waqf Fund properly, failing which Section 61
and 64 of the Waqf Act, 1995 will be attracted. The respective duties are mentioned
hereunder.
a) To implement the orders issued by the Board from time to time.
b) To carry out the directions of the Board.
c) To allow Inspector Auditor Waqfs and any Officials of the Board regarding
property accounts, records, deeds and documents relating thereof.

d) To discharge all public duties.
e) To do any other Act which is Lawfully required to do be or under this
Act.
f) Shall render proper and correct accounts of the Institution and its attached
properties and shall not suppress any fact.
g) That the Mutawallies are restricted to grant lease of Waqf property
exceeding one year.
h) The Mutawallies should follow the Norms fixed in Section 56 of the
Waqf Act, 1995 while granting Lease of any agricultural land. He should
follow Lease Rules 2014 to put open auction through A.P. State Waqf
Board.
i) He will not entitled to expend the Monies of Waqf exceeding 10% of
the Net annual Income.

As per Sec.101 (2) of Waqf Act, 1995, “Every Mutawalli of a Waqf, every
member of managing committee whether constituted by the Board or under any deed of
Waqf, every Executive Officer and every person holding any office in a Waqf shall also be
deemed to be a public servant within the meaning of Sec. 21 of the Indian Penal Code”. As
such, for the illegal act if any, every member of the committee will be liable for penal action. The
Committee / Mutawallies shall also note that Sec.3 (ee) defined encroacher, sec. 52-A explain
rigorous punishment upto (2) years and Sec.61 speaks penalty and punishment upto (6) months
for the lapses / charges shown therein, hence should act carefully delinquency and maintain
account scrupulously.

The APSWB reserves its right to modify / cancel / alter / with hold the order at any time
without assigning any reasons thereof.
