CONDIZIONI GENERALI DI VENDITA - GARANZIA
GENERAL SALES AND WARRANTY TERMS
1. CONDIZIONI Dl VENDITA:
Gli ordini ricevuti e presentati per l’acquisto dei prodotti KTC S.R.L., comprendono
l’accettazione, senza riserve, di tutte le condizioni di fornitura e sono parte integrante
dell’accordo di vendita. Eventuali variazioni devono essere approvate da KTC S.R.L.,
per iscritto, tramite conferma di vendita. Questa verrà inviata soltanto su richiesta
dell’acquirente ed i cambiamenti saranno validi solamente per gli ordini a cui si riferiscono.
2. ORDINI:
Gli ordini saranno ricevuti da KTC S.R.L. sempre con la clausola “conforme ad approvazione
della società”. Le condizioni di fornitura descritte si intendono approvate dal cliente con
la trasmissione dell’ordine stesso. L’ordine del cliente viene considerato vincolante e non
può essere ridotto o annullato, a meno che il termine di consegna superi di due mesi il
termine stabilito per iscritto da KTC S.R.L.
In caso di discrepanza nell’ordine, fra la descrizione dell’articolo ed il codice, sarà data
priorità al codice. Gli ordini trasmessi dai nostri agenti, rappresentanti od incaricati dovranno
sempre essere approvati da KTC S.R.L. e saranno pertanto ritenuti vincolanti solamente
se confermati tramite invio di conferma d’ordine (su esplicita richiesta dell’acquirente).
3. TERMINI Dl CONSEGNA:
L’evasione dell’ordine è subordinata alla disponibilità di magazzino ed alla fattibilità di
produzione. Questo, tuttavia, non garantisce l’evasione totale dell’ordine in un’unica
spedizione. Di conseguenza KTC S.R.L. si riserva il diritto di spedire l’ordine effettuando più
di una spedizione.
La mancata consegna parziale o totale dell’ordine, non darà luogo ad alcun diritto di rivalsa
o di richiesta danni, ad alcun diritto di annullamento o di riduzione dell’ordine compreso
il rifiuto di ricezione della rimanenza dell’ordine, né tanto meno darà diritto al ritardo nel
pagamento da parte del cliente a KTC S.R.L. I termini di consegna comunicati sono da
ritenersi indicativi. KTC S.R.L. non risponde inoltre per ritardi causati da forza maggiore.
KTC S.R.L. si riserva il diritto di rifiutare annullamenti da parte del cliente per modelli non
a stock ordinati esplicitamente su richiesta del cliente stesso.
4. SPEDIZIONE:
La merce viene consegnata franco fabbrica e viaggia a rischio e pericolo del committente.
In caso di ritardo, avarie, urti, manomissioni o perdita durante il trasporto, il destinatario
dovrà rivolgersi esclusivamente ai vettori. KTC S.R.L. declina ogni responsabilità
verso il committente e verso il destinatario. Prima di prendere in consegna le merci si
raccomanda di controllare il peso e l’integrità del contenuto ed il numero di colli. In caso
di contestazione si ricorda di richiedere la riserva sul documento di trasporlo facendola
controfirmare con data ed ora dall’autista.
1. SALES TERMS:
The received and submitted orders for the purchase of KTC S.R.L. products, include the
acceptance of the relevant supply conditions unconditionally and are an integral part of the
sales agreement. Any possible change must be approved by KTC S.R.L. upon submission
of suitable written sale confirmation, which may only be sent upon purchaser’s request.
Changes will only be valid for the order they refer to.
2. ORDERS:
They shall be received by KTC S.R.L. always with the “subject to company approval”
clause. The conditions described must be considered approved by the customer with
the submission of the order. The customer’s order is binding and cannot be reduced or
cancelled unless the delivery time exceeds the deadline stated in writing by KTC S.R.L.
by two months.
For the submission of the order, in case of discrepancy between the item description and
the code, the latter will be given priority. The orders issued by our Agents, representatives
or operators are always subject to the approval of KTC S.R.L. They must be considered
binding only if they have been confirmed with the submission of the Order Confirmation
(upon purchaser’s specific request).
3. DELIVERY TERMS:
The issuing of the order is subject to stock availability and manufacturing capabilities.
These, however, do not guarantee the availability of the entire shipment. Therefore, KTC
S.R.L. reserves the right to dispatch the order in different deliveries.
A failed partial or total delivery of the order shall not generate any compensation or
indemnification right, any possible cancellation or reduction of the order or of its remaining
part as described above, or any delay in the customer’s payment to KTC S.R.L. The
communicated delivery terms shall be deemed as indicative. KTC S.R.L. cannot be held
responsible for delivery delays caused by force majeure. KTC S.R.L. cannot be held
responsible for delays caused by force majeure. KTC S.R.L. reserves the right to refuse
order cancellations of non-stock models expressly requested by the customer.
4. SHIPPING:
The goods are delivered Ex works and the shipping is at the purchaser’s risk. In case
of delay, damage, shock, alterations or loss during transportation, the addressee must
contact carriers only. KTC S.R.L. will not be held responsible towards the purchaser and/
or the addressee under any circumstance. Before taking possession of the goods, it is
advisable to check the weight and integrity of the product and the number of parcels.
In case of claim, please bear in mind to ask for the reserve clause on the transportation
documents; it must be signed by the driver complete with time and date.

5. IMBALLO:
KTC S.R.L. consegna i propri prodotti imballati in scatole che vengono fomite a titolo
gratuito. Eventuali ammanchi nel numero dei pezzi (anche confezioni sigillate) dovranno
essere segnalati entro 8 giorni dal ricevimento della merce con lettera raccomandata.
Trascorso detto limite la merce si terrà tacitamente accettata. Eventuali imballi in casse,
gabbie o simili, non rientranti quindi negli imballi standard, saranno addebitati al costo.
6. PREZZI:
Valgono i prezzi di listino (IVA esclusa) in vigore al momento dell’ordine. Il listino in vigore
annulla e sostituisce tutti i precedenti. I prezzi non comprendono l’installazione ed il
collaudo sul posto; l’eventuale intervento di assistenza tecnica sarà fatturato a parte. I
prezzi di listino si riferiscono a merce resa franco nostro stabilimento.
KTC S.R.L. si riserva la facoltà di variare il listino in ogni momento e senza alcun preavviso.
I pagamenti devono essere effettuati all’indirizzo della KTC S.R.L. nel modo indicato in
fattura. I pagamenti devono essere eseguiti puntualmente a seconda delle scadenze
stabilite anche nel caso di prodotti riscontrati difettosi, vedere punto 8.
7. PAGAMENTI:
In caso di mancato pagamento da parte del cliente alle scadenze concordate, KTC S.R.L si
riserva il diritto di modificare d’ufficio le condizioni di pagamento in pagamento anticipato. KTC
S.R.L , potrà sospendere le forniture, riattivandole a pagamento avvenuto.
Per ritardato pagamento rispetto alle condizioni d’ordine, verranno addebitati interessi nella
misura di 5 punti percentuali oltre il tasso ufficiale di sconto. KTC S.R.L. si riserva in ogni
momento la facoltà di variare le condizioni di pagamento.
8. RESTITUZIONE MERCE:
KTC S.R.L. non accetta resi di macchine, accessori, ricambi e gli oneri di trasporto
qualora l’errore non sia stato generato dalla stessa. In ogni caso non saranno accettati
resi non preventivamente autorizzati in forma scritta. Non saranno autorizzati resi di
merce fatturati da oltre 3 mesi dalla richiesta di reso.
9. CARATTERISTICHE DEI PRODOTTI:
I dati tecnici, le dimensioni e le caratteristiche riportate sui cataloghi potrebbero
subire variazioni senza preavviso. Eventuali modifiche apportate sulle macchine non
disimpegnano il cliente dalla fornitura, nè possono dar luogo a rivalse.
10. GARANZIA:
KTC S.R.L garantisce i suoi prodotti da difettosità di fabbricazione o progettazione per
un periodo di 24 mesi (eventuale estensione della garanzia KTC SMART 36/48/60 mesi,

KTC S.R.L. delivers its products in parcels or packaging which are free of charge. Possible
missing pieces (including sealed packages) must be reported within 8 days from the date
of receipt, with a Registered Letter. After such deadline, the goods will be considered

under standard packaging, will be charged.
6. PRICES:
The price list (excluding VAT) currently enforced at the time of the order applies. It
cancels and replaces any previous list/order. Prices do not include installation and on site
inspection; any possible technical assistance intervention will be charged and invoiced
separately. The prices included in this price list are ex our works.
KTC S.R.L. reserves the right to change the price list at any time without notice. Payments
must be made to the registered address of KTC S.R.L. following the instructions provided
in the invoice. Payments must be made within the deadlines provided, also in case of
faulty products. Refer to claims governed by point 8.
7. PAYMENTS:
In case the customer fails to pay within the agreed deadlines, KTC S.R.L. reserves the
right to change payment terms at its own discretion to advanced payment. KTC S.R.L. can
suspend all supplies, resuming them once the payment has been completed.
In case of late payment with respect to the order conditions, interests will be applied at a
5% higher rate than the target discount rate. KTC S.R.L. reserves the right to change the
payment conditions at any time.
8. RETURN POLICY:
KTC S.R.L. does not accept the return of machines, accessories or spare parts, as well as
any transport fee for errors not generated by KTC S.R.L. itself. In any case, returns that have
not been previously approved in writing will not be accepted. Returns of products that have
already been invoiced more than 3 months before the return claim, will not be authorised.
9. PRODUCT FEATURES:
Technical data, size, and features mentioned in the catalogues can be changed without prior
notice. Any possible change to the machine does not free the customer from the supply and
cannot generate any kind of claim.
10. WARRANTY:
KTC S.R.L. guarantees its products from manufacturing or design defects for a period
of 24 months (any warranty extension SMART 36/48/60 months to authorized dealer will

da parte dei clienti autorizzati, dovrà essere stipulata a parte al momento dell’acquisto)
dalla data di messa in servizio che deve essere comunicata a KTC S.R.L, compilando
l’apposito modulo presente all’interno della documentazione tecnica in dotazione alla
macchina. Non ricevendo nessuna comunicazione, la garanzia sarà riconosciuta per 12
mesi facendo riferimento alla data di spedizione riportata sulla fattura di vendita KTC
S.R.L. Vengono escluse dalla garanzia i componenti, che per loro impiego specifico sono
soggetti ad usura. Gli interventi in garanzia possono essere effettuati esclusivamente
da KTC SR.L. oppure da personale autorizzato da KTC SR.L. La spedizione di qualsiasi
prodotto reso a KTC S.R.L, per interventi in garanzia, dovrà essere preventivamente
autorizzato in forma scritta da KTC S.R.L, la quale deciderà a suo giudizio insindacabile se
autorizzare o avvalersi dell’intervento di un proprio Centro Assistenza Tecnica Autorizzato.
In entrambi i casi, la spedizione a KTC S.R.L dovrà avvenire in porto franco con l’addebito
delle spese di spedizione in fattura. La riparazione o la sostituzione in garanzia comprende
la sostituzione gratuita dei componenti della macchina , riconosciuti difettosi. La garanzia
decade per danni provocati da incuria, da un uso ed installazione errati, o non conformi
alle avvertenze riportate nel “libretto di uso e manutenzione”, nel caso di modifiche o
riparazioni effettuate con ricambi non originali KTC S.R.L o da personale non autorizzato
da KTC S.R.L.. Gli elementi difettosi sostituiti in garanzia, verranno ritirati dal centro
assistenza autorizzato. Sono esclusi dalla garanzia qualsiasi riparazione o risarcimento
per danni avvenuti durante il trasporto (in andata o ritorno dal Centro Assistenza Tecnica
Autorizzato). Viene escluso qualsiasi tipo di risarcimento per danni causati a persone
o cose, derivanti da un mancato e inadeguato uso del modello acquistato e dal fermo
macchina (il cliente deve cautelarsi per questa evenienza). L’assistenza in garanzia viene
garantita solamente all’acquirente in regola con le norme contrattuali ed amministrative
che presenti la specifica documentazione attestante il periodo di acquisto. Questa è
l’unica garanzia validamente riconosciuta da KTC S.R.L..
Per qualsiasi controversia sarà esclusivamente competente il Foro di Vicenza
11. INFORMATIVA Al SENSI DELL’ART. 13 DEL D.LGS. 30 GIUGNO 2003, N. 196
CODICE IN MATERIA DI PROTEZIONE DEI DATI PERSONALI
I dati personali forniti dal cliente saranno trattati dal titolare TC S.R.L, con sede Via A.
Da Schio, 4/A-B Creazzo (VI) Italia, di seguito “KTC” con strumenti automatizzati e non,
nel rispetto di quanto previsto dal D.Lgs, 30 giugno 2003, n. 196 - Codice in materia di
protezione dei dati personali, esclusivamente con i seguenti fini: per dare esecuzione al
presente contratto ed adempiere a tutte le relative prestazioni ed obbligazioni, ivi comprese
le prestazioni di garanzia, e per svolgere analisi e ricerche statistiche in norma anonima.
A tali esclusivi fini i suoi dati potranno essere comunicati ad operatori contrattualmente
legati a KTC quali (spedizionieri, corrieri, istituti bancari e creditizi) e alle società ed
operatori appartenenti alla rete distributiva e di assistenza tecnica KTC (quali filiali,
have to be purchased) from the date of first commissioning. To inform K.T.C. S.R.L. of this
date, fill in and send the special form supplied with the machine technical documentation.
If no communication is received, the warranty shall be valid for 12 months starting from
the date on which the unit was shipped, i.e. the date indicated on the KTC S.R.L. invoice.
The warranty does not cover parts subject to wear. Repair works covered under warranty
can only be performed by KTC S.R.L. or aKTC S.R.L. authorized staff. Shipment of any
product being returned for service under warranty must be authorized in advance and in
writing by KTC S.R.L. Moreover, KTC S.R.L., in its unquestionable judgement, can decide
whether to authorize such shipment or have one of its Authorized Service Centres do the
work. In both cases, shipment to KTC S.R.L. must be made carriage paid with shipping
costs charged in the invoice. Repairs or replacements covered by warranty include free
replacement of parts of the machine that are recognized as defective. The warranty does
not cover damage caused by negligence, incorrect use or installation or non compliance
with the warnings indicated in the ‘Operation and Maintenance Manual’. Moreover, the
warranty becomes void if modifications or repairs are made using non original KTC S.R.L.
spare parts or performed by personnel not authorized to do so by KTC S.R.L. Defective
parts replaced under warranty will be retained by the Authorized Service Centre. The
warranty does not cover repairs or reimbursement for damage occurred during transport
(to or from the Authorized Service Centre).
The warranty does not cover any type of reimbursement for injuries or damages to people
or things deriving from
improper use of the purchased model or due to machine down time (the customer must
take steps to prevent this). Service covered by warranty is guaranteed only to purchasers
who have met their contractual and administrative obligations and who are able to show
the documentation certifying the purchase period. This is the only warranty lawfully
acknowledged by KTC S.R.L.
The Court of Vicenza is the exclusive place of jurisdiction for any dispute that may come.
11. NOTICE PURSUANT TO ART. 13 OF ITALIAN LEGISLATIVE DECREE NO. 196 OF
30TH JUNE 2003 ON PERSONAL DATA PROTECTION
Personal data provided by the customer will be processed by the controller of KTC S.R.L., with
head office in Via A. Da Schio, 4/A-B Creazzo (VI) Italy, hereinafter referred to as “KTC”, with
automated or non-automated tools, in accordance with the provisions of Italian Legislative
Decree no. 196 of 30th June 2003 on Personal Data Protection, exclusively for the following
purposes: Fulfilment of this contract and of all the performances and obligations herein,
including guarantees and the carrying out of anonymous analysis and statistic research. Only
for these purposes can your data be communicated to KTC’s contractors (such as freight
forwarders, carriers, banks and credit institutions) and to companies and operators included in
KTC’s distribution and technical support network (such as subsidiary companies, distributors,

importatori, distributori, concessionari rivenditori, installatori, riparatori), eventualmente
anche eventuali sede in paesi non appartenenti all’Unione Europea, e saranno portati a
conoscenza dei Responsabili (designati) e degli Incaricati del trattamento nominati dal
Titolare KTC e dai suddetti soggetti. I dati personali non saranno diffusi.
II conferimento dei dati a tali fini è facoltativo, cioè non discende da un obbligo normativo,
ma strettamente necessario per poter concludere e dare esecuzione al contratto.
Nella sua qualità di interessato il cliente gode dei diritti di cui all’art. 7 del Codice privacy,
di cui si riporta di seguito il testo:1. L’interessato ha diritto di ottenere la conferma
dell’esistenza o meno di dati personali che lo riguardano, anche se non ancora registrati,
e la loro comunicazione in forma intelligibile. 2. L’interessato ha diritto di ottenere
l’indicazione: a) dell’origine dei dati personali; b) delle finalità e modalità del trattamento;
c) della logica applicata in caso di trattamento effettuato con l’ausilio di strumenti
elettronici; d) degli estremi identificativi del titolare, dei responsabili e del rappresentante
designato ai sensi dell’articolo 5, comma 2; e) dei soggetti delle categorie di soggetti ai
quali i dati personali possono essere comunicati o che possono venirne a conoscenza in
qualità di rappresentante designato nel territori dello Stato, di responsabili o incaricali. 3.
L’interessato ha diritto di ottenere: a) l’aggiornamento e la rettificazione ovvero, quando vi
ha interesse, l’integrazione dei dati; b) la cancellazione, la trasformazione in forma anonima

Tutti i compressori KTC S.R.L. sono corrispondenti alle direttive europee 98/37/CE
Machinery Directive 2004/108/CE EMC Directive e 2006/95/CI Low Tension Directive,
97/23/CEE PED Directive.
I serbatoi del presente listino sono corrispondenti alle normative CE 87/404 90/488- 93/68
e CE 97/23.

the entities or categories of entity to whom or which the personal data may be communicated

3. A data subject shall have the right to obtain:
a) updating, rectification or, where interested therein, integration of the data; b) erasure,
anonymization or blocking of data that have been processed unlawfully, including data
whose retention is unnecessary for the purposes for which they have been collected or
subsequently processed; c) certification to the effect that the operations as per letters a)
and b) have been notified, as also related to their contents, to the entities to whom or which
the data were communicated or disseminated, unless this requirement proves impossible or
involves a manifestly disproportionate effort compared with the right that is to be protected.
4. A data subject shall have the right to object, in whole or in part, a) on legitimate grounds,
to the processing of personal data concerning him/her, even though they are relevant to the
purpose of the collection; b) to the processing of personal data concerning him/her, where
it is carried out for the purpose of sending advertising materials or direct selling or else for
the performance of market or commercial communication surveys.

KTC S.R.L garantisce i suoi prodotti da difettosità di fabbricazione o progettazione per un periodo di 24 mesi (eventuale estensione della garan-
zia KTC SMART 36/48/60 mesi dovrà essere stipulata a parte al momento dell’acquisto) dalla data di messa in servizio che deve essere comuni-
cata a KTC S.R.L, compilando l’apposito modulo presente all’interno della documentazione tecnica in dotazione alla macchina. Non ricevendo
nessuna comunicazione, la garanzia sarà riconosciuta per 12 mesi facendo riferimento alla data di spedizione riportata sulla fattura di vendita
KTC S.R.L. Vengono escluse dalla garanzia i componenti, che per loro impiego specifico sono soggetti ad usura. Gli interventi in garanzia
possono essere effettuati esclusivamente da KTC SR.L. oppure da personale autorizzato da KTC SR.L. La spedizione di qualsiasi prodotto reso
a KTC S.R.L, per interventi in garanzia, dovrà essere preventivamente autorizzato in forma scritta da KTC S.R.L, la quale deciderà a suo
giudizio insindacabile se autorizzare o avvalersi dell’intervento di un proprio Centro Assistenza Tecnica Autorizzato. In entrambi i casi, la spedi-
zione a KTC S.R.L dovrà avvenire in porto franco con l’addebito delle spese di spedizione in fattura. La riparazione o la sostituzione in garanzia
comprende la sostituzione gratuita dei componenti della macchina, riconosciuti difettosi. La garanzia decade per danni provocati da incuria, da
un uso ed installazione errati, o non conformi alle avvertenze riportate nel “libretto di uso e manutenzione”; nel caso di modifiche o riparazioni
effettuate con ricambi non originali KTC S.R.L o da personale non autorizzato da KTC S.R.L. Gli elementi difettosi sostituiti in garanzia, vengono
ritirati dal centro assistenza autorizzato. Sono esclusi dalla garanzia qualsiasi riparazione o risarcimento per danni avvenuti durante il trasporto
(in andata o ritorno dal Centro Assistenza Tecnica Autorizzato). Viene escluso qualsiasi tipo di risarcimento per danni causati a persone o cose,
derivanti da un mancato e inadeguato uso del modello acquistato e dal fermo macchina (il cliente deve cautelarsi per questa evenienza). L’assi-
stenza in garanzia viene garantita solamente all’acquirente in regola con le norme contrattuali ed amministrative che presenti la specifica docu-
mentazione attestante il periodo di acquisto. Questa è l’unica garanzia validamente riconosciuta da KTC S.R.L.
Per qualsiasi controversia sarà esclusivamente competente il Foro dl Vicenza
KTC S.R.L. guarantees its products from manufacturing or design defects for a period of 24 months (any warranty extension SMART 36/48/60
will have to be purchased) from the date of first commissioning. To inform K.T.C. S.R.L. of this date, fill in and send the special form supplied
with the machine technical documentation. If no communication is received, the warranty shall be valid for 12 months starting from the date on
which the unit was shipped, i.e. the date indicated on the KTC S.R.L. invoice. The warranty does not cover parts subject to wear. Repair works
covered under warranty can only be performed by KTC S.R.L. or a KTC S.R.L. authorized staff. Shipment of any product being returned for
service under warranty must be authorized in advance and in writing by KTC S.R.L. Moreover, KTC S.R.L., in its unquestionable judgement, can
decide whether to authorize such shipment or have one of its Authorized Service Centres do the work. In both cases, shipment to KTC S.R.L.
must be made carriage paid with shipping costs charged in the invoice. Repairs or replacements covered by warranty include free replacement
of parts of the machine that are recognized as defective. The warranty does not cover damage caused by negligence, incorrect use or installa-
tion or non compliance with the warnings indicated in the ‘Operation and Maintenance Manual’. Moreover, the warranty becomes void if modifi-
cations or repairs are made using non original KTC S.R.L. spare parts or performed by personnel not authorized to do so by KTC S.R.L. Defec-
tive parts replaced under warranty are retained by the Authorized Service Centre. The warranty does not cover repairs or reimbursement for
damage occurred during transport (to or from the Authorized Service Centre).
The warranty does not cover any type of reimbursement for injuries or damages to people or things deriving from
improper use of the purchased model or due to machine down time (the customer must take steps to prevent this). Service covered by warranty
is guaranteed only to purchasers who have met their contractual and administrative obligations and who are able to show the documentation
certifying the purchase period. This is the only warranty lawfully acknowledged by KTC S.R.L.
The Court of Vicenza is the exclusive place of jurisdiction for any dispute that may come.
