FOREWARD
The Embu Public Service Board had another eventful year ending 31st December, 2021. It
has remained focused and committed to discharging its mandate in the management of the
Human Resource component of the Embu County Government.
During the period under review, the board has been able to recruit, promote, confirm and
redesignate staff in the County Public Service.
I take this opportunity to thank the Executive for its support during this period. I also thank
my Board members and the acting Secretary/CEO of the Board and the Secretariat for their
dedicated support in discharging our mandate.

EXECUTIVE SUMMARY
The report has been prepared in fulfilment of Arcticles 10 and 232 of the Constitution of
Kenya. This is the annual report covering the period January to December 2021. The Board
has continued to work hard with a positive drive to fulfill its mandate in management of
human capital in the county.
The Board has been very keen and committed to quality, effective and efficient service
delivery, maintained good relations with all its customers, stakeholders and the public at
large while discharging its key responsibilities.These include but not limited to the
following: recruitment and selection, promotion of staff, re-designation, inter - county
transfers, enforcement of policies and regulations,training and development and discipline
among others.
I wish to take this opportunity to appreciate the cordial working relationship and support
given to the Public Service Board of Embu by the Executive and the County Assembly.
I would wish to thank the Board members together with the secretariat staff for their
continued support and determination that has seen the success of service delivery to the
public.

PART 1
1.0: INTRODUCTION
1.1: MANDATE OF THE BOARD
The County Public Service Board (CPSB) is established under County Government Act of
2012, Section 57 to act on behalf of the County Public service established under Article 235
(1) of the constitution1. The CPSB as stipulated by Section 57 (a) shall be a body corporate
with perpetual succession and a seal; and (b) capable of suing and being sued in its corporate
name.
The functions and powers of the County Public Service Board as stipulated in Section 59 are;
(1) Shall be on behalf of the County Government to:

(a) Establish and abolish offices in the county public service;
(b) Appoint persons to hold or act in offices of the county public service including in
the Boards of cities and urban areas within the county and to confirm
appointments;
(c) Exercise disciplinary control over, and remove, persons holding or acting in
those offices as provided for under this Part;
(d) Prepare regular reports for submission to the county assembly on the execution
of the functions of the Board;
(e) Promote in the county public service the values and principles referred to in
Articles 10 and 232;
(f) Evaluate and report to the county assembly on the extent to which the values and
principles referred to in Articles 10 and 232 are complied with in the county
public service;
(g) Facilitate the development of coherent, integrated human resource planning and
budgeting for personnel emoluments in counties;
(h) Advise the county government on human resource management and
development;
(i) Advise county government on implementation and monitoring of the national
performance management system in counties;

(j) Make recommendations to the Salaries and Remuneration Commission, on
behalf of the county government, on the remuneration, pensions and gratuities
for county public service employees.
(2) In appointing a person as a secretary to a board of a city or an urban area under
subsection (1)(a), the County Public Service Board shall ensure that such person is a
certified public secretary of good professional standing.
(3) The reports under subsection (1)(d) shall contain the details of persons appointed
including gender, persons with disabilities, persons from the minority and
marginalized communities.
(4) In the performance of its functions under subsection (1)(e), the County Public Service
Board shall have powers to—
(a) Inform and educate county public officers and the public about the values and
principles;
(b) Recommend to the county government effective measures to promote the values
and principles;
(c) Assist county government in the formulation and implementation of programmes
intended to inculcate in public officers the duty to uphold the values and
principles;
(d) Advise the County Government on their obligations under international treaties
and conventions on good governance in the county public service;
(e) Visit any county public office or body with a view to assessing and inspecting
the status of compliance with the values and principles;
(f) Investigate, on its own initiative or upon a complaint made by any person or
group of persons, the violation of any values and principles;
(g) Recommend to the relevant lawful authority, any necessary action in view of the
violation of the values and principles by any person or public body;
(h) Cooperate with other institutions working in the field of good governance in the
public service; and
(i) Perform any other functions as the Board considers necessary for the promotion
of the values and principles.
(j) The CPSB shall Present a report under subsection (1)(f) to the county Assembly
detailing all the steps taken and decisions made by the board; specific
recommendations that require to be implemented in the promotion and protection
of the values and principles; specific decisions on particulars of persons or public

body who have violated the values and principles, including action taken or
recommended against them; include any impediment in the promotion of the
values and principles; and include the programmes the board is undertaking or
has planned to undertake in the medium term towards the promotion of the
values and principles.
The public Service Board is also vested with the mandate to establish public offices within the
County Public Service in accordance with the criteria stipulated in Section 60 (1) if it is
satisfied that—
(a) The establishment of the public office shall serve public interest in line with the core
functions of the county government;
(b) There exists no other public office in the county public service discharging or capable
of discharging the duties for which the county is requested to establish another office;
(c) Upon the establishment of the office, the office shall be vacant to be filled
competitively and transparently in accordance with the prescribed appointment or
promotion procedures;
(d) The establishment of the office including its level of grading, qualification and
remuneration shall not disadvantage similar offices in the county public service or
occasion unfair competition for staff among county public bodies;
(e) The establishment of the office shall not confer unfair advantage to a group of or
individual serving public officers;
(f) The county government entity has prudently utilized offices previously provided in its
establishment; and
(g) Funding for the office to be established is duly provided for.
Section 60 (2) further stipulates that in determining the provision of funding under subsection
(1)(g), the County Public Service Board shall take due regard to the need to limit the
component of personnel emoluments to a level that does not adversely affect other budgetary
provisions in the recurrent vote.
As stipulated in Section 60 (3), a written request for establishment of an office complying

with the conditions in this section shall be submitted to the Board by the concerned head of
department. Consequently in Section 60 (4), in deciding whether or not to establish a public
office, the County Public Service Board shall take into account—
(a) The overall workload in the county public service concerned; and

(b) The suitability of that department but not any other to be the domicile of the public
office to be established.
1.2 COMPOSITION OF THE BOARD

The CPSB shall be composed of the Chairperson, not less than three and not more than five
members and a Certified Public Secretary of good standing all appointed by the Governor
persuant to County Government Act 2012, Section 58 (1).
The Embu County Public Service Board currently has a chairman, five board members and
the Secretary/CEO. (ANNEX 1 - Board Members)
1.3 REPORTING REQUIREMENT OF THE BOARD

In Section 59 subsection (1)(f), the Board2 is required by the law to evaluate and report to the
County Assembly on the extent to which the values and principles referred to in Articles 10
and 232 are complied with in the county public service. Pursuant to this the Board present this
report every December to the County Assembly as stipulated by Section 59 subsection (5).
This report by the County Public Service Board shall:-
(a) Be delivered each December to the County Assembly.
(b) Include all the steps taken and decisions made by the board;
(c) Include specific recommendations that require to be implemented in the promotion
and protection of the values and principles;
(d) Include specific decisions on particulars of persons or public body who have
violated the values and principles, including action taken or recommended against
them;
(e) Include any impediment in the promotion of the values and principles; and
(f) Include the programmes the board is undertaking or has planned to undertake in
the medium term towards the promotion of the values and principles.
The Board shall then proceed to publish this report in the county Gazette not later than seven
days after the report has been delivered to the county assembly as a requirement in Section 59
(6).

1.4 VISION AND MISSION OF THE BOARD3
Vision: To be the leading county in Public Service Management.
Mission: To promote an effective and efficient service delivery

1.5: VALUES AND PRINCIPLES

The County Public Service Board is governed by the established values and principles. The
constitution, Article 10(2) stipulates the national values and principles of governance, which
includes;
(a) Patriotism, national unity, sharing and devolution of power, the rule of law,
democracy and participation of the people;
(b) Human dignity, equity, social justice, inclusiveness, equality, human rights, non-
discrimination and protection of the marginalised;
(c) Good governance, integrity, transparency and accountability; and
(d) Sustainable development.
It is in the light of these provisions that the CPSB observes the Values and principles of
County public service stipulated in Article 232 (1), which include;
(a) High standards of professional ethics;
(b) Efficient, effective and economic use of resources;
(c) Responsive, prompt, effective, impartial and equitable provision of services;
(d) Involvement of the people in the process of policy making;
(e) Accountability for administrative acts;
(f) Transparency and provision to the public of timely, accurate information;
(g) Subject to paragraphs (h) and (i), fair competition and merit as the basis of
appointments and promotions;
(h) Representation of Kenya’s diverse communities; and
(i) Affording adequate and equal opportunities for appointment, training and
advancement, at all levels of the public service, of––
(i) Men and women;
(i) The members of all ethnic groups; and
(ii) Persons with disabilities.

2.0: ACHIEVEMENTS
2.1: RECRUITMENT AND SELECTION
During the reporting period (1st January – 31st December, 2021), the Board undertook
recruitment of a number of officers to fill vacant positions various departments in fulfilling its
mandate as per the constitutional provisions.
Pursuant to Section 66 of the County Government Act 2012, the advertisements of positions
were widely publicised as the County Public Service Board invited applications through
advertisement in the National Dailies and the county website so as to reach as wide a
population of potential applicants as possible. Subject to Section 67, the appointments were
done in writing and the consequently subject to Section 68; the Board maintained the records
of applicants, which are available for inspection by any person.
As stipulated in Section 65 (1), in selecting candidates for appointment, the County Public
Service Board considered the standards, values and principles set out in Articles 10, 27(4),
56(c) and Article 232(1) of the Constitution. Article 10 stipulates the National values and
principles. Article 27 (4) stipulates that the State shall not discriminate directly or indirectly
against any person on any ground, including race, sex, pregnancy, marital status, health status,
ethnic or social origin, colour, age, disability, religion, conscience, belief, culture, dress,
language or birth. Article 56(c) of the Constitution of Kenya stipulates that the State shall put
in place affirmative action programmes designed to ensure that minorities and marginalised
groups are provided special opportunities for access to employment. Article 232(1) stipulates
the values and principles of public service.
The CPSB observed the values and principles of County public service stipulated in Article
232 (1), in recruitment and selection. The process of the recruitment and selection was in
conformity with the requirements stipulated in the Constitution. The board considered
representation of all the twenty (20) wards in the four sub counties of the county. Regional
representation as a requirement of section 65 of the County Government Act, 2012 which
requires the board to ensure that at least thirty percent of the vacant posts at entry level are
filled by candidates who are not from the dominant ethnic community in the county. Gender
parity was also considered by the board in its recruitment.

2.1.1: RECRUITMENT IN VARIOUS DEPARTMENTS
Nine (9) officers were recruited for the department of Education to fill vacant positions of
ECDE teachers and Vocational Training instructors.
Recruitment was also done in the departments of Embu County Revenue Authority, ECRA,
where seventy eight officers were employed to fill positions of Deputy Director Revenue
services, Senior Accountant, Accountant I, Administrative Officers and Revenue Officers. In
Lands, Physical Planning and Urban Development four officers were recruited including one
(1) person living with a disability was recruited to fill a vacant position in the Embu
Municipal Board. In the Public Service, Administration and Devolution department one (1)
officer was employed to fill a vacant position of Ward Administrator for Nginda ward. One
(1) Medical Specialist(Pathologist) was recruited for the Health department. The CEO for
Embu Level Five Hospital was also recruited during this period. Particulars of the officers
recruited are as shown in annexes 2 to 6.
2.2: REDESIGNATION, PROMOTION, CONFIRMATION, RENEWAL

OF CONTRACT, INTERCOUNTY TRANSFER, CHANGE OF TERMS
OF SERVICE AND RETIREMENT
2.2.1: REDESIGNATIONS.
The board did redesignation of five (5) officers during this period ending 31st December 2021.
Details of the redesignated officers are as shown in annex 7.
2.2.2: CONFIRMATIONS IN APPOINTMENT.

During the year the board confirmed thirty two (32) officers in various positions in to
permanent and pensionable terms of service with effect from the dates they were placed on
probation. A list of these officers is as shown in annex 9.
2.2.3: RENEWAL OF CONTRACT

The contracts for two hundred and ninety eight (298) officers were renewed during this
period. Details of these officers are as shown in annex 10.
2.2.4: INTER COUNTY TRANSFER

During the reporting period three (3) officers transfered their services from Embu county to
Kakamega, Meru and Nairobi City counties respectively. Details of these officers are as
shown in annex 11.

2.2.5: CHANGE OF TERMS OF SERVICE
One officer had her terms of service changed from contractual to permanent and pensionable
during the year.
2.2.6: RETIREMENT UNDER 50-YEAR RULE

One officer was allowed to retire under the fifty-year rule. The officer had attained the age of
fifty eight (58) years by the time she was allowed to retire
2.3: BOARD’S VEHICLE

The board was able to acquire an official vehicle, an Executive Microbus(Nissan), to ease the
movement during its operations.

3.0: IMPLEMENTATION OF OPERATIONS

3.1: TRAINING AND DEVELOPMENT
The board facilitated its members and secretariat to attend the following forums, meetings,
trainings and workshops.
3.1.1: INAUGURAL COUNTY PUBLIC SERVICE BOARDS’

GOVERNANCE CONVENTION.
So as to strengthen the operations of Public Service Boards, all the 47 county public service
boards formed a National Consultative Forum, which has elected members representing
various regions in the republic. The forum organized induction courses and other training to
equip its members with wide scope of knowledge in matters relating to different legislations
affecting the boards.
The forum in conjuction with the Institute of Certified Secretaries of Kenya organized the
inaugural County Public Service Boards’governance convention for five days in Naivasha
from 21st to 25th June 2020.
This convention sensitized participants on various areas of focus which included:
 Proposed reforms in public service boards;
 New public management and innovative public service delivery;
 Transformative issues that can lead to efficiency of county public service boards;
 Performance management and productivity in public service;
 Dispute resolutions;
 Public procurement;
 Public participation;
 Public finance management act, under printing acts and regulations; and
 Budget making process.

The board has faced many challenges from time to time some of which are as shown below:

5.1: DEVELOPING OF BOARD’S STRATEGIC PLAN
The board is in the process of finalizing the review and evaluation of the previous strategic
plan and commence the preparation of the second strategic plan.
5.2: CUSTOMIZING OF HR POLICIES AND SCHEMES OF SERVICE

The board in liaison with the Public Service and Administration department are in the
perocess of customizing/preparing schemes of service for all cadres in the county public
service.
5.3: CAPACITY BUILDING FOR THE BOARD

The board conducted capacity building programs for its members and the secretariat for
better service delivery.
5.4: PREPARATION OF EMBU COUNTY STAFFING PLAN

This is an key undertaking which the board is im[lementing starting March , 2022 subject to
availability of funds.
