I. 사법권
A. 출처 및 범위
1. 출처—제 3 조
미국 헌법 제 3 조 제 1 항은 "미국의 사법권은 한 대법원과 의회가 때때로 또는 존속하고 확
립할 수 있는 하급법원에 귀속된다"고 규정하고 있다.
연방법원은 일반적으로 제 3 조에 기술된 헌법상의 권한에 따라 미국 의회에 의해 만들어
진다. 위에서 언급한 바와 같이, 제 3 조는 대법원의 설립을 요구하고 있으며 의회가 다른
연방법원을 만들고 관할권에 제한을 두는 것을 허용하고 있다. 제 1 조에 부여된 권한으로
많은 전문법원이 만들어지지만 의회, 대통령, 정치적 절차로부터 독립되어 있기 때문에 제
3 조 법원에 더 큰 권한이 부여된다.
2. 범위
제 3 조 제 2 항은 연방법원의 관할권을 사건이나 논쟁에 한정하는 것으로 규정하고 있다.
i) 미국의 헌법, 법률 및 조약에 따라 발생한다.
ii) 외국의 대사, 공공장관 및 영사에 영향을 미치는 행위
iii) 해군 및 해군 관할권 관련
iv) 미국이 당사자인 경우
v) 두 개 이상의 주 또는 다른 주의 주와 시민 사이의 관계
vi) 서로 다른 주의 시민 또는 동일한 주의 시민 간에 주장
서로 다른 주의 보조금을 받는 토지, 또는
vi) 국가, 또는 그 시민, 외국 국가, 시민 또는 대상 간의 관계
a. 의회 및 행정 조치의 사법 검토

3. Limitations—Eleventh Amendment
The Eleventh Amendment is a jurisdictional bar that prohibits the citizens of one state
from suing another state in federal court. It immunizes the state from suits in federal court
for money damages or equitable relief when the state is a defendant in an action brought
by a citizen of another state or a foreign country. In addition, the Eleventh Amendment
bars suits in federal court against state officials for violating state law. Pennhurst State
School & Hospital z Halderman, 465 U.S.89 (1984).
The Supreme Court has expanded the amendment's reach to also preclude citizens from
suing their own state in federal court. Hans z Louisiana, 134 U.S. 1 (1890).
Note that the Supreme Court has also barred federal-law actions brought against a state
government without the state's consent in its own courts as a violation of sovereign
immunity. Alden z Maine, 527 U.S. 706 (1999). Similarly, states retain their sovereign
immunity from private suits brought in the courts of other states. Franchise Tax Bd. Of
Cal. v. Hyatt, 2019 U.S. LEXIS 3399 (2019) (overruling Nevada v. Hall, 440 U.S. 410
(1979)).
a. Exceptions
There are, however, a few notable exceptions to the application of the Eleventh
Amendment.
1) Consent
A state may consent to suit by waiving its Eleventh Amendment protection.
Lapides z Board of Regents of Univ. System of Ga., 535 U.S. 613 (2002) (state
removal of case to federal court constituted a waiver).
2) Injunctive relief
When a state official, rather than the state itself, is named as the defendant in an
action brought in federal court, the state official may be enjoined from enforcing a
state law that violates federal law or may be compelled to act in accord with
federal law despite state law to the contrary. Ex parte Young, 209 U.S. 123
(1908), Edelman z Jordan, 415 U.S. 651 (1974).
Note: A state also cannot invoke its sovereign immunity to prevent a lawsuit by a
state agency seeking to enforce a federal right against a state official. Virginia
Office for Prot. & Advocacy v. Stewart, 563 U.S. 247 (2011).
3) Damages to be paid by an individual
An action for damages against a state officer is not prohibited, as long as the
officer himself (rather than the state treasury) will have to pay. Such is the case
when an officer acts outside the law; the action is against the officer as an
individual and not in his representative capacity.
4) Prospective damages
As long as the effect of a lawsuit is not to impose retroactive damages on a state
officer to be paid from the state treasury, a federal court may hear an action
against a state officer, even if the action will force a state to pay money to comply
with a court order.
5) Congressional authorization
Congress may abrogate state immunity from liability if it is clearly acting to
enforce rights created by the remedial provisions of the Thirteenth, Fourteenth,
and Fifteenth Amendments (i.e., the Civil War Amendments), and

a. 예외

5) 의회 허가
의회는 13, 14, 15 개 수정 조항(즉, 남북 전쟁 수정)의 수정 조항으로 인해 만들어진
권리를 시행하기 위해 명확하게 행동하는 경우 국가의 책임 면제를 폐지할 수 있다.

may not abrogate state immunity by exercising its powers under Article I (e.g.,
Commerce Clause powers). Seminole Tribe of Florida v. Florida, 517 U.S. 44
(1996).
b. Not barred by the Eleventh Amendment
1) Actions against local governments
The Eleventh Amendment applies only to states and state agencies. Local
governments (e.g., counties, cities) are not immune from suit.
2) Actions by the United States government or other state governments not
barred
The Eleventh Amendment has no application when the plaintiff is the United
States or another state.
3) Bankruptcy proceedings
The Eleventh Amendment does not bar the actions of a Bankruptcy Court that
impacts state finances. Central Cmty. Coll. v. Katz, 546 U.S. 356 (2006).
B. 대법원 관할권

2. 항소

a. 수단
대법원 상고심 관할권 설정에는 소추(재량심사)와 직접 상고심 두 가지 방법이 있다.
1) Certiorari
거의 모든 사건들이 현재 대법원에 재량심판, 즉, 재량심사에 대한 청원을 통해 제
출되고 있다. 법원은 최소한 4 명의 재판관이 이 사건에 승복하기 위해 투표한 경우
에만 사법권을 가진다.
2) 직접항소
대법원은 직접 항소를 통해 소수의 사건만을 심리해야 하는데, 이는 특별 3 심 지방
법원 위원회가 내린 명령적 구제 결정에서 나온 사건이다. 28 U.S.C. § 1253. 이러
한 패널(및 항소)이 한때는 상당히 흔했지만, 현재는 몇 가지 특정 법령(예: 투표권
법)에 따라 제기된 사례에 국한됩니다.
3. 한계
의회는 대법원의 항소심 재판권을 법으로 제한할 수 있는 어느 정도의 권한을 가지

power, because to deny all Supreme Court jurisdiction over certain types of cases would
undermine the constitutional system of checks and balances. Boumediene v. Bush, 553
U.S. 723 (2008) (Congress and President cannot remove Supreme Court's authority to
say "what the law is" (quoting Marbury v. Madison, 5 U.S. 137 (1803))).
Note that most federal cases are filed in district court and appealed, if at all, to the courts
of appeals. The jurisdiction of the federal courts is set, within the framework of Article III,
by statute. For example, Congress requires the amount in controversy necessary for
federal jurisdiction over a case between citizens of different states to exceed $75,000. 28
U.S.C. § 1332.
4. Adequate and independent state grounds
A final state-court judgment that rests on adequate and independent state grounds may
not be reviewed by the U.S. Supreme Court (or it would be an advisory opinion). The
state-law grounds must fully resolve the matter (i.e., be adequate) and must not
incorporate a federal standard by reference (i.e., be independent). If a state court
chooses to rely on federal precedents, the court can avoid federal review by making a
plain statement in its judgment or opinion that the federal cases are being used only for
the purpose of guidance and did not compel the court's judgment. When it is not clear
whether the state court's decision rests on state or federal law, the Supreme Court may
hear the case, decide the federal issue, and remand to the state court for resolution of
any question of state law. Michigan v. Long, 463 U.S. 1032 (1983).
