Invitation to Tender for Onshore Pipeline Extension Package for Marine Import
Facilities 2 Project, Petron Port Dickson Refinery

1. Invitation
Petron Malaysia Refining & Marketing Berhad (No. 3927V) formerly known as Esso Malaysia
Berhad hereby invites tenders for Onshore Pipeline Extension Package for Marine
Import Facilities 2 Project, Petron Port Dickson Refinery on the terms set out in the
attached documents. The scope of work shall cover but not limited to deliver Onshore
Pipeline Extension package of the Marine Import Facilities 2 Project, Petron Port Dickson
Refinery

2. Tender Package
Tenderers are required to tender on the terms and condition of the Tender Package,
provided in the email attachment, failing which the tender may be rejected. The said Tender
Package comprises:
a) ITT Documents Index
b) Instructions to Tenderers
c) Part A – The Agreement
d) Part B – Conditions of Contract
e) Part C – Job Specifications
f) Part D – Construction Requirements
g) Part E – Commercial Proposal
h) Part F – Technical Proposal

3. Term of Agreement
Term of Agreement is as specified in Part A and Part B.

4. Tender Briefing
A tender briefing session will be held at Petron Port Dickson Refinery, 1.5 Miles Off Jalan
Pantai, 71009 Port Dickson, Negeri Sembilan (Date and Time is to be informed separately).
Tenderer is required to attend the scheduled session.

5. Tender Closing Date

Tenders closing date and time will be on XX nd March 2019 at 4:00 PM. Tenders that are
submitted later than the said closing date and time may be rejected by the Company.

6. Bid Validity
Every tender submitted shall remain valid for a period of 90 calendar days from the closing
date of tender submission, and shall not be retracted or withdrawn during that period.

7. Tenderer's Proposal and Submission Requirements

Tenderer shall submit their technical and commercial as specified in part E and F.

8. Tenderer's Exceptions
Tenderer's base quotations shall be in full compliance with Company's specifications. Any
exceptions to the terms of the tender are to be submitted in a separate attachment.

9. Tender Opening Date

Tender is open for bidding with immediate effect and Tenderers shall submit their bids at the
Company's following address and correspondence:

11. Alternatives Encouraged

Tenderer is encouraged to provide cost-effective or cost-saving solutions with no sacrifice to
safety, reliability and quality. If there are any, Tenderer shall clearly set out the details in a
separate attachment.

12. Subcontractors Details

Tenderers shall furnish Company with the names, addresses, track records, and
organization chart of its sub-contractors or others, who are engaged in the performance of
the work, for Company's review and approval. The successful Tenderer shall ensure that all
its sub-contractors are approved by Company.

13. Award Notification

Company shall notify the successful Tenderer by e-mail, fax or post. Issuance of such
notification shall be deemed to be good service of Company's acceptance of the tender. The
successful Tenderer shall within fourteen (14) days of the date of notification of acceptance
by Company, sign an Agreement in the form set out in the Agreement Forms hereto.

14. Others
a) Tenderer agrees to hold all information provided in the tender documents, and any
subsequent clarifications, confidential except as necessary to meet Company's request.
There shall be no confidentiality obligation on the Company.
b) Any subsequent award/agreement shall be conditional upon the Tenderer becoming
qualified by the Company at a later date.
c) Company may discuss and review all aspects of the tender with any party after tender
opening.
d) Company reserves the right to accept all, or any part, of the tender.
e) Company shall be under no obligation to accept the lowest tender, or any tender, and
reserves the right to not enter into any correspondence with any Tenderer regarding the
reasons for non-acceptance of any tender.

15. Illegal Information Brokering

Tenderer warrants and represents that it has not and will not utilize confidential information
of others or illicit influence such as illegal information brokering in connection with this
tender.Tenderer will promptly notify company's procurement services manager or controller
if anyone approaches Tenderer for the purpose of illegal information brokering concerning
this tender.

16. Non-Compliance
Non-compliance with instructions will render the tender liable to rejection.
