General Guidance for e-Tendering :-

Instructions / Guidelines of the electronic submission of the tenders online for the bidders have been to participate
in e-Tendering is available on http://mahatenders.gov.in.
E-tenders are invited for the above works of eligible contractors dually registered with Zilha Parishad or Rural
Development Department.

Registration of Contractors :-
Any contractor should participate in the process of e-Tendering must have registered in any zilla parishad and or
Rural Development Department of MAHARASHTRA in appropriate class & categories & for the Government
e-Procurement System, through logging the web portal of the GOVT. OF MAHARASHTRA on
"http://mahatenders.gov.in

Digital Signature Certificate (DSC) :-

Each contractor is required to obtain a Digital Signature Certificate (DSC) for submission of tenders, not needed
of tenders, from the approved service provider of the National Informatics Centre (NIC), after payment of requisite
amount. Details are available at the website stated. DSC is given as a USB e- Token.

Collection of Tender Documents :-

The contractor can search and download NIT and tender documents electronically from internet by logging to the
website mentioned using the Digital Signature Certificate. This is the only mode of submission of tender
documents.
Participation in more than one work :-
Normally, any contractor can collect and submit tenders for maximum number of work in any particular NIT,
depending on his credential and financial capability.
Submission of Tenders
General process of submission of tenders :-
Tender is to be submitted online only before due date and time in two folders. i.e. one is Technical Proposal and
other Financial Proposal. Using the Digital Signature Certificate (DSC), prescribed scanned digitally signed
document must be uploaded. The documents will get encrypted (transformed into non-readable formats)
automatically.
Technical Proposal :-
The Technical Proposal of two covers (folders) must contain scanned copies of the following.
a. Statutory cover containing.
1. Challan/ receipt of online payment towards tender fee & earnest money deposited (EMD) or to be paid
through Net Banking in the account of Chief Accounts & Finance Officer Z.P.Ahmednagar at SBI
Burudgaon Road Branch Ahmednagar, A/C No 33991302872 IFSC Code SBIN 0008991, MCER code
414002004, Branch code is 08991. The scanned copy of challan / counter file of receipt or net banking
submission report is to be submitted along with the Technical Documents.
2. Bid shall be treated as “Invalid” if the amount of tender fee and Earnest Money is found incorrect after
reconciliation with bank account of CA & FO Zilla Parishad Ahmednagar.
3. Copy of Valid Registration issued by any Zilla parishad and Rural Development Department of
Maharashtra.
4. Copy of G.S.T. Registration Certificate.
5. Copy of PAN card.
6. If the bidder submits the tender amount below 10% of the estimated rates (BoQ) he must submit the
additional performance security deposit in the form of demand draft as per PWD GR date 27/09/2018. If
tender quotes the rate 10% below he must give in writing with his signature mentioning how he will
complete this work in this below rate, maintainig proper quality, within five days after opening financial
envelope.
7. Additional Performance Security Deposit of Demand Draft must be submitted to concerned office of Zillha
Parishad within eight days after financial bid opening.
8. The Demand Draft should be in the name of Executive engineer PW South Div. Z.P. Ahmednagar and
should be of nationalized bank / Schedule bank. The name of work must be written on the back side of
Demand Draft
9. The scanned documents showing Own Plant / Agreement for Partnership / Rent Agreement with Plant
Owner firm machinery Hot mix / drum mix plant / Vibratory roller / paver finisher / Dumpers is Compulsory.
This valid agreement must be produced in concerned office of ZP within tender submission end date. If
contractor is found guilty legal/ penalised action will be taken on him as per G.R. No.misc-
2018/pr.no.30/y.b.s. dt.27-3-2019. As these machinery having 15 years life considered and after 10 years,
every year Superitedent Engineer of Mechanical’s Qualification Certificate must be attached.
10. In view of maintaing the proper temperature of bitumen and carpet mix material, it is binding on tender or
to use such material from where the distance of work site and hot mix plant is 40 to 60 km or within 1 hour
distance from plant.
11. As per state schedule or rate, if SCADA condition is included in some items of estimate, then while
submitting the bills of such works original receipt of SCADA certified by concerned contractor & Deputy
Engineer should be attached. Otherwise as per SSR mentioned amount will be deducted from the
respective item of SCADA by Deputy Engineer.

12. Defective Laibility Period of work will be held as per PWD Resolution dated 14 January 2019.
13. For concrete road works, it is necessary to attach agreement of given below machinery, the tender has
his own /partnership/rent mobile concrete mixer/RMC Plant/Vibrator/Trimix machine .
14. For all building works use of concrete mixer and needle vibrator is compulsory.
15. If it is noticed that at any tender stage, tenderor has not completed the previous works alloted to him after
given him time extension, then his tender will be disqualified.
16. Contractor shall take out necessary Insurance Policy / Contractor relating Policies (viz. Contractor's All
Risks Insurance Policy, Erection Risks to insurance of Insurance Policy etc. as decided by the Directorate
of Insurance) so as contractor have to provide adequate insurance cover for execution of the awarded
contract work including for total contract value and complete contract period compulsorily from the
"Directorate of Insurance, Maharashtra State, Mumbai" only. Its postal address for correspondence is "
264, MHADA, First Floor, Opp. Kalanagar, Bandra (E), Mumbai-400 051". (Telephone Nos 26590403
/26590680 and Fax Nos 26592461 / 26590403). Similarly all workmen's appointed to complete the
contract work are required to insure under workmen's compensation Insurance Policy from authorized
provider policies taken out from any other company will not be accepted. If any Contractor has effected
Insurance with any Insurance Company, the same will not be accepted and the amount of premium
calculated by the Government Insurance Fund will be recovered directly from the amount payable to the
Contractor for the executed contract work and paid to the Directorate of Insurance Fund, Maharashtra
State, Mumbai. The Director of Insurance reserves the right to distribute the risks of insurance among the
other insurers. The document must be kept available at site during execution.

17. Similar type of work done Certificate.

i. As per PWD GR dated 27/09/2018, Certificates of similar type of completed work done For Rs.
One Crore above Tender Amount One single completed work of similar type at least 30 % amount
of work done in last 5 years , the bidder must upload valid certificates.
ii. As per PWD GR dated 27/09/2018, 30% of quantity of work mention in tender must be done in 1
year of last 5 years, the bidder must upload valid certificates
iii. For Rs.One Crore above Tender Amount providing proof of similar type of work done the
document should contain (a) Name of work, (b) Name of contractor, (c) Amount of tender, (d)
Amount of complited work, (e) schedule (month and year of commencement and completion as per
work order) and month and year of actual completion & execution of quantities specified.
iv. For providing proof of similar type of work done the document of work executed in other
Departments of Central Government Departments, State Government or semi Govt. organizations,
and Zilla Parishad may also be considered. Such proof other than those stated are to be counter-
signed by the Executive Engineer / Deputy Engineer of the respective State / Central Government
Departments or by any Officer of equivalent rank.
 Financial Proposal :-
The financial proposal should contain one cover (folder) the following documents.
i. Bill of Quantities (BoQ):- The contractor is to quote the rate (percentage above or below) online through
internet in the space marked for quoting rate in the BoQ.
ii. Bidder can download those copies before uploading, after quoting the rate the bidder must be insure that
those scan documents are dully digitally signed.

General instructions :-
1. Price escalation in tender is not allowed.
2. After gating the bid if the tendered wish to sublet work to another agency he must required to qualify in
technical and financial matters as per terms and conditions of tenders and should pay to zilha parishad
the cost 0.5% of Tendered amount must be obtain permission of competent authority to sublet the work.
3. As per GR / Circular no 2018 / PRA KRA 198/ BANDH 4 Dated 12/10/2018, tenderor should have
enrolled name of employees to board of labour Welfare.
4. As per Circulars issued by R D D Dated 05/10/2018, tenderor must dually insure labors to be employed
for work should be produced before time of issuing work order.
5. The Bidder should submit self declaration as per the annexure 1 of RR 28/11/2018. The all contents of
Annexute 1, including name of the work must be well typed and in similar font on first page of bond paper.
The scanned copy must be uploaded in tender while the original bond must be produced within 8 days
after opening of Tender. Mismatching of original and scanned document will be treated as forgery.
6. During evaluation if the uploaded document don’t match with the originals the bidder will be penalized as
pre the rule and even police action if needed.
7. After opening of financial bid the information automatically go to bidder and they can see the financial bid,
So no separate correspondence will be done in this regard. The successful lowest bidder need to submit
all required documents and agreement in a specified B 1 form along with security deposit, insurance
enrollment of labour within 15 days from the opening of bid. If Bidders fail to submit the said document
within stipulated period his claim for the tender will be void. The other Bidder will be called chronologically
for negotiations and in negotiation if they accept to do the work below the rate quoted by first lowest
bidder the tender will be awarded to such a bidder.
8. Befor submitting the documents in statutory envelope, when contractor submits e – tender the page
number should be placed on the document itself by uploading all pages with number and total number in
such a manner given below and uploading it in PDF file envelope number one.

Eligibility criteria for participating in more than one tender :-

i. Proof of similar type of work done the document of fully physically completed works is to be provided for each
separate work.

Penalty for Withdrawal from Tender :-

After evaluating the techinical envelope, if contractor giving in writing that his financial bid do not open or he
withdraw from the tenter, then his financial bid must be opened and the tender evaluation committee can be
penalizes the tenderor.
Penalty for suppression / distortion of facts/ False documents :-
During evaluation if there is mismatch of original document and uploaded documents, the bidder / tender will be
disqualified for this tender and other tenders he submitted also disqualified and penalized like EMD forfited/
suspension of license / cancellation of registration and even police action if needed.

Obscure/Suspicious Documents :- It will be the responsibility of concerned contractor to disqualify him on the
ground of having obscure/suspicious documents.

Taxes & duties to be borne by the Contractor :-

Income tax, GST, Royalty, Workers' Welfare Cess and all other statutory levy / cess /octroi will have to be Paid by
the contractor and the rate should be quoted in BoQ accordingly after consideration of all these charges.

Site inspection before submission of tender :-

Before submitting any tender, the intending tenderer should make themselves acquainted thoroughly with the local
conditions prevailing at site by actual inspection and taking into consideration all factors and difficulties likely to be
involved in the execution of work in all respect and no claim whatsoever will be entertained on these account
afterwards.

Conditional and incomplete tender :-

Conditional and incomplete tenders are liable to summary rejection.Unnecessary documents should not be
submitted in tender.

Opening and evaluation of tender.

Tender Evaluation Committee (TEC) :- Committees already constituted for issuance of tender papers. vide Govt
.Resolution No. misc/2010/275/CR/PARA-7 /11 dated 19-10-2011 will continue to function as Tender Evaluation
Committee (TEC), for evaluation of Technical and financial Bid Proposals of the tenderer.

Opening of Technical Proposal.

i. Technical proposals will be opened by the committee members as per govt resolution and/or his authorized
representatives electronically from the website stated , using their Digital Signature Certificate.
ii. Intending tenderer may remain present if they so desire.
iii. Cover (Folder) for Technically Statutory Documents should be opened first If there is any deficiency in the
statutory documents, the tender of the concerned bidder will be rejected.
iv. Decrypted (transformed into readable formats) documents of the Non-statutory Cover will be downloaded, and
handed over to the Tender Evaluation Committee.
v. The Tender papers submitted by tenderor can be re-examined or tenderor docoments can examined if required
by tender evaluation committee.

Uploading of summary list of technically qualified tenderer (1st round).

i. Pursuant to scrutiny and decision of the Technical Evaluation Committee (TEC), the summary list of eligible
tenderer and the serial number of work(s) for which their Financial Proposals will be considered will be uploaded in
the web portals.

While evaluation, the Committee may summon off the tenderer and seek clarification / information or additional
documents or original hard copy of any of the documents already submitted and if bidder fails to be produce the
desired documents within the stipulated timeframe, their proposals will be liable for rejection.

Provision for appeal and its disposal :-

i. Intending tenderer if not satisfied with the decision of the Tender Evaluation Committee (TEC) may prefer an
appeal to the CHIEF EXECUTIVE OFFICER Z.P.AHMEDNAGAR / ADDITIONAL CHIEF EXECUTIVE OFFICER
Z.P.AHMEDNAGAR in writing (through facsimile / e-mail or speed post) within 24 hours after the date of uploading
of the summary list of the successful tenderer. Copy of such appeal should also be sent to EXECUTIVE ENGINEER
Z.P. PWS DIV. AHMEDNAGAR.
ii. The Appellate Authority, CHIEF EXECUTIVE OFFICER Z.P.AHMEDNAGAR / ADDITIONAL CHIEF EXECUTIVE
OFFICER Z.P.AHMEDNAGAR will dispose such appeals by hearing the aggrieved tenderer as well as consulting
the Tender Evaluation Committee within next working days and the concerned tenderer will be communicated
accordingly.
Final publication of summary list of technically qualified tenderer :-
In case, the Appellate Authority asks the Tender Inviting Authority to consider tender of any of the aggrieved
tenderer, who may have preferred appeal, the process of uploading of qualified tenderer will be re-done, through
issuing necessary corrigendum. Date of opening of financial bid is to be intimated in the final summary list.

Opening and evaluation of Financial Proposal.

i. Financial proposals of the tenderer declared technically eligible by the Tender Evaluation Committee will be
opened electronically from the web portal stated. on the prescribed date, normally after 24 hours of date of
publication of final summary list of the tenderer, or later on suitable date by the Executive Engineer Z.P. PWS Dn.
Ahmednagar.
ii. The encrypted copies will be decrypted and the rates will be made available to read out for bidder.
iii. After evaluation of Financial Proposal, by the Executive Engineer Z.P. PWS Dn. Ahmednagar after having
necessary comments and test check to the comparative statement by the Chief Accounts & Finance officer Z.P.
Ahmednagar / Executive Engineer may upload the final summary result containing inter-alia, name of contractors
and the rates quoted by them against each work provided he is satisfied that the rate obtained is fair and
reasonable and there is no scope of further lowering down of rate.
iv. After holding such bids, final summary result would have to be uploaded in the web portal, through
corrigendum.
v. The Tender Accepting Authority may ask any tenderer to submit analysis to justify the rate quoted by that
tenderer.
Acceptance of Tender :-
Lowest valid rate should normally be accepted. However, the Tender Accepting Authority/ Executive Engineer Z
.P. PWS Dn. Ahmednagar does not bind himself to do so and reserves the right to reject any or all the tenders, for
valid reasons and also reserves the right to distribute the work amongst more than one tenderer.

Payment of additional Earnest Money/Security deposit on acceptance of tender :-

The tenderer, whose tender is approved for acceptance, shall within 10 days of the receipt of Letter of Acceptance
(LoA) to him, will have to execute 'Formal Agreement' with the Executive Engineer Z .P. PW South Div.
Ahmednagar in quadruplicate copies of bond paper of necessary values prescribed in finance rules/resolutions of
Govt. Of Maharashtra in force. The successful tenderer shall have to pay 2% security deposit in form of demand
draft of Nationalized bank in favor of Chief Accounts & Finance Officer Z. P. Ahmednagar payble at Ahmednagar
enclosed form and complete the contract document.

Return of Earnest Money of the unsuccessful tenderor(s) :-

For return of the Earnest Money of the unsuccessful tenderor(s), he/she/they is/are to apply for the same to the
Executive Engineer concerned with the work, giving the reference to the work, NIT No., date of tender, amount
and mode of Earnest Money deposited - all in a complete form. The Earnest Money of all tenderer other than the
lowest tenderer in each case may be refunded, after acceptance of the rate in comparative statement,and work
order given as early as possible.

Payment.
The payment of RA as well as final bill for any work will be made according to the availability of fund and no claim
to delay in payment will be entertained.

Supply of Materials.
All materials required for the works are to be supplied by the agency at his own cost.

Note: Days mean working days excluding Saturdays, Sundays and Government Holidays. Date of openings of
technical /financial bids are probable if change occurs the corrigendum will published accordingly.
The complete bidding process will be online (e-tendering) . The guidelines to download the tender document and
online submission of bids and procedure of tender opening can be downloaded from website
http://mahatenders.gov.in.
Contractor should submit Original physical form demand draft for downloading tender documents ,DD should be
drawn in favor of " Chief Accounts & Finance Officer Z.P. Ahmednagar " payable at AHMEDNAGAR,
and should submitted as given schedule.(tb-3 ,5)) offline manually to the office of Executive Engineer.
Bank challan submitted shall be the same as scanned copy submitted along the bid.
Technical Bids will be opened online as per scheduled date (tb-4,4) from website "http://mahatenders.gov.in" in
the office of the Additional Chief Executive Officer Z.P. Ahmednagar.
Financial Bids will be opened online on as per scheduled date (tb-4,8 ) from website http://mahatenders.gov.in
in the office of Additional Chief Executive Officer Z.P. Ahmednagar.
Time and Date of opening of financial bids will be informed by email to responsive bidder. if change occurs.
The tender submitted by the tenderer shall remain valid for a period of 120 days from the date opening of tenders.
Also see Para 1 of General Rules etc. of the contract form.
The amount of earnest money will be forfeited in case of successful contractor does not pay the amount of initial
security deposit within the time specified as stipulated by the Executive Engineer and complete the contract
documents. In all other cases earnest money will be refundable.

Examination of drawing and site conditions - The tenderer shall in his own interest carefully examine the
drawing, conditions of contract, specifications etc. He shall also inspect the site and shall acquaint himself about
the climate, physical and all other conditions prevailing at site, the nature, magnitude, special features practically
of the works all existing and required means of communications and access to site stores and godowns etc. He
shall obtain all necessary information as to the risks, contingencies and other circumstances which may effect and
influence the tender. No claims on any of the above or any other factors will be entertained by the ZP or Govt. If
there is any discrepancy doubt or obscurity as to the meaning of any of the tender documents or as to the
instructions to be observed by him he shall set forth in writing such discrepancy or doubt or obscurity and submit
the same to the Executive Engineer within first 3 days of tender periods.
Any Corrigendum if required will be published only on http://mahatenders.gov.in Right to reject or cancel any or all
the tenders without assigning any reason there of whatever reserved by the competent authority.

Activity Date
