LEGAL STATUS: Married
OCCUPATION: Teacher

This Judicial Affidavit of Ms. Dina Malabo is being offered

to prove the material allegations in the complaint for Unlawful
Detainer against the Defendants spouses Juan and Estella
Bernabe to provide additional and/or testimony regarding the
matter of the case at hand, to identify the documents and
other evidence pertinent to the above case.

The examination of the witness was conducted and

supervised by Atty. Arman D. Alipit Jr. at his office at Block
001, Asuncion Building, Bauan, Batangas.

The question were prompted in English which the
witness understands, while the answers were given by him in
Filipino dialect but corresponding translation thereof is
provided after each question.

1. Q: How are you related to Susan Roxas, the plaintiff in

Civil Case 3657 before the MCTC of Taal-San Nicholas for
Unlawful Detainer with damages against spouses Juan
and Estella Bernabe?

A: We are not related with each other sir.

2. Q: Do you know the plaintiff Susan Roxas?

A: Yes, sir. I come to know her when she bought the

lot of spouses Jose and Maria Castillo on 2012. That I
signed as a witness on the Deed of Sale of the lot
executed by spouses Castillo in favor to Susan Roxas.

3. Q: Who are the spouses Jose and Maria Castillo?

A: The spouses Jose and Maria Castillo are my

neighbor at Brgy. Butong, Taal, Batangas.

4. Q: You said that you are the witness of the Deed of

Sale executed by the spouses Castillo in favor of the
plaintiff Susan Roxas, do you know where the location of
the lot subject of that sale?

A: Yes, sir. The lot that was sold to Susan Roxas is the
lot of spouses Castillo located at Brgy. Butong, Taal,
Batangas adjacent to my lot were my house is located.

5. Q: Can you remember the date and location were the

said contract of sale was made by the spouses Castillo
and Susan Roxas?

A: The Contract of Sale was executed at the residence

of spouses Castillo at Brgy. Butong, Taal, Batangas on
2012.

6. Q: I am showing you a photo copy of a Deed of Sale as

Exhibit A, can you recognized it as the Deed of Sale
whom you witnessed and signed?

A: Yes, sir that’s the Deed of Sale.

7. Q: Do you affirm the truthfulness and veracity of this

Judicial Affidavit?

A: Yes, Sir.

8. Q: Do you answer these questions fully conscious that

you do so under oath and that you may be criminally
held liable for false testimony or perjury?

A: Yes, sir.
