FACTS:
Liberato was having a drinking spree at the house of Angel Vargas, the father of the victim Vivian
Vargas. After the drinking spree has ended, Angel asked Vivian to go to the house of a certain
Auring Rabal, which was about 200 meters away, to return a chair that they borrowed. Vivian
never returned.
Meanwhile Liberato went home. He encountered while on his way home, Antonio, the cousin of
Vivian at Antonio’s corn plantation. In the said encounter, Liberato was seen carrying Vivian on
his back and appeared to be headed towards the nearby body of water.
Later that day, with Vivian still missing, they began searching for her. The following morning,
however, Vivian’s lifeless body was recovered near the house of Joel Basagre, the father of
Jason.
Immediately, the policemen summoned and investigated all those present at the drinking spree
in Angel’s house. However, when Liberato’s turn for questioning came, he ran away.
An autopsy was performed on her body revealing “asphysia by submersion” or drowning as the
cause of death.
Liberato, during the trial, denied knowing Vivian or any of the children of Angel.
Later on, during his testimony before the RTC, Liberato retracted his previous statements and
admitted to knowing Vivian because he was able to talk to her on a separate occasion. Upon
further questioning, however, Liberato suddenly claimed that he never talked to Vivian and only
learned about her name when he was helping Angel search for her.
The RTC found Liberato guilty of the crime of Murder, qualified by treachery. It found that there
was enough circumstantial evidence to produce a conviction and to overcome Liberato’s
defense of alibi and denial.
CA affirmed RTC’s conviction with modification only as to the damages awarded.
ISSUE: w/n the circumstantial evidence sufficiently proved Liberato’s guilt beyond reasonable doubt for
the crime of Murder.
RULING: YES. The SC ruled that the pieces of evidence, considered in their totality, are sufficient to
prove Liberato’s guilt beyond reasonable doubt for the murder of Vivian.
