Swafford v. Florida. FSA File Celeste Bacchi, Esq. [954] 713-1284

Conviction and death sentence 05-026 Capital Collateral Regional
vacated by the Florida Supreme Counsel – South
Court, No. SC10-1772, November 7,
2013, based in substantial part on the
debunking of the State’s AP spot test
to prove semen on the victim’s
vaginal and anal swabs. Court states
FDLE employee, Keith Paul,
recognized that the AP tests he
performed were only presumptive
tests and he did not perform the
quantitative tests to confirm
whether semen was present. He
testified that although during the
trial he had agreed that “given a
vaginal area and an anal area and
[the presence of AP in both],
there would have to have been a
male organ at one or the other,” he
did not mean to say a male organ
was either at the anus or the
vagina and that he must have
misunderstood the question.
