MEMORANDUM OF AGREEMENT

FOR THE TURNOVER, OPERATION, AND MAINTENANCE OF


THE BAY-WIDE MANAGEMENT MULTIPURPOSE BUILDING (BMMB) IN JOLO, SULU

KNOW ALL MEN BY THESE PRESENTS:

This Memorandum of Agreement made and entered into by and between:

JOLO, Sulu, herein represented by Mohammad Nur Alih;

PANAMAO, Sulu, herein represented by Gafur Amil;

OMAR, Sulu, herein represented by Al-Ghosaibi Jupli;

BANGUINGUI, Sulu, herein represented by Morjaden Munap;

LUUK, Sulu, herein represented by Henry Siraji;

PANGUTARAN, Sulu, herein represented by Alkhalid S. Omar;

HADJI PANGLIMA TAHIL, Sulu, herein represented by Mohammad Arziyad Basir;

PATIKUL, Sulu, herein represented by Luzviminda Hayudini;

MAFAR Provincial Office, herein represented by Engr. Alfie Iribani, DPA

-and-

MAFAR-BARMM, herein represented by Mohammad S. Yacob, Ph.D.

WITNESSETH THAT:

WHEREAS, the Fisheries Coastal Resources and Livelihood (FishCORAL) Project with
assistance from the International Fund for Agricultural Development (IFAD) will address
key issues that contribute to the high incidence of poverty among fishermen through
sustainable management of the coastal and fisheries resources and implementation of
community-based enterprises;

WHEREAS, the Department of Agriculture (DA) is the Project Executing Agency with the
Bureau of Fisheries and Aquatic Resources (BFAR) as the Lead Implementing Agency and
the MAFAR-BARMM will be responsible for the Project implementation in its jurisdiction;

WHEREAS, under Article X, Section 13 of the 1987 Philippines Constitution, local


government units (LGUs) are encouraged to group themselves, consolidate or coordinate
their efforts, services, and resources for purposes commonly beneficial to them;

WHEREAS, the foregoing constitutional provision in favor of LGUs is emphasized in the RA


7160, otherwise known as the Local Government Code of 1991, particularly Section 33
which provides for cooperative undertakings among local government units by grouping
themselves, consolidating their efforts, services, and resources commonly beneficial to
them;
WHEREAS, Section 16 of RA 8550, known as the Philippine Fisheries Code of 1998, as
amended by RA 10654, likewise provides, among others, that the municipal governments,
shall have jurisdiction over municipal waters; responsible for the management,
conservation, development, protection, utilization, and disposition of all fish and
fishery/aquatic resources within their respective municipalities; manage contiguous
fishery resources such as bays which straddle several municipalities, which shall not be
based on political subdivisions in order to facilitate their management as a single resource
system;

WHEREAS, the above-mentioned municipalities comprising the Sulu Bay-wide


Management Council (SBMC) have shared vision for a sound and sustainable management
of their coastal and fishery resources for the benefit of their constituents;

WHEREAS, the eight member municipalities hereby consider the existence of Sulu Sea as a
single Bay and a single resource system to facilitate integrated and coordinated coastal
resource management of the municipal waters.

WHEREAS, the Bay-wide Management Multi-Purpose Building (BMMB) serves as the


SMBC’s physical office with its address at MAFAR- Sulu Fisheries Services Compound, Port
Area, Jolo, Sulu.

NOW THEREFORE, for and in consideration of the foregoing premises herein set forth, the
parties hereto have agreed and do hereby agree as follows:

The FishCORAL Project shall;

1. Provide funds for the construction of the BMMB and procurement of support
equipment such as air conditioning unit, filing cabinet, tables, and chairs.

2. Turn over the BMMB to Sulu Bay Management Council.

3. Provide necessary support to capacitate SBMC in the management and


operationalization of BMMB.

The Sulu Bay Management Council shall;

1. Be the main management body responsible for the utilization of the BMMB.
As stated in the Project Implementation Manual:

The Project will provide each bay with a BMC, and a Bay Management and
Multi-Purpose Building (BMMPB): a two-story concrete building. The ground
floor will be a learning center with IEC materials about the bay resources and
its programs, while the second level will house the office of the BMC and
IFARMC with a meeting area.

2. Ensure the utilization of BMMB as the physical office of the Council, and

3. Provide counterpart funds for the recurrent cost of operation and


maintenance of BMMB.

4. Provide Annual BMMB Operation and Management Plan, Financial Plan, and
Accomplishment Plan to MAFAR, submitted within the first quarter of each
year.

5. Establish SBMC regular meetings, at least quarterly.


6. Allocate space for the FishCORAL Staff until the end of the FishCORAL
Project.

The MAFAR- Sulu Provincial Office shall;

1. Ensure Sulu Bay Management Council is functional.

2. Provide necessary support to capacitate Sulu Bay Management Council in the


management and operationalization of BMMB.

That any amendments to this agreement shall be in writing and signed by each of
the parties hereto.

This Memorandum of Agreement shall take effect upon signing herein and shall
remain in force, unless otherwise earlier modified or amended by mutual consent of both
parties.

It shall continue to be binding and obligatory upon the parties mentioned herein,
but it may be terminated upon mutual consent of both parties through a written notice
furnished for at least sixty days (60) before the specified date of termination.

IN WITNESS WHEREOF, the parties have executed this Memorandum of Agreement


on this ___ day of ____________________, 2022 at _________________.
