THE WARDS IN THE CITY OF HUDSON AND VOTING PROCEDURE OF ITS COMMON COUNCIL
(1) We the undersigned, being duly qualified electors of the City of Hudson, State of New York
representing not less than ten percent (10%) of the total number of valid votes cast for governor in the
City of Hudson at the last gubernatorial election, present this petition to the City Clerk of Hudson and
respectfully request that the following law to amend the Charter of the City of Hudson be submitted to
the voters of the City of Hudson at the next general election to be held on November 8, 2016:
Be it enacted by the people of the City of Hudson pursuant to the authority provided in section 37 of
the Municipal Home Rule Law as follows:
Section 1. The Hudson City Charter, section 1-4 (enacted 2-13-1973 by L.L. No. 2-1973), is hereby
amended (by inserting therein the underlined text, and deleting therefrom the text with lines through
it) to read as follows:
Article I
Incorporation and Boundaries
Section 1-4 Ward Boundaries and changes in Ward boundaries pursuant to reapportionment
A. Ward boundaries. The City shall be divided into five (5) wards, bounded and described
respectively as follows:
B. Allocation of Population to Each Ward. The population allocated to each of the wards
described in subparagraph A. above is based on the census block data from the United States
Census Bureau from the 2010 census, as adjusted by the New York Legislative Task Force on
Demographic Research and Reapportionment with respect to persons resident in state or
federal prisons. Such census block data is set forth below listing the census blocks in each
ward that contain population. The asterisked population figures for census block Tract 1300,
Block 1002, with a total population of 365, that is split between Wards 1 and 2, are based on
there being 168 housing units in said census block, of which 60 units are within the
boundaries of Ward 1, and 108 units are within the boundaries of Ward 2, as calculated by the
City Clerk of Hudson. The asterisked population figures for census block Tract 1200, Block
1012, with a total population of 200, that is split between Wards 4 and 5, are based on there
being 91 housing units in said census block, of which 34 units are within the boundaries of
Ward 4, and 57 units are within the boundaries of Ward 5, as calculated by the City Clerk of
Hudson.

C. Equal Population Requirements and Reapportionment of Wards. The Wards shall have
substantially equal populations as determined by the United States Census Bureau and New
York state law such that such populations are in conformance with applicable federal and
New York state law. If after any decennial federal census, the population of the Wards is not in
compliance with the law, the Common Council by not later than July 1 st of each year ending in
“2” shall reapportion the Wards and change their boundaries in order to cause their
respective populations to be in conformance with the law.
A. First Ward. All that part of the City lying southerly of the center line of Warren Street and westerly
of the center line of Third Street and within projections of those lines extended to the southerly and
westerly bounds of the City shall be the First Ward.
B. Second Ward. All that part of the City lying northerly of the center line of Warren Street and
westerly of the center line of Third Street and within projections of those lines extended to the
northerly and westerly bounds of the City shall be the Second Ward.
C. Third Ward. All that part of the City within the lines beginning in the center of that part of Third
Street known as the "Bay Road" in the southerly bounds of the City and running thence northerly
along the center line of the Bay Road and Third Street to the center line of Warren Street, and
thence easterly along the center line of Warren Street to the center line of Seventh Street, and
thence diagonally across Public Square to a point where the center line of Gifford Place intersects
the center line of Columbia Street, and thence along the center line of Columbia Street and the
center line of Columbia Turnpike to the easterly bounds of the City, thence along the easterly and
southerly bounds of the City to the point of beginning, shall be the Third Ward.
D. Fourth Ward. All that part of the City lying within lines beginning at a point in the northeasterly
bounds of the City, where a projection of the center line of Third Street intersects the northerly
bounds of the City, running thence southwesterly along said projection of the center line of Third
Street and along the center line of Third Street to the center line of Warren Street, and thence
easterly along the center line of Warren Street to the center line of Fifth Street, thence northerly
along the center line of Fifth Street and a projection of said center line of Fifth Street to the
northerly bounds of the City, and thence westerly along the northerly bounds of the City to the point
of beginning, shall be the Fourth Ward.
E. Fifth Ward. All that part of the City lying within the lines beginning at a point where a northerly
extension of the center line of Fifth Street intersects the northerly bounds of the City, and running
thence southerly along said projection and the center line of Fifth Street to the center line of Warren
Street, and thence easterly along the center line of Warren Street to the center line of Seventh Street,
and thence diagonally across Public Square to a point where the center line of Columbia Street
intersects the center line of Gifford Place, thence along the center line of Columbia Street and the
center line of Columbia Turnpike to the easterly bounds of the City, thence along the easterly and
northerly bounds of the City to the place of beginning, shall be the Fifth Ward.
Section 2. The Hudson City Charter, section 12-13 (enacted 2-13-1973 by L.L. No. 2-1973, and
amended 9-16-1975 by L.L. No. 4-1975; 4-20-2004 by L.L. No. 3-2004; 4-20-2004 by L.L. No. 4-2004;
2-19-2013 by L.L. No. 3-2013), is hereby amended (by inserting therein the underlined text, and
deleting therefrom the text with lines through it) to read as follows:
Article XII
Common Council
Section 12-13 Number of member of Common Council votes necessary for passage; quorum
requirements. Majority vote necessary; manner of voting.

(1) The Common Council shall consist of eleven (11) members. Each of said eleven (11)
members shall be entitled to cast at each special or regular meeting of the Common
Council, or at a committee meeting of such Council on which such member serves, one
vote. Simple majority decisions shall require six (6) votes for passage. Two-thirds majority
decisions shall require eight (8) votes for passage. Three-fourths majority decisions shall
require nine (9) votes for passage.
(2) Decisions of any committee of the Common Council shall require a vote that constitutes a
majority of all the members of the Common Council serving on such committee.
(3) No motion or resolution, or other action of the Common Council, or a committee of such
Council, shall pass, unless with the assent of those members thereof as required in
Subsection A(1) and A(2) of this section. The ayes and nays shall be called and recorded on
all motions and resolutions authorizing the expenditure or collection of money, or the
making of local improvements or repairs, or on any vote whenever demanded by a
member of the Common Council, and on the adoption, amendment or repeal of any local
law or ordinance.
B. Quorum.
(1) The attendance of six (6) members of the Common Council shall be required to constitute
a quorum at a general or special meeting which calls for the adoption of any resolution,
ordinance, local law, motion or proposal which requires a simple majority of the Common
Council under applicable provisions of law.
(2) The attendance of eight (8) members of the Common Council shall be required to
constitute a quorum at a general or special meeting which calls for the adoption of any
resolution, ordinance, local law, motion or proposal which requires a two-thirds vote of
the Common Council under applicable provisions of law.
(3) The attendance of nine (9) members of the Common Council shall be required to
constitute a quorum at a general or special meeting which calls for the adoption of any
resolution, ordinance, local law, motion or proposal which requires a three-fourths vote of
the Common Council under applicable provisions of law.
(4) The attendance of a majority of the members of the Common Council serving on a
committee of such Council shall be required to constitute a quorum at such a committee
meeting.
A. No motion or resolution, or other action of the Common Council, shall pass, unless with the assent of
those members entitled to cast a majority vote as required in Subsection C(3) of this section. The
ayes and nays shall be called and recorded on all motions and resolutions authorizing the
expenditure or collection of money, or the making of local improvements or repairs, or on any vote
whenever demanded by a member of the Common Council, and on the adoption, amendment or
repeal of any local law or ordinance.
B. The apportionment of the voting strength of the members of the Common Council shall be
determined by the 2010 federal census in the City of Hudson until the next decennial federal census,
in which event the voting strength shall be changed, if necessary, to conform to such decennial
federal census; excepting, however, should there be proposed an official special county census
subsequent to such federal decennial census, the Common Council may effect a reapportionment
which shall be in conformity with such official county census and such then applicable provisions
of law.
(1) The Common Council shall continue to consist of 11 members. Each of said 11 members shall
be entitled to cast at each special and regular meeting of the Common Council the number of votes
set forth opposite his respective ward or title and as applies to each voting situation as follows:

(2) Quorum.
(a) The attendance of members of the Common Council entitled to cast 1015 votes shall be
required to constitute a quorum at a general or special meeting which calls for the adoption
of any resolution, ordinance, local law, motion or proposal which requires a simple majority
vote of the Common Council under applicable provisions of law.
(b) The attendance of members of the Common Council entitled to cast 1,013 votes shall be
required to constitute a quorum at a general or special meeting which calls for the adoption
of any resolution, ordinance, local law, motion or proposal which requires a two-thirds vote
of the Common Council under applicable provisions of law.
(c) The attendance of members of the Common Council entitled to cast 1,011 votes shall be
required to constitute a quorum at a general or special meeting which calls for the adoption
of any resolution, ordinance, local law, motion or proposal which requires a three-fourths
vote of the Common Council under applicable provisions of law.
(3) The affirmative vote of those members of the Common Council entitled to cast a simple
majority of the weighted votes entitled to be exercised by the members assembled, provided a
quorum is present, as required by Subsection C(2) of this section, shall be required for the
adoption of any resolution or proposal which requires a simple majority vote under applicable
provisions of law.
(4) Notwithstanding any other provisions of this Charter, every member of the Common Council
serving on a committee of such Council shall be entitled to cast one vote as a member of said
committee.
(5) Where the weighted vote of aldermen from the same ward varies, the alderman with the higher
total electoral vote in the last election shall cast the greater weighted vote.

Section 3. Severability. If any clause, sentence, paragraph, section or part of this Local Law shall be
adjudged by any Court of competent jurisdiction to be invalid, such judgment shall not affect, impair
or invalidate the remainder thereof, but shall be confined to its operation in said clause, sentence,
paragraph, section or part of this Local Law.
Section 4. Conflicting Local Laws. All Local Laws or parts of Local Laws inconsistent herewith are
hereby repealed to the extent of such inconsistency.
Section 5. Form of Proposition. The question to be submitted to the electorate pursuant to Section 6
of this law shall read as follows:
The proposed amendment to Sections 1-4 and 12-13 of the City Charter of the City of
Hudson, New York, requires that the wards of the City of Hudson have substantially equal
populations, and revises the boundary lines of the existing five (5) wards of the City so that
each of the wards does have such a substantially equal population. The proposed
amendment also revises the voting procedure of its Common Council by changing the
number of votes the Members of the Common Council cast on all matters to one vote per
Member; changing accordingly the number of votes required for passage of matters before
the Common Council so that the calculation of the number of Common Council votes
needed to achieve a simple, two thirds or three quarters majority are based on each such
Member casting one vote out of the eleven (11) total Member votes of the Common
Council; and changing the number of Members of the Common Council required to be
present to have a quorum to the same number as the number of votes needed for passage
of matters by the Common Council. The proposed amendment further provides that to the
extent required by law, the Common Council shall revise the ward boundaries and
reapportion each of the five wards by July 1st of each year ending in “2” following each
decennial United States census. Shall the proposed amendment be approved?
Section 6. Effective Date. This Local Law shall not take effect until January 1, 2017 as to Section 1
hereof, and January 1, 2018 as to Section 2 hereof, after its approval by the affirmative vote of a
majority of the qualified electors of the City of Hudson voting upon a proposition for its approval by
referendum in conformity with the provisions of Section 37 of the NEW YORK MUNICIPAL HOME
RULE LAW.
Section 7. Conflicting Referenda. In the event there are one or more other proposals on the ballot,
pertaining to or addressing substantially the same issues as are contained in this law, then the
provisions of the proposal approved by the electorate receiving the greatest number of affirmative
votes shall prevail, and the alternative proposal, or proposals, as the case may be, shall be deemed
null and void.
(2) Severability of Petition. If any provisions of this petition shall be adjudged by any Court of competent
jurisdiction to be invalid or ineffective, in whole or in part, or inapplicable to any person or situation,
such holding shall not affect, impair or invalidate the remainder of this petition, and all other provisions
thereof shall nevertheless be separately and fully effective, and shall be applicable to all other persons or
situations.

3) Each of the undersigned states that he or she was a registered and qualified elector of the City of Hudson, at the last
general election held on November 3, 2015, that his or her present place of residence is truly stated opposite his or her
signature, and that he or she does hereby petition for the submission of the proposed local law set forth in this petition
to the electors of the City of Hudson to be held on November 8, 2016.
