ABOUT THE BILL
Title: The Anti-Political Dynasty Act
Author/s: Senator Miriam Defensor Santiago
PURPOSE OF THE BILL (3PTS)
To prohibit the establishment of political
dynasties in Philippine politics, and
guarantee equal access and opportunity
to public office. In addition, this will
prevent the monopoly of political power
and resources. This means that two or
more people who are related within the
second civil degree of consanguinity or
affinity cannot hold or run for an elective
office simultaneously within the same
province or occupy the same position
one after the other.
COMMENTS ABOUT THE
BILL (3 PTS)
The puspose of the bill is very helpful to
ensure that a family cannot abuse the use
of political power and public resources.
All important terms are defined clearly.
The persons covered by the bill is clearly
explained. The actions and processes
needed to do when the bill or prohibition
is violated are also explained clearly, but I
have some additions/changes that I will
state in the “personal amendments”
section. Finally, the implementation,
modification, and effectivity of the bill are
also stated and explained clearly.
PERSONAL AMMENDMENTS
(3PTS)
In addition to Section 4, a relative within the
second degree of consanguinity or affinity
must not be able to hold or run for any
elective position in the same province
immediately after the end of the term of an
incumbent elective official. Meaning, the
family must wait for at least one term after
the end of the term of the incumbent elective
official before a relative can run for any
position in the same province. Additionally,
this bill must apply to all positions, including
Punong Barangays or members of the
Sanguniang Barangay. Finally, the violators
of this prohibition must be automatically
disqualified even without a petition if the
connection within the second degree of
consanguinity or affinity is proven.
