The Public Health (Aerated Water and Ice) Rules.


(Under section 104 of the Act.)

1. Citation.

These Rules may be cited as the Public Health (Aerated Water and Ice)
Rules.

2. Interpretation.

In these Rules—
(a) “aerated water” means any kind of nonalcoholic liquid prepared
for food for humans and sold in bottles, syphons, casks or other
vessels;
(b) “aerated water factory” means any premises, or any part of the
premises, used or intended to be used for the manufacture of
aerated water;
(c) “authority” means a local authority;
(d) “employee” includes any person employed on any premises to
which these Rules apply, whether paid or unpaid;
(e) “ice” means water solidified by freezing and intended for sale to
the public and includes ice cream and water ice;
(f) “ice factory” means any premises, or any part of the premises,
used or intended to be used for the manufacture of ice for sale to
the public;
(g) “licensee” means a person holding a licence under these Rules.

3. Premises to be licensed.

(1) No premises shall be used as an aerated water factory or ice


factory unless they shall first have been licensed by an authority in the Form
B in the Schedule to these Rules.

(2) Every such licence shall be annual and shall expire on the 31st
December of the year in respect of which it is issued.
(3) No such licence shall be transferable.

4. Application for licence.

(1) Every application for a licence under these Rules shall be made
to the authority in the Form A in the Schedule to these Rules.

(2) The authority shall not issue a licence under these Rules unless
the applicant produces a certificate from a medical officer of health stating
that the premises in respect of which a licence is required are in conformity
with the requirements of these Rules.

5. Requirements in licensed premises.

In every factory licensed under these Rules, the following provisions shall be
complied with—
(a) the construction, situation, lighting, ventilation, drainage, sanitary
provision and state of repair of the premises shall be such as to
ensure, in the opinion of the authority, satisfactory sanitary
conditions in the premises and the purity and protection from
contamination of products made or kept in the premises; except
that the requirements of the authority in the foregoing respects
shall not be in conflict with or in excess of the requirements of
the Act or any rules made under the Act;
(b) there shall be provided a sufficient and pure supply of water
maintained or stored in such manner as to ensure protection from
contamination;
(c) sufficient accommodation and facilities for employees to wash
themselves and their overalls shall be provided;
(d) there shall be provided sufficient portable receptacles, of a size
and shape approved by the authority and fitted with good and
efficient lids, in which shall be placed all refuse from the factory;
(e) no part of any factory shall be used as or have direct
communication with a living or sleeping room;
(f) a dressing room or cupboard having facilities for employees to
store their overalls in a clean and sanitary condition shall be
provided and shall not be used for any other purpose;
(g) adequate facilities shall be provided for the handling, preparation
and storage of all articles used in the manufacture of aerated
water or ice in such manner as to protect them from
contamination;
(h) no cellar or basement shall be used for any of the purposes of the
manufacture of aerated water or ice;
(i) an efficient filter plant shall be provided to the satisfaction of the
authority; and
(j) sufficient tanks and apparatus shall be provided for the cleaning
and sterilising of all bottles and other utensils used in the
manufacture or storage of aerated water or ice and shall be of
such type and so situated as the authority may approve.

6. Duties of licensee.

Every licensee shall—


(a) at all times keep his or her premises in a state of cleanliness;
(b) cause the inside walls and ceilings of the factory to be surfaced,
to the satisfaction of the authority, with limewash or other
suitable material approved by the authority and shall so resurface
those walls and ceilings at such intervals as, in the opinion of the
authority, may be necessary to maintain cleanliness and freedom
from risk of contamination of the products made or kept in the
factory;
(c) provide and maintain on the premises adequate facilities for a
sufficient supply of hot water for the purposes of the factory;
(d) maintain the premises and any plant, filter or other thing used in
the manufacture of aerated water or ice in a clean and wholesome
state;
(e) ensure that all persons employed on his or her premises are clean
at all times while so employed and, if so required by the
authority, are dressed in clean white overalls made of washable
material and extending from the neck to the knees;
(f) use no bottles or containers that are not of a type which can easily
be cleaned;
(g) cause all bottles intended for the storage of aerated water to be
thoroughly cleaned and sterilised before use to the satisfaction of
the authority;
(h) ensure that all water used in the manufacture of aerated water or
ice is filtered and, if so required by the authority, boiled or
chlorinated before being filtered;
(i) at all times maintain on the premises a complete spare set of filter
candles in good condition;
(j) ensure that all filter candles in use are kept clean and removed
from their filters daily and boiled for not less than fifteen
minutes; and
(k) if so required by the authority, cause all water used for cleaning
bottles, utensils or any plant used in connection with the
manufacture of aerated water or ice to be boiled, chlorinated or
otherwise sterilised before use.

7. Infectious diseases.

(1) No person who to his or her knowledge is suffering from any


infectious or communicable disease shall work in or about any factory to
which these Rules apply or handle or assist in the preparation of any aerated
water or ice in the factory.

(2) Every licensee shall without delay inform a medical officer of


health of the occurrence or suspected occurrence of any infectious or
communicable disease among any of his or her employees and shall comply
with any directions which the medical officer of health may give for the
purpose of preventing the spread of any such disease.

8. Keeping of animals, etc. prohibited.

No animal or bird shall be kept or permitted to remain in any factory licensed


under these Rules.

9. Licence to be exhibited.

Every licensee shall affix and at all times maintain his or her licence in some
conspicuous place in his or her factory.

10. Other processes or trades prohibited.

No process or trade other than the making of aerated water or ice shall be
carried on in any aerated water factory or ice factory, as the case may be.

11. Responsibility for observance of rules.

Every licensee shall be responsible for the due observance on his or her
premises of these Rules, and any breach of these Rules committed by any
agent, servant or employee of the licensee shall be deemed to be a breach by
the licensee.
12. Revocation and suspension of licence.

If any person is convicted of an offence against these Rules, the court may,
in addition to or in substitution for any other penalty provided for the
offence, revoke or suspend for such time as it thinks fit any licence granted
to him or her under these Rules.
