3. That above mentioned brand / trade names are our brands and we are owner of
the same. To the best of our knowledge they do not resemble with any other
brand names used in India by any other person for Pharmaceutical or Food
supplement products. That uses of above listed brand/ trade names for our
products do not violet any provision of the Trade Marks Act, 1999 and Rules
made there under.
4. Enclosed here is declaration in form 51 duly signed as per Drugs and Cosmetic ~Q
Rules 1945 for submission to Licensing Authority A'

5. In case of any dispute or claim regarding Brand /Trade names with any thir Rogd'

party or any statutory authority, all liabilities- legal, financial, statutory and 0 1,
, expenses shall be solely that of M/sBIOVION PHARMA PVT LID. If Hirai Labs '/
Ltd. suffers any losses (Financial or otherwise) on account of such dispute then
BIOVION PHARMA PVT L TDundertakes to compensate all. such losses
incurred by Hirai LalJs Ltd. in ·this regards. That subsequent to manufacturing of
products under above ·tisted brand names if it is found to resemble with already
regiS.tered, existingor used brand names then Hirai Labs Limited may stop further
manufacturing of relevant brands and in such case we shall compensate Hirai
Labs Ltd. for unused packing materials of suchproducts.
 *6. That the packaging and get up (including color and design) of the proposed

brands and products will not be copied from any other products being

manufactured /marketed in India. In case of any dispute or claim regarding such
copy right and IP matters with any third party or statutory authority all liabilities-
legal, financial, statutory and expenses shall be solely that of M/sBIOVION
PHARMA PVT LTD. If Hirai Labs Ltd . suffers any losses (Financial or otherwise)
on account of such dispute then BIOVION PHARMA PVT L TDundertakes to
compensate all such losses incurred by Hirai Labs Ltd. in this regards.
