 ASSIGNMENT OF DECREE

THIS DEED OF ASSIGNMENT OF DECREE is made on 11.03.2022by and between :-

Suresh Kumar, son of Kamlesh Kumar residing at E-3 Arera Colony, Bhopal (MP)
hereinafter referred to as the assignor (which term shall include his successors-in-interest and
persons claiming under him).

And

Amar Singh, son of Vijay Singh residing at A-133 Neelbad, Bhopal (MP) hereinafter referred
to as the assignee (which term shall include his heirs, successors and assigns).

WHEREAS THE ASSIGNOR HAS TAKEN A SUM OF Rs,50,000 from the assignee as
aforesaid which is due on him( ASSIGNOR).

WHEREAS A DECREE IS PASSED IN FAVOUR OF THE ASSIGNOR WHO IS A

DECREE HOLDER TO GET A SUM OF Rs, 50,000 from the JUDGEMENT DEBTOR AS
Hereafter.

WHEREAS IN ORDER TO SET – OFF THE PREVIOUS CLAIM WHICH THE

ASSIGNEE HAS AGAINST THE ASSIGNOR , THE SAID ASSIGNOR THEREBY
TRANSFERS HIS DECREE OF A SUM OF Rs,50,000 to the ASSIGNEE TO SATISFY
THE AMOUNT WHICH HE HAS AGAINST THE ASSIGNOR.

WHEREAS the Assignor obtained a simple money decree in Suit No 245 of 2022 in the suit
of recovery of money before the Court of the Civil Judge Class-II, Arera Hills, Bhopal
decided on. 5.01.2022 against Arnesh Mishra son of Vivek Mishra residing at B-22 Malviya
Nagar, Bhopal (hereinafter referred to as the Judgement Debtor );
AND
WHEREAS the said Judgement Debtor. did not file any appeal and the said decree became
final;
AND
WHEREAS the Assignor is unable to execute the said decree on account of his continued
absence from India due to his getting a job in California, USA ,soon after the decree is passed
in his favour.
AND
WHEREAS if the said decree is not executed on or before 26.08.2022. it will become time-
barred;
AND
WHEREAS the sum of Rs 50,000 is now owing on account of principal, interest and cost on
the said decree;
AND

The said Suresh Kumar. has agreed to transfer the said decree to Amar Singh. for the sum of
Rs 50,000.

NOW, THIS DEED OF ASSIGNMENT WITNESSES that in pursuance of the said

agreement and in consideration of the said sum of Rs 50,000 the said Suresh Kumar. hereby
assigns unto the said Assignee ALL THAT sum of Rs 50,000 now owing on the said decree
and all future interest to become due and the full benefit of the said decree and judgment TO
HOLD unto the said Assignee the said decree and all interest, benefit and obligation
thereunder.

IN WITNESS WHEREOF THE PARTIES HERETO HAVE EXECUTED THESE

PRESENTS ON THE DAY, MONTH AND YEAR FIRST ABOVE-WRITTEN.
