ASSIGNMENT OF DECREE
Suresh Kumar, son of Kamlesh Kumar residing at E-3 Arera Colony, Bhopal (MP)
hereinafter referred to as the assignor (which term shall include his successors-in-interest and
persons claiming under him).
And
Amar Singh, son of Vijay Singh residing at A-133 Neelbad, Bhopal (MP) hereinafter referred
to as the assignee (which term shall include his heirs, successors and assigns).
WHEREAS THE ASSIGNOR HAS TAKEN A SUM OF Rs,50,000 from the assignee as
aforesaid which is due on him( ASSIGNOR).
WHEREAS the Assignor obtained a simple money decree in Suit No 245 of 2022 in the suit
of recovery of money before the Court of the Civil Judge Class-II, Arera Hills, Bhopal
decided on. 5.01.2022 against Arnesh Mishra son of Vivek Mishra residing at B-22 Malviya
Nagar, Bhopal (hereinafter referred to as the Judgement Debtor );
AND
WHEREAS the said Judgement Debtor. did not file any appeal and the said decree became
final;
AND
WHEREAS the Assignor is unable to execute the said decree on account of his continued
absence from India due to his getting a job in California, USA ,soon after the decree is passed
in his favour.
AND
WHEREAS if the said decree is not executed on or before 26.08.2022. it will become time-
barred;
AND
WHEREAS the sum of Rs 50,000 is now owing on account of principal, interest and cost on
the said decree;
AND
The said Suresh Kumar. has agreed to transfer the said decree to Amar Singh. for the sum of
Rs 50,000.
