PART I : PRELIMINARIES AND GENERAL (CIVIL WORKS)

1.1 SCOPE OF WORKS

The Works shall comprise the design, supply of all labour, materials, plant, equipment,
tools, temporary works, and any relevant matters pertaining to proper construction,
completion and maintenance of the Works as shown on the tender drawings and
amplified in the Schedule of Rates, all in accordance with the Conditions of Contract and
the Specifications.

The Works envisaged under the Contract should include design and construction of the
following :

a) Engaged a licensed surveyor (registered under the requirements of Act 458 of


the Licensed Land Surveyors Act 1958) to survey for the location and setting out
of lot boundary stones, roads, structures and building etc. as specified.

b) Engage approved consultants to carry out design work and prepare all civil /
structural / M&E drawings for submission to the relevant local authorities.

c) Carry out all site and soil investigation works.

d) All earthworks, including removal of topsoil prior to earthworks, topsoiling and


turfing, and any unsuitable materials for backfilling works.

e) Switch house and switchyard, including provision of granite stone chipping for
the switchyard.

f) Drainage works including design of drainage system, construction of culverts,


headwalls, block drains, kerbs and channels, catchpits etc.

g) All other external works including guardhouse, cable ductings and connection to
existing services.

h) All fencing and roadworks.

i) All mechanical and electrical works.

j) All landscaping works.

k) All works incidental to the project including any necessary modifications to be


carried out in accordance with the terms of the Contract and as per
Specifications.

1.2 DESIGN AND CONSTRUCTION

In complying with the requirements of the Specifications, with respect to both


arrangement and detail, design is to conform to the best current engineering practice
and shall incorporate the latest improvements of design.

All materials used under the Contract shall be new, of the best quality and workmanship
shall be of the highest quality. Any repair to defective parts shall not be permitted without
written instruction of the Engineer. The design of the switch house and switchgear
plinths and other associated works shall be in accordance to BS 8110-1 : 1997 and the
relevant Code of Practice.

The design shall generally comprise the following :

a) Site Preparation : Design formation levels of the site based on soil settlement
analysis, soil treatment carried out and information on flood situation at the area
for the last 50 years.

b) Substation building (Conventional “AIS” or “GIS”) designed accordingly for the


type of equipment to be installed complete with transformer bays and plinths.
The building shall consist of normal or piled foundation, and of reinforced
concrete (r.c.) floor slabs. The superstructure shall comprise of r.c. framing with
230mm brick walls and metal cladding for switchgear rooms; glass-panelled
windows according to suitability and requirements; P.C. ventilation blocks; fire-
rated roller shutters, aluminium or timber louvred doors; “double” roof system
using steel roof truss designed for safety according to suitability and
requirements.

All footings, beams, columns and column stumps, lintols, aprons, ramps, cable
trenches, cable slots, plinth foundations, staircases and all other associated
works shall be constructed in reinforced concrete.

c) External Works : Design all roads, road kerbs, soil drainage (including manhole,
septic tank and filter bed) spot and close turfing, drainage system, premix
asphalt macadam surfacing to road, chippings in transformer area or switchyard,
and landscaping works.

d) Construction of switchyard / building extension and / or remedial works where


required.

The Tenderers shall submit their proposed design of a typical substation based on the
switchgear manufacturer's drawings, loading diagram and the contract drawings. The
design should include all the associated structures and architectural work necessary for
the completion of the whole substation work. In case there are any details of
construction or materials which have not been referred to in the Specifications, the
Schedule of Rates or the tender drawings, but may be reasonably implied or inferred,
and considered essential to the completion of the works, these shall be deemed to be
included in the rates and prices named by the Contractor in the priced Bill of Quantities.

Not withstanding the acceptance of the design proposal by the Engineer, the
successful Tenderer shall be solely responsible for the adequacy of all the works
in the Contract and shall make good any works arising from inadequate
provisions.

1.3 PLAN APPROVAL

All works performed under the Contract shall comply in all respects with the relevant
Malaysian Standard (MS) or approved equivalent Standard, Specifications and Codes of
Practice and any requirements of the local authorities or service utilities in Malaysia. The
costs of the necessary approval of all design work under the Contract shall be deemed
to be included in the Contract Price. It is the responsibility of the Contractor to enter into
and expedite all correspondence for submission to the relevant authorities in connection
with the design approval prepared by the Contractor.

The Contractor shall be responsible for complying in all respect with any relevant local
Statutory Regulation By-Laws in connection with plan approval and services. The
submitting person involved (in submission of drawings to the authorities) shall supervise
the construction works. It is reminded that the submitting person must carry out or take
full charge of supervision of the works well before signing the Completion Certificate for
the Project as required in Section 71 of Road, Drainage and Building Act 1974 (including
the 1978 Amendments).

1.4 SAFETY REQUIREMENTS AT SITE

The Contractor shall provide a full time Safety Officer registered with the Department Of
Safety And Health (DOSH) at site. Maximum safety precautions consistent with good
practice in all site works must be afforded to personnel directly engaged on this
Contract. A Safety Manual shall be submitted by the Contractor to the Engineer for
approval before commencement of site work. All such safety requirements shall
conform strictly to the Factory And Machinery Act (FMA) 1967, and the
Occupational Safety And Health Act (OSHA) 1994 (or the latest revision).

Supervision at site by a competent and experienced supervisor who has a valid


Competency Certificate issued by the office of the Energy Commission of
Malaysia (“Pejabat Suruhanjaya Tenaga, Malaysia”) is a requirement. A certified
copy of the supervisor’s Certificate of Competency shall be submitted for
verification by the Engineer. The operation of or connections to any items of
equipment once made live shall be subjected to Tenaga Nasional Berhad (TNB)'s
Safety Regulations which require work permits to be issued by an Authorised Person
before any work can be carried out.

1.5 QUALITY ASSURANCE AND QUALITY CONTROL (QA/QC)

1.5.1 General

As a means of assuring that the performance of the Works fulfils the requirements of
the Contract, the Contractor shall establish and implement an approved Quality
Assurance and Quality Control (QA/QC) program. A Quality Manual shall be submitted
by the Contractor to the Engineer for approval before commencement of site work.

1.5.2 Inspection And Audits

The Contractor’s work and related records shall be subject to periodical inspection and
audit by the Engineer to assure compliance to the QA/QC program that was set up. A
request for corrective action may be issued by the Engineer upon detection of non-
compliance by the Contractor. The Contractor shall correct in timely manner all such
deficiencies that were identified.

1.5.3 Rejection

All materials or equipment furnished and delivered under the Contract shall be subject to
inspection. If any items or articles are found not to meet the Specifications, the item or
any faulty portion thereof shall be rejected. The fact that the materials or equipment
have initially been successfully inspected, tested and accepted by the Engineer shall not
relieve the Contractor of responsibility to make good any defects before Taking-Over
Certificate (TOC) is issued.

1.5.4 Inspection And Testing Prior To Delivery

Inspections by the Engineer at the Contractor’s mill, factory, yard or warehouse shall be
in accordance with the following conditions :-

a) Access
The Purchaser or his representative shall have the right to inspect the
Contractor’s or sub-contractor’s work during manufacture and undertake such
tests from time to time as deemed advisable, provided no delay in production of
acceptable materials or equipment is caused thereby. The Contractor shall
furnish, at his own expense, reasonable facilities including tools and
instrumentation for such inspections.

b) Witness Tests

Mill or factory witness tests, shall be made in the presence of the Engineer. All
related costs related to the tests shall be borne by the Contractor, except for the
compensation and expenses incurred by the Engineer. If the component or
material to be inspected or tested is not ready at the time specified by the
Contractor, or if the component or material fails the test carried out, any
additional costs incurred to the Purchaser from these delays shall be charged to
the Contractor.

c) Receipt Inspection

All materials or equipment purchased under the Contract may be inspected at


the specified receiving points, and there be accepted or rejected by the
Engineer. Inspection will include the necessary testing for determining
compliance with the Specifications. All expense of initial acceptance tests shall
be included in the Contract. The expense of subsequent tests due to failure of
materials or equipment first offered will be charged against the Contractor.

d) Quality Assurance (QA)

The Contractor shall maintain a QA program which specifies that all equipment,
materials, and services under the Contract, whether manufactured or performed
within the Contractor’s plant or at any other source, shall be controlled at all
points necessary to assure conformance to Contractual requirements. The QA
program shall provide for the prevention and ready detection of discrepancies,
and for timely and positive corrective action. If required, the Contractor shall
make objective evidence of quality conformance readily available to the
Engineer. All instructions and records for quality assurance must be controlled
and kept by the Contractor.

e) Release For Shipment

The Contractor shall not ship materials or equipment until they are released by
the Engineer. The Contractor shall notify the Engineer in advance of any
shipment.

1.6 SERVICES

1.6.1 Contractor’s Living Accommodation

The Contractor shall make all arrangements necessary with regards to accommodation
for his staff or labour, either foreign or locally-recruited, during site construction works.

1.6.2 Site Office

The Contractor shall provide such temporary buildings as may be necessary for office
accommodation for the Contractor's engineers and site staff during the erection of the
Works. At least one room, complete with one(1) set of tables, chairs, cabinets and
reliable communication equipment shall be reserved solely for the use of the
Purchaser's supervisory site staff as a site office. The cost of all these shall be deemed
to be included in the Contract Price.

1.6.3 Storage Facilities

The Contractor shall furnish and maintain during the Contract period all living
accomodation, sheds, stores and workshops necessary for the execution of the
Works, and shall make his own arrangements, subject to the approval of the
Engineer, with the owner of any land required and, if necessary, pay for its use. The
Contractor shall, except when authorised by the Engineer, confine his labour, materials
and equipment to within the area of which he is given possession. The Contractor shall
not use any part of the site for any purposes not connected with the Works unless prior
written consent of the Engineer has been obtained.

1.7 CONSTRUCTION UTILITIES

All construction utilities required for the Contractor’s site staff (including the site
office) and undertaking of the Works shall be provided and be the responsibility
of the Contractor. All related costs shall be deemed included in the Contract
Price.

The required utilities shall include the following :-


a) Telephone and other site communication requirements.
b) Temporary power facilities.
c) Temporary lighting : conductors shall not be less than 12 AWG copper, and be
insulated for 600 volts. A fuse shall be provided for the protection of each circuit.
d) Water for construction use and drinking (including related piping, hoses and valves.
e) Sanitary facilities, including provision of chemical toilets at site.
f) First aid facilities.
g) Trash disposal, including removal of any construction debris from site at weekly
intervals.
h) Fire protection (all insurance requirements must be met).

The Contractor shall not be allowed to commence the Works until such provision for
electricity and water is made available at Site. All costs with regards to installation, use
and termination of the electricity and water supply are deemed to be the Contractor’s
responsibility.

1.8 SUBSURFACE INVESTIGATION

During tendering stage, the Contractor shall ascertain, at his own cost, the accuracy
and the relevance of all soil data, including initial recording of subsoil by any approved
methods, with respect to the Works. Any or all interpretations, assumptions,
extrapolations, and interpolations that the Contractor may wish to make shall be his sole
responsibility. To enable the foundation programme to be completed, each substation
site shall be investigated by boreholes (quantity as specified in the Technical Schedules)
and standard penetrometer tests in areas of non-cohesive soils, i.e. sand / gravels, or a
shear vane test in areas of cohesive soil. Each test shall be carried out at intervals not
exceeding 1500mm and to a depth of N=50 blows repeated three times on bedrock. In
addition, ground water level shall be observed and measured, and the sample of soil
collected tested using the following laboratory tests :

a) Moisture - Density Analysis,


b) Grain-Size Analysis,
c) Atterberg Limits, and
d) pH and soluble sulphates
Any undisturbed samples shall be collected for Undrained Triaxial Compression tests.

Unless otherwise specified, the works included in the site investigation shall be carried
out in accordance with BS5930 : 1999 “Code of Practice of Site Investigation” and
BS1377 : 1990 “Methods of Test of Soil for Civil Engineering Purposes”. Any soil
investigation works shall be carried out by an approved geotechnical consultant or
specialist. The final certified results of all soil tests shall be submitted to the Purchaser
for review and approval.

1.9 INSPECTION OF SITE

The Contractor shall visit and examine the Site and its surroundings and shall satisfy
himself, before submitting his Tender, as to the nature, extent and practicability of the
Works. These will include the nature of the ground and subsoil ( so far as is practicable
), the form and nature of the proposed Site, the quantities and nature of the work and
materials necessary for the completion of the Works and the means of access to the
Site, the accomodation he may require for his labour and, in general, shall obtain for
himself all necessary information ( subject as above-mentioned ) as to the risks,
contigencies and other circumstances which may influence or affect his Tender.

No claims for additional costs shall be entertained and allowed by the Engineer
on the grounds of ignorance of the conditions under which the works will be
executed.

1.10 CONSTRUCTION PROGRAMME

Within a month after the date of notification of Tender Acceptance, the Contractor shall
prepare and submit for the Engineer’s approval, three (3) copies, a detailed construction
programme showing his proposals, time periods, allocations of skilled and unskilled
labour, supervision, construction plant and materials for carrying out the various sections
of the Works and the overall completion time.
After receiving the approval of the Engineer to the programme, it shall become the
approved Programme of Works and no deviation shall be made by the Contractor
without the approval in writing of the Engineer.
Should at any time the actual work progress fall behind the time periods shown in the
approved Programme of Works, the Contractor shall take such steps and employ such
methods as to enable him to catch up on the programme. These to be in accordance
with the requirements and the approval of the Engineer. The approval of the detailed
construction programme by the Engineer shall not relieve the Contractor of any of his
duties or responsibilities under the Contract.
If the Contractor is prevented from starting on any part of the work earlier than as shown
on the approved Programme of Works, this shall not be considered a ground for
granting of Extension of Time and no additional costs shall be deemed to have arisen.

1.11 SURVEY AND SETTING OUT

The Contractor, before commencing works, shall survey the whole site to check on the
accuracy of the lines, levels, etc. as shown on the tender drawings to ensure that any
discrepancies are corrected before construction begins. Any discrepancies detected
during survey shall be reported immediately to the Engineer for appropriate action.

The Contractor shall arrange for the whole of the Works to be carefully set out and
frequently checked by a qualified Surveyor (registered under the requirements of Act
458 of the Licensed Land Surveyors Act 1958) to ensure accuracy of the lines and
levels, and shall provide all instruments and attendants required by the Engineer for
checking of survey results. Any setting out disturbed during the course of the Works
shall be re-established at the Contractor's expense. Notwithstanding whatever
assistance or checks on the setting out by the Engineer, the Contractor shall not be
relieved of his responsibility for the correctness of the setting out and levelling. The
Contractor shall remedy at his own cost any work wrongly performed as a result of
incorrect setting out or levelling.

The Contractor shall supply pegs, steel pins, sight rails, batter boards, templates etc.
necessary in the setting out and checking of the Works to the Engineer's satisfaction.
The Contractor shall take all practical steps to safeguard the setting out marks including
fencing and concreting where necessary in the opinion of the Engineer.

The Contractor shall supply the Engineer with records in approved forms relating to all
reference pegs and benchmarks, and shall keep such records up to date by formal
notice to the Engineer. All pegs shall be painted with such distinguishing colours as
approved by the Engineer. All survey reference pegs shall be carefully preserved except
where construction requires their removal, and before such removal the approval of the
Engineer shall be obtained.

Before commencing and immediately after completion of excavation or embankment for


which payment is to be made by quantities to be measured by survey method, the
Contractor shall take survey measurements sufficient to define the dimensions and
elevations of the original and final surfaces. Measurements which are to be the basis of
quantities for claim for payment shall be taken only in the presence of the Engineer. The
Contractor shall notify the Engineer of his intention to take such measurements not less
than 24 hours beforehand. The Contractor shall produce earthworks cross sections at
distance intervals to be agreed by the Engineer.

Where centre lines have been fixed, and running chainage established, the line of each
25 metres cross-section shall be fixed with reference pegs placed in a protected place
on each side of the centre line peg, the three (3) pegs to be in straight line, and the
distance between the centre line pegs and the reference pegs is to be recorded. The
running chainage is to be clearly indicated so as to be visible at a distance. Where
precise information as to the lines and levels of drainage works and retaining walls is not
indicated on the tender drawings, the position of the centre line and levels of such
works shall be agreed on site with the Engineer before such works are commenced.

The Contractor shall make due allowance in his rates for any adjustment which may be
needed in the setting out of Works, should the measurements or levels obtained by him,
as required by this sub-Clause, differ from those provided by the Engineer.

1.12 ASSISTANCE TO ENGINEER’S SUPERVISORY STAFF

The Contractor shall render all necessary assistance to the Engineer and supply all
labour, survey instrumentation and materials required by the Engineer for carrying out
his duties of inspection, supervision, checking and measurement of the Works.

The Contractor shall provide and maintain a sufficient supply of pegs, poles, string lines,
paint, spirit levels, and all other tools necessary for setting out the Works. All wages and
expenses incurred in connection with the above shall be borne by the Contractor.

1.13 UNITS OF MEASUREMENT

All units of measurement used in the Specification and the Bills of Quantities shall be in
accordance with the S.I. Metric System units. The Contractor must be careful during the
pricing of items in the Schedule of Rates as no claims for additional costs will be
entertained and allowed by the Engineer on the ground of ignorance or misinterpretation
of the units.

The Contractor shall take note that some of the survey information are in imperial units,
thus conversions shall be carried out wherever necessary according to the following
conversion table :

1.14 MALAYSIAN STANDARDS

The Contractor’s attention is drawn that, where applicable, all goods, materials and
workmanship are to conform to the latest relevant Malaysian Standard (MS) or approved
equivalent Standard or Code of Practice.

1.15 MATERIALS AND WORKMANSHIP

Materials and workmanship throughout the Works shall be of the highest quality.
Materials and workmanship shall comply with the Malaysian or British Standards (MS
or BS) and Codes of Practice, where applicable, and shall be approved by the
Engineer. Where in the Specifications any proprietary goods or materials are
specified, goods or materials of alternative manufacture may be considered for
acceptance provided they comply in all respect as regards appearance and quality
and are approved by the Engineer. In the event of the Engineer allowing for the
replacement of any of the materials during the Contract, this shall be accompanied
by a corresponding deduction in cost unless the Engineer otherwise directs.
Materials shall be transported, handled and stored in a manner as to prevent damage
or deterioration.

1.16 SUPPLY OF MATERIALS, ETC.

The Contractor shall place orders for specified materials at the earliest possible date
after the acceptance of his Tender. If the Contractor's failure to supply any material
causes any interruption or delay in the progress of the Works, the Employer may supply
portion(s) or all of the materials and the cost to be borne by the Contractor. On this
matter, the rates shall be either as calculated at the current market rates or the actual
cost to the Purchaser at the date of supply, including overhead or any other charges,
whichever is the greater.

Samples

The Contractor shall submit samples of materials and fittings for approval as and when
required by the Engineer or Purchaser. All approved samples shall indicate the relevant
Standards to be maintained in the execution of the Works and materials which are
rejected shall not be brought onto the site.

Inspections and Tests

The Engineer may inspect and test any materials or goods required in or for the Works
from time to time and shall have unrestricted access to the Contractor's, sub-
Contractors' and suppliers' premises for such purpose during all normal working hours.

The Contractor shall provide the Engineer all facilities, labour and assistance necessary
for the convenient examination, testing, weighing or analysis of all such materials or
goods. For any tests which may have been carried out off Site, the Engineer shall be
empowered to order further tests of any materials or goods to be made on Site and to
reject such materials or goods should they fail to pass such tests on Site. The full cost of
providing all facilities and labour required in connection with all testing and analysis shall
be deemed to be included in the tendered rates and prices.

Testing at Approved Laboratories ( as directed by Engineer)

Testing which cannot be done at Site shall be carried out at approved laboratories and
shall be carried out as directed by the Engineer. Payment shall be made for actual costs
of tests incurred. Other costs and overheads incurred by the Contractor shall be deemed
to be included in the Contract Price.

1.17 CONTRACTOR'
S SITE REPRESENTATIVE

A competent, duly authorised representative of the Contractor whose name and


qualifications shall be submitted to and approved in writing by the Engineer prior to his
appointment. The Contractos’ Site Representative shall have full authority to act on
behalf of the Contractor and shall reside in the vicinity of the Works. He/she shall attend
at the Engineer's office at all reasonable times when required to do so. All written
correspondences shall be conducted in the English Language.

The Contractor’s Site Representative shall be stationed on Site for the duration of the
Contract. The Engineer shall be informed in writing whenever the Site representative is
to be absent from Site. Where the Contractor desires to change his site representative,
the name and qualifications of the proposed replacement shall be submitted to the
Engineer for approval.

The Contractor shall be responsible for arranging, with the appropriate authorities, all
temporary and permanent diversions required with regards to the Works. The Contractor
shall inform the Engineer of all the relevant negotiations and no final arrangements shall
be made without the approval of the Engineer.

The Contractor shall ensure that his programme of the Works executed under the
Contract is compatible with the requirements of the authorities concerned and the
provisions of the Contract. The Contractor must co-ordinate all diversion operations with
the remainder of the Works in close liaison with the relevant authorities concerned and
shall make adjustments to his programme, from time to time, as necessary, to
accommodate the actual progress of work.

The Contractor shall appoint and employ throughout the period of the works a full-time
engineer who is competent and suitably experienced in planning, coordinating and
getting design approval on all the temporary and permanent construction and diversion
of roads, accesses, drainage systems, services and railways, if any. He shall be
designated the Contractor' s Liaison Engineer. The Contractor shall be responsible for
complying in all respect with any relevant local Statutory Regulation By-Laws in
connection with plan approval and services.

1.19 DAILY AND MONTHLY REPORTS

The Contractor shall submit to the Engineer or his representative daily return or report of
the Works reporting on the exact number of types of plant working, hours of actual
working of each plant, hours of breakdown or idling plant and reasons for such, the
actual number of men of all grades, and trades working, weather conditions, the
occurrance of accidents or the like and any other relevant information related to the
execution and progress of the Works. Such daily return shall be submitted and delivered
to the Engineer or his representative not later than 5.00 p.m. in respect of the previous
day.

At the end of each calendar month, the Contractor shall summarise all daily reports of
the month concerned, submit and deliver each monthly report to the Engineer or his
representatives not later than third day of the month. The Engineer reserves the right
and power to direct the Contractor to include any additional information as the Engineer
deems necessary in the foresaid daily and monthly reports.

1.20 PROVISION OF PLANT AND TEMPORARY WORKS

The Contractor shall provide, at his own expense, all necessary plant and temporary
works required for proper execution, completion and maintenance of the Works, and the
arrangement shall be such that damaged plant and temporary works can be made good
or replaced forthwith to avoid any delay in the Works. The Contractor shall be solely
responsible for the safe custody of the plant and material on Site and shall therefore
provide all necessary security arrangements in respect thereof.

The Contractor shall provide, maintain and remove on completion of the Works, all
temporary works including roadways, tracks, staging, bridging, etc. and shall make them
safe and suitable in every respect to carry all plant and materials required for the work or
for providing access or for any other purpose. The temporary works shall be
constructed, maintained and removed to the satisfaction of the Engineer. The Contractor
shall also provide in his Tender the cost for removal of any rubbish, spoils, debris and
the like from Site.

1.21 PUBLIC UTILITY AND PRIVATE SERVICES

Prior to tendering, the Contractor shall determine the extent of the private and public
utilities which may affect and / or obstruct the Works. The Contractor shall be
responsible for locating the position of all services, including mains, overhead and
underground cables, pipes, sewers and drains, and where necessary shall adopt such
methods of excavation to ensure that no damage is caused to them. Where damages to
such services occur, the Contractor shall immediately inform the Engineer and the
appropriate authorities or owners concerned.
Before commencing any excavation works, the Contractor shall ensure from the various
utility authorities that no underground services are present at or in the vicinity of such
excavation.
It shall be the Contractor’s responsibility to make good any damage to any existing
underground services caused by him to the complete satisfaction and in accordance
with the requirements of the appropriate authorities or owners concerned. The
Contractor shall keep the Purchaser indemnified at all times from all claims, costs and
expenses which may be brought against or incurred to the Purchaser for or on account
of any damage ( whether permanent, temporary or recurring ) to the said services.

Where during excavation works, the Contractor uncovers any underground services,
work shall be stopped immediately and shall not re-commence until the matter has been
reported to the Engineer, who will then issue the necessary instruction.

All services encountered during the course of the Works shall be adequately supported,
slung up, strutted or otherwise protected from injury to the satisfaction of the persons
or authority in whom they may be vested.

The Contractor shall be responsible for any safety matters with regards to his Works and
labour.

Due allowance shall be made by the Contractor for any alterations to existing public and
private mains, and services caused by the Works. The Contractor must ensure that
existing mains and services are not interrupted without the written consent of the
appropriate authority or the owner of the services concerned.

1.22 MAINTENANCE OF EXISTING FACILITIES

No public or private facility shall be interrupted without the prior written permission of the
Engineer. Such permission will not be given until suitable permanent or temporary
alternatives, approved by the Engineer, have been provided by the Contractor or, in the
case of accommodation works, by the owner of the facility or his agent.

The Contractor shall maintain all existing drainage flows. Where the flows from existing
drains and culverts interfere with the normal progress of the Works, the Contractor shall
carry out all necessary temporary works to divert and maintain the flows at his own
costs. Where the Contractor proposes to construct temporary channels, culverts or
outfalls, he shall submit full details to the Engineer for approval. No temporary drainage
channels, culverts or outfalls may be put into operation without the written approval of
the Engineer.

The Contractor shall maintain all existing streetlighting and where the particular service
is in the way of construction, it shall be relocated subject to the approval of the Engineer,
and the relevant authorities. Any damage to any existing services, breaking up of
pavement etc. shall be made good by the Contractor at his own cost.

The Contractor shall be responsible for any damage caused by his Works to any
existing roads or culverts, and shall repair the damage to the satisfaction of the Engineer
and, in addition shall keep such roads clear of slurry, boulders and loose earth resulting
from the Works. Should the Contractor fail to maintain, repair or reinstate the affected
roads, the cost of such maintenance and restoration shall be deducted from monies due
to the Contractor under the Contract.

The Contractor shall arrange for the conveyance of materials, plant etc. so as to cause
minimum damage to existing roads and culverts, and minimum inconvenience to the
public. The Contractor shall not deposit any earth, rubbish or materials on any road,
street, pavement or footway which may lead to the obstruction of vehicles or
pedestrians. All highway drains, ditches and grips shall be kept clear of any spoil, mud,
slurry or material brought on the road. In addition, the Contractor shall construct, at his
own expense, silt traps to prevent the earth from flowing down into drains during rainy
periods.

1.23 MAINTENANCE AND PROTECTION OF TRAFFIC

The Contractor shall keep all existing roads and adjacent main roads or highways, to
and from Site, open to traffic during the undertaking of the Works, unless otherwise
instructed in writing by the Engineer.

The Contractor shall be responsible in ensuring, at all times, the safety of pedestrians
and residents along and adjacent to the Site, and shall conform to the requirements of
the relevant local Statutory Authorities concerning the control of traffic to and from the
Site. No construction materials shall be allowed to stack adjacent to any existing or
temporary roads or highways.
The Contractor shall be responsible in ensuring that all excavations near busy roads be
adequately strutted and shored against any live or dead loads, and all such excavations
be guarded with suitable barriers and lit up at night.

1.24 TEMPORARY TRAFFIC SIGNS, BARRICADES, SIGNALS, ETC.

The Contractor shall provide, and maintain on Site, and at any points leading to and
from the Site, adequate temporary traffic signs, barricades, signals or warning lights in
complying with the requirements of the Roads Traffic Ordinance Act, 1958. The
Purchaser or Engineer reserves the right to suspend any works or outstanding
payments to the Contractor until satisfactory compliance with the requirements as
desired under this Clause. Any losses incurred on the matter arising out of any
suspension of the Works shall be borne by the Contractor.

Where suspension of the Works occur, the Contractor shall only be permitted to re-
commence the Works upon satisfaction of the Engineer that that adequate numbers of
barricades, warning lights and signs as described above have been provided and are
stored ready for use on the Site.

The cost of these temporary signs, barricades, signals and lights and all attendant costs
such as supply, installation, maintenance, replacement and labour charges shall be
deemed to have been included in the Contract Price.

1.25 TEMPORARY DIVERSION OF TRAFFIC

The Contractor shall be responsible for providing temporary traffic diversion whenever
the Site is intersected by existing public and private roads, highways, footpaths, cycle
tracks, estate and temporary accesses, and accommodation roads. The diversion roads
shall be suitable for all types and classes of vehicles, and regularly maintained in
satisfactory condition to the approval of the Engineer.

The Contractor shall provide the Engineer with full details of any alignment construction,
lighting, signing, signal and safety at each and every stage of the construction of the
Works, and with his proposals for putting each new diversion/
partial closure of highway into operation. The Contractor shall be responsible for the
construction and maintenance of all traffic diversions or partial closure of any roads in all
aspects including all signs, lighting and signals, traffic barricades and cones.

Approval From The Authorities

Prior approval shall be obtained for any proposal to new diversions and partial closure of
any highway or roads. The Contractor shall submit full detailed plans and alignment of
his proposed traffic flow diversions and partial closure and excavation of road pavement
to the relevant authorities for their approval. These details shall be subject to the
approval of the Engineer, and the Police Department.

1.26 LIMITED WORKING HOURS

The Contractor shall be required to carry out works at night when it is deemed
necessary by the Engineer. During any night works, it is the Contractor’s responsibility to
install sufficient lighting at the working area for safe working condition. No claims arising
from any loss of liability suffered by the Contractor in compliance with this Clause shall
be entertained as all claims under this Clause shall be deemed to be included in the
prices and rates inserted by the Contractor in the Bills of Quantities.

1.27 SAFEGUARDING THE WORKS

The Contractor shall allow for the safeguarding of the Works, materials and plants
against damage or theft, and provide adequate lighting to the satisfaction of the
Engineer for the security of the Works and protection to the public.

The Contractor, upon completion of any part of the Works, shall immediately, at his own
expense, backfill any excavations or trenches related to the Works, and shall dispose of
all rubbish and leftover materials no longer required for any future works.

1.28 DAMAGE TO ADJACENT PROPERTY

The Contractor shall ensure that during all stages of the Works, adjacent properties to
the Site shall not be damaged, destroyed, or flooded. Any claims for compensation by
any of the above-mentioned property owners for damage incurred to their land shall be
borne by the Contractor.

1.29 ACCESS TO SITE

The Contractor shall at the time of the Tender determine the nature of available access
routes to Site and shall make his own arrangement with the relevant local authorities
and landowners for the use of such access. Where trenches have to be crossed,
adequate timber bridges shall be erected and maintained, to the satisfaction of the
Engineer, throughout the period of the Works.

1.30 OTHER CONTRACTORS ON SITE

The Contractor shall, in accordance with the requirements of the Engineer, afford all
reasonable opportunities for carrying out their work to any other contractors employed
by the Purchaser, the workmen of the Purchaser and any other duly constituted
authorities who may be employed in the execution on or near the Site of any work not
included in the Contract or any contract which the Purchaser may enter into on
connection with or ancillary to the Works.

1.31 FIRE HYDRANTS

The Contractor shall inform the Engineer before any work commences in the vicinity of a
fire hydrant and shall maintain, at his own expense, sufficient working space for the Fire
Services Department to have ease of use and access. The Contractor shall be
responsible for any damage to fire hydrants in the course of his work and shall maintain
in good working condition both the fire hydrant markers and sumps.

1.32 BUSHES, SHRUBS AND TREES

The Contractor shall preserve and maintain, where possible, and not cut down any
plants or trees without the prior permission of the Engineer. The Contractor shall make
efforts and precautions to ensure that these plants or trees are not damage during the
course of construction by his workers or equipment. Where any plants or trees are
damaged, it shall be the Contractor's responsibiity to make good, reinstate or
compensate for the re-planting of these plants and trees.

1.33 PREVENTION OF STAGNANT WATER

The Contractor shall keep the whole of the Works well drained throughout the Contract
period and shall ensure that, where possible, all work is carried out in the dry. The
Contractor shall carry out any pumping works, where necessary, to prevent excessive
surface water from the Works when construction is in progress.

The Contractor shall be held responsible for the sufficiency of the arrangements made
for the exclusion of water from the Works and shall be liable for keeping the Works safe
during periods of heavy rainfall and for making good any damage incurred to the Works
that may be attributable to bad weather. Any loss of production or any additional costs or
overheads that may result from heavy rainfall shall be borne by the Contractor.

Mosquito Prevention

The Contractor shall keep all areas at Site, where water can stagnate or accumulate,
free from the breeding of mosquitoes by taking preventive measures as may be deemed
necessary or desirable by the Engineer and shall pay all costs or charges which may be
incurred due to the requirements set by the relevant Statutory Authorities concerned for
any anti-malaria or anti-dengue measures taken.

1.34 HOARDING

The Contractor shall allow for the erection of any timber hoarding complete with gates as
shown on the tender drawings or as directed by the Engineer. Any proposed hoarding
shall be painted with two coats of approved paint on all sides including all graphic
presentation to the approval of the Engineer. The Contractor shall allow for paying of all
fees, obtaining approvals from relevant authorities and maintaining the hoarding in a
safe and presentable conditions throughout the Contract period.

The Contractor shall not use any area outside the hoarding for the parking of any
equipment or plant or stockpiling of materials, and shall form gateways, where
necessary at his own expense, for access to his Works.

1.35 CLEARANCE OF SITE

a) The Contractor shall at all times keep the Site affected by his operations free
from any obstruction of the Works. The Contractor shall at any time if directed by
the Engineer clear away and remove from the Site any redundant construction
plant, surplus materials, rubbish and temporary works no longer required and
leave the part of the Site affected clean and tidy to the satisfaction of the
Engineer.

b) Upon completion of the Works and before the issuance of the Certificate of
Completion, the Contractor shall remove from the Site, all construction plants,
surplus material, rubbish and temporary works of every kind and leave the whole
of the Site and Works clean and in a workmanlike condition to the satisfaction of
the Engineer.

All work done under this clause shall be deemed to have been included in the prices and
rates inserted by the Contractor in the Bills of Quantities.
No structure, either temporary or permanent, shall be built on Site by the Contractor
during the course of construction unless permitted by the Engineer. Where any
unapproved structure of any kind is constructed by the Contractor or his appointed
agent, the Contractor shall remove the entire structure upon the completion of the works.

1.36 PROJECT SIGNBOARDS

The Contractor shall provide and erect signboards to dimensions as per the tender
drawings, and subject to the requirements of the local Authority. The sole right of
advertising upon or adjacent to the Works is reserved to the Purchaser and the
Contractor shall not allow any unauthorised advertisement to be displayed without the
consent in writing of the Purchaser.

1.37 CONTRACTOR'
S RESPONSIBILITIES

The Contract is to include the whole of the Works which are described in or implied
by the Contract Document. All matters omitted from the Contract Document, which may
be inferred to be obviously necessary for the efficiency, stability and completion of the
Works, shall be deemed to be included in the Contract Price.

Works shown in the tender drawings and not described in the Specification and vice
versa, shall be deemed to be included in the Contract and their execution covered by the
Contract Price in the same manner as shown in the tender drawings or described in the
Specification.

The Contractor's nominated site representatives shall be given full responsibility to enter
into any negotiations with the Engineer with regards to matters or problems arising out of
the Works. The Contractor shall inform the Engineer in writing on this matter where such
nomination of representative occurs. All works on Site shall be supervised throughout by
qualified representatives of the Contractor who have thorough experience in erecting
and commissioning of similar works. Unless otherwise specified, the Contractor is to
supply the whole of the labour and equipment required for the completion of the Works.

1.38 DRAWINGS

All tender drawings are for tender purposes only. They are indicative of work
required for pricing in the Tender. The successful tenderer shall be then required to
prepare detail working drawings based on the tender drawings to ensure compliance in
all respects with relevant Statutory Codes, Rules and Authority requirements.

1.39 WORKING DRAWINGS

Working drawings to be used are to be submitted in duplicate to the Purchaser for


approval before commencement of the Works. The following working drawings are to
submitted for approval :

a) Design calculation.
b) Location plan and key plan.
c) Layout plan.
d) Road and drainage details.
e) Reinforced concrete culvert details.
f) Details of mild steel gates and fencing.
g) Water and sanitary layout, schematic water supply and diagramatic sanitary
layout.
h) Architectural ground, first floor and roof plans and sections.
i) Architectural elevations and sections.
j) Window details.
k) Door details.
l) Toilet and ceiling details.
m) Staircase details.
n) Footing details, cable slot and reinforced concrete ramp details.
o) Beam details.
p) Slab details
q) Roof truss details.
r) Reinforced concrete gutter and roof details.
s) Fire fighting and air conditioning service layout plans.
t) Lighting and small power schematic wiring layout diagram.
u) Switchgear plinths layout and details.
v) Landscaping details.

Upon approval of the working drawings by the Purchaser, the Contractor shall supply
the Purchaser with three complete sets of all drawings or revised drawings on medium
or airmail paper. Further copies of particular drawings are to be provided when required.

Where the Contractor requires early approval of any drawings to avoid delay in the
delivery of the Contract Works, he is to advise the Purchaser to such effect when
submitting the drawing. Any approval of the working drawings shall not relieve the
Contractor from any responsibility in connection with the Works.

The Contractor shall prepare and submit to the Engineer for approval a
preliminary taking off of all the materials required as set forth in the Schedule of
Rates. No construction works shall be carried out at Site before approval is given
by the Engineer.

After all items of work have been completed, one “true to scale” on approved translucent
material and one white print on linen from such drawings, to show details and
arrangements of work as constructed, shall be supplied to the Purchaser by the
Contractor.
