MOTION TO DECLARE THE DEFENDANT IN DEFAULT

PLAINTIFF, through counsel, most respectfully, state that:

1. As per the Sheriff’s Return, the defendant, Mitch Santos, was served
and personally received a summons with the attached copy of the
Complaint on April 15, 2022.

2. That said summons ordered the defendant to file her Answer thirty (30)
days from the receipt of the summons.

3. That said defendant failed to file her answer up to May 20, 2022, or
beyond thirty (30) days period, considering the failure of the defendant
to file her Answer, pursuant to the Rules of Court, the defendant should
be declared in default.

PRAYER
WHEREFORE, it is most respectfully prayed that the defendant, Mitch
Santos, be declared in default and that judgment be rendered against said
defendant, granting all the reliefs prayed for in the complaint.
