Intramuros, Manila DEPARTMENT ORDER NO. 434 Series of 2022 CLARIFICATION ON WORKERS COVERED UNDER DOLE DEPARTMENT ORDER NO. 222-21, OR THE REVISED GUIDELINES IN THE IMPLEMENATION OF THE SOCIAL AMELIORATION AND WELFARE PROGRAM FOR WORKERS IN THE BIOFUEL INDUSTRY, UTILIZING MOLASSES AS FEEDSTOCK Pursuant to Section 11 (e) and 17 of Republic Act No. 9367, otherwise known as the Biofuels Act of 2006, its implementing rules and regulations, DOE Department Circular No. 2007-05-0008, and JAO No. 2008-01, series 2008 (or the Guidelines Governing the Biofuel Feedstock Production, and Biofuel and Biofuels Blend Production, Distribution, and Sale under RA 9367), and DOLE Department Order (D.0.) No. 222-21, this Guidelines is made to clarify bioethanol workers' entitled to receive benefits under the Social Amelioration and Welfare Program for Biofuel Workers, utilizing molasses as feedstock Section 1. Covered Workers. Bioethanol plant workers, as defined under DOLE D.O. No. 221-21, are the following: a. All rank and file employees directly employed by the bioethanol plant, including those working outside the bioethanol plant, employed in any manner and regardless of employment status. Excluded are the managerial level employees. b. All bioethanol plant workers whose tasks and activities have been determined as contributing and/or engaged in the production of bioethanol fuel. ¢. All bioethanol plant workers hired through contracting and sub-contracting arrangement under DOLE Department Order No. 18-A, s. 2011 and DOLE Department Order No. 174, s. 2017, and performing tasks and activities that contributes and/or engaged in the production of bioethanol fuel. Proof of employment or any other record of employment shall be submitted in the availment of benefits under DOLE Department Order No. 222-21 Section 2. Profiling of Covered Workers. The Bureau of Workers with Special Concerns (BWSC) and concerned DOLE Regional-Offices are instructed to conduct the profiling of workers entitled to receive benefits under DOLE Department Order No. 222-21. The work instruction and list of documentary requirements needed to avail said benefits shall also be prepared and disseminated by the BWSC io all covered DOLE Regional Offices and stakeholders. Section. 3. Separability Clause. This Guidelines shall not be construed in any way as affecting or altering the employment status of covered workers, as defined above, and shall only be used as basis to facilitate the processing of claims under DOLE D.O. No. 222-21 Section 4. Effectivity. This Guidelines shall now form part of DOLE D.O. No, 222-21. Further, it shall take effect upon publication in a newspaper of general circulation and/or in the Official Gazette.
