1. NTPC invites on-line bids from eligible Bidders for aforesaid package, as per the scope of work
briefly mentioned hereinafter:

*The MSME Benefits as mentioned in ITB, shall be applicable for “Form of Contract/Tender
Category” type “categorized as "Services" and not for “Form of Contract/Tender Category”
categorized as “Works Contracts”.

Applicable relevant MSME Certificate should be submitted online/offline before schedule bid
submission end date & time.

Post clarifications by Ministry of MSME, dated 16th June,2021, with reference to Notification
S.O. No.2347( E) dated 16th June,21 issued by the Ministry of MSME, provisions of tender
documents are amended as below :-

The existing enterprises registered prior to 30th June, 2020 shall continue to be valid only
for a period up to the 30th day of June, 2022.
· In the list of documents acceptable for being a MSME, Udyam Registration Certificate has

been added.
· It is advised that all the Prospective Bidders shall register and obtain Udyam Registration
Certificate. It may be noted that w.e.f. 1st July, 2022, Udyam Registration Certificate shall be
only valid Certificate to avail the benefits as per Public Procurement Policy.

Note:
1. Bid Security Declaration:
Bidders are requested to give Bid Security Declaration by accepting the GTE.

By accepting the GTE-“Do you accept Bid Security Declaration” it will be considered that
Bidder has read the provisions of the bidding document and they hereby declare the
following:

a). We confirm that, in case we withdraw our offer within the validity period of the offer provided in the
bidding documents or any extension thereof, then we shall be treated as ineligible for participation in the
future tenders issued from NTPC for a period of 06monthsfrom the date of withdrawal of the bid.

b). In addition, we also confirm that in case after having been issued the Notification of Award/Purchase
Order of a package, we either do not accept the Notification of Award/Purchase Order or do not sign the
Contract or do not submit an acceptable Performance Security as per bidding documents provision, and
which result in tender being annulled then we shall be treated ineligible for participation in retendering of
this particular package and contractual action may be taken against us as per the provisions of the Bidding
documents. Further, NTPC shall also be free to take further actions as per the provisions of the policy for
Withholding and Banning of Business Dealings.

2. "Class-I local suppliers’ only are eligible to participate in this tender, as defined in the bidding
documents/ Public Procurement (Preference to Make in India), Order 2017 and its subsequent
amendments/ revisions issued by DPIIT. The bidders may apprise themselves of the relevant provisions of
bidding documents in this regard before submission of their bids."

NOTE:
Class-I Local Suppliers only are eligible to participate in this tender.

In order to confirm that bidder is a Class-I Local Supplier, bidder shall accept the GTE particular
regarding confirmation as Local Supplier in Tendering Portal.
If a Bidder has ticked the above attribute as YES under the GTE TAB in GEPNIC Portal :
Then it will be deemed that the bidder has submitted and accepted the ‘Minimum Local Content Criteria"
as mentioned in Attachment-11(Section-VII) of the subject bidding document along with the quotation.
Without the aforesaid certification bidders will not be allowed to submit their offer. No need to upload
the document "Attachment-11" separately. If attachment 11 found anywhere in the Bid Proposal, then
the acceptance of attribute will prevail.
A supplier who has been debarred / banned by any other procuring entity for violation of 'Public
Procurement (Preference to Make In India), Order 2017' (PPP-MII Order) dated 15.06.2017 and its
subsequent revisions /amendments issued by Department of Industrial Policy and Promotion (DIPP) shall

not be eligible for evaluation/preference, as applicable, under the aforesaid procedures for duration of the
debarment.

In case false declaration in respect of Local content, same shall be treated as false declaration
and will be dealt in line with the Fraud Prevention Policy of NTPC.

The bidders may apprise themselves of the relevant provisions of bidding documents in this
regard before submission of their bids.

# No Queries from Bidders, whatsoever, shall be entertained by the Employer beyond the
last date of receipt of Queries/ Pre-Bid Conference (if applicable) as specified above.

3. Any ‘Bidder from a country which shares a land border with India’, as specified in the Bidding
Documents, will be eligible to bid in this tender only if bidder is registered with the Competent Authority
as mentioned in the Bidding Documents.

However, the said requirement of registration will not apply to bidders from those countries (even if
sharing a land border with India) to which the Government of India has extended lines of credit or in
which the Government of India is engaged in development projects.

4. A complete set of Bidding Documents may be downloaded by any interested Bidder from our NIC
Portal (https://eprocurentpc.nic.in/nicgep/app).

5. Clarification on bidding documents:


A prospective Bidder requiring any clarification of the Bidding Document shall put the query under
Clarification tab of the on-line bid at least three days prior to the clarification end date. EMPLOYER
will respond to any request for clarification or modification of the bidding documents that it receives
within the time line specified.

EMPLOYER will post the Clarifications under Clarification/Corrigendum tab at e-tender website only.
Bidders can view these clarifications.

6. Transfer of Bidding Documents issued by one intending Bidder to another is not permissible.

Bidders may note that in case they do not accept the GTE conditions, their bids shall not be
evaluated and shall be rejected.
Any other condition, if mentioned in GTE, requiring any confirmation/information are to be
ticked/filled up suitably.
