Fact of the Case.

Alesha Sabat y Bugha, a 20-year old female, single, resident of Sitio Kamangan, Brgy, Poblacion Ormoc
City, Leyte, was raped at her neighbor’s home, by adding hypnotic tablets on her coffee. The suspect is
Darwin Yano y Masigasig a 23-year-old male, single, resident of Brgy, Poblacion Sitio Kamangan, Ormoc
City, Leyte, and the brother of her friend.

Alesha narrated that at about 10:10 a.m. on July 31, 2021, she arrived at the house of one of her friends
named Sophia Yano y Masigasig to give some food. Alesha said that she knocked on the door four times
and called Sophia four times, and the one who opened the door was Darwin Yano y Masigasig the eldest
brother of Sophia Yano y Masigasig. Alesha stated that after Darwin opened the door, Darwin said, “
ouh!!! Alesha Maayong Buntag! Kalami ba anang imong sud an na Gidala.”alesha said “ Lami gud dar ako
gud mismo nagluto Ani.” Based on what Alesha stated, Darwin asked her to enter their house and said
“sulod anay ari”, “Ako na ana beh” while Alesha gave the food to Darwin. According to Alesha, after
Darwin set the food on the table, she picked up her phone on the right side of her legs while
Darwin asked her to have some coffee and said, “Alesha Kape Unay ta.” Alesha stated that she noticed
Darwin close the door and lock it. Darwin offered him a coffee and said, “Diay ako gi timpla para nimuh
ouh.” Alesha stated that she asked Darwin about her sister. “Asa Tood Si Phia Dar?” And Darwin replied
to him, “Naa sa kwarto, natug siguro!” Pukawa lang!

Furthermore, the victim stated When she entered the bedroom, Darwin suddenly pushed him onto the
bed while Darwin rushed to lock the door, and she told Darwin, “Nganu man ka dar Ayaw tawn
pagbinuang.”

According to Alesha, Darwin pleaded with her to give him a chance to love him. And they say, “Unsa may
kulang sa akoa, nganung dili man ko nimuh magostohan tagae kog chance diha sa imohang dughan na
higugmaon tika lesh.” Based on what Alesha stated, Darwin placed his right hand on her left leg, but
Alesha didn’t like it, and she pushed the hand of Darwin away from her leg.

Based on what Alesha stated, she told Darwin that “ayaw ana dar, wala koy gusto nimuh sukad pa sa
una, kay bisyoso ka na pagkatawo ug walay pulos, walay magkagusto sa imo maskin ako tungod sa
imong batasan nga perting batia”. According to the victim, Darwin slapped her face and grabbed her,
and she tried to get away from the hand of Darwin. She s told Darwin, “Buhi-I ko, na unsa man ka? E
Report Tika sa police karon! “ According to the victim, she tried to pull his arms, but Darwin threatened
to kill her and said, “Patyon Tika karon Kung mo supak ka.” According also to the victim, she tried to
push him again, but Darwin was too strong, and she also started to feel dizzy and out of sobriety.

Alesha stated that she was forced and grabbed by Darwin while she was feeling dizzy and out of
sobriety. Based on what Alesha stated, she heard Darwin say “ayaw na kagahi ug ulo, Sige na” and
forced her to agree to his request to have sex with him, but according to the victim, she never agreed to
it and said “ayaw dar, tabang.”

Alesha narrated that the last thing that she remembered before she fell unconscious was that she was
punched by Darwin on her left side with the left arm.

According to Alesha after she gained her consciousness back, she felt pain In her vagina with blood on it
and Darwin was gone already.
