COMPROMISE AGREEMENT
WHEREAS, on _________________, the petitioner has initiated a civil complaint for
Custody of the minor LORRAINE ALBALADEJO now pending before this Honorable Court
docketed as Civil Case No. R-QZN-19-11983-CV.

WHEREAS, the minor LORRAINE ALBALADEJO (“Lorraine” for brevity) who was
born on _____________ in ______________ is the daughter of the petitioner Serge Vaillant and
respondent Eliza Sarong Albaladejo outside of marriage.

WHEREAS, both parties, desire to provide for a complete settlement of the issues
pertaining to the custody, visitorial rights, support, maintenance of the minor. Both parties
motivated by their mutual desire to have peace of mind, have decided to enter into a final
compromise and amicable settlement of all claims and causes of action that may be asserted
against each other, if any, now and hereafter, arising out of, and in connection, whether directly
or indirectly, with the matters concerned therein under terms and conditions mutually beneficial
and acceptable to both parties.

WHEREAS, each party acknowledges his or her personal obligations as parent of the
minor Lorraine and by these presents, each hereby undertakes to render the performance of these
obligations to the child and comply with his or her duties as a parent.

NOW, WHEREFORE, for and in consideration of the foregoing premises and


dispositions made in this agreement, the parties hereto have agreed as follows:

1. RESIDENTIAL CUSTODY, VISITATION AND ACCESS RIGHTS

a. The parents shall share in the responsibility to make decisions regarding the health,
education and welfare of Lorraine.

b. The mother shall have residential custody over the minor Lorraine who shall
maintain residence at __________________________. As such, the minor will reside
at the mother’s residential address and the father shall be entitled to visitation rights
at any reasonable time during his stay in the Philippines. In the event of the mother’s
death or in the event the mother is otherwise incapable or unable to perform her
responsibilities as custodial parent for Lorraine, the father will assume all such
responsibilities as custodial parent.
c. Each parent is authorized to take any and all actions necessary to protect the health
and welfare of the children, including but not limited to consent to emergency
surgical procedures or treatment.

d. Each parent will have access to Lorraine’s school, medical, and dental records and
the right to consult with those professionals providing services to the children.

2. CHILD SUPPORT AND MAINTENANCE

a. Immediately effective upon signing and approval by the Honorable Court this
Compromise Agreement, the father shall open a time deposit in the name of Lorraine
and maintain the said account until she reach the age of twenty one (21) years old.

b. The father shall deposit a weekly allowance of Lorraine in the amount of


₱______________ thru the bank account number ______________;

c. The above-mentioned amount may be increased depending upon the needs of


Lorraine and financial capacity of the father. As much as possible, the said amount
shall be utilized only for Lorraine’s basic needs.

3. CHILD EDUCATION

a. The father shall provide for the education of Lorraine such as but not limited to
tuition fees and miscellaneous fees. In the event that the mother advanced the
expenses in school, the father shall pay and reimburse such expenses provided that it
shall be supported by documents (e.g. receipts).

4. VACATION/TRAVEL
a. The father may take Lorraine for a vacation during holidays and special days and
may take to France during school break for no more than two (2) months.

b. The father must notify the mother verbally or in writing of their vacation plans
with a basic itinerary that includes dates of leaving and returning, destinations,
flight information, and telephone numbers for emergency purposes.

5. COURT APPROVAL OF AGREEMENT

This Agreement shall be governed by and construed in accordance with the laws of the
Republic of the Philippines. The parties hereto shall, in good faith, strictly abide by the
terms hereof.

The parties agree to submit this Agreement for the Court’s approval.
6. JUDICIAL RELIEF

Should either one of the parties fail to comply with the terms and conditions of this
Agreement, the aggrieved party may seek judicial relief against the erring party and apply
with the proper court for a writ of execution against said erring party to enforce his or her
obligations imposed in this Agreement. The offending party shall pay the cost of
litigation, attorney’s fees and interest incurred in such application for writ of execution.
